Annex 2 - Conditions consistent with the Operating Schedule
1 The premises are operated in accordance with the principles outlined by the 'Nightsafe' Scheme, as are relevant to those premises, and indicated in the associated leaflet.
2 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and having regard to the guidance under the Nightsafe Scheme.
3 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
4 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
5 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with Lancashire Constabulary.
6 Noise from any regulated entertainment or mechanical ventilation will be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
7 The volume of amplified sound used in connection with any regulated entertainment shall, at all times, be under the control of the Licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
8 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
9 All internal lobbied doors to any entrance/exit point, fire exit doors and external windows should be closed during hours of any regulated entertainment, except in the event of an emergency.
10 The Licence Holder and the Designated Premises Supervisor shall ensure that only toughened glass vessels are used to dispense beverages to customers.
11 The Licence Holder and the Designated Premises Supervisor shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
12 The Licence Holder and the Designated Premises Supervisor shall ensure that at least one Personal Licence Holder is available on the licensed premises while the supply or sale of alcohol is being undertaken and shall ensure that person's identity is known to all other staff engaged in the supply or sale of alcohol.
13 The Licence Holder and the Designated Premises Supervisor shall nominate another person who will deputise for the Designated Premises Supervisor in that person's absence and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
14 The Licence Holder and the Designated Premises Supervisor shall erect and maintain signage (in a form approved by the Licensing Authority) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of door staff to enforce a ‘no exit with a bottle’ policy.
15 The Licence Holder and the Designated Premises Supervisor shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
16 No patrons shall remain on the licensed premises (except for a period of 60 minutes to enable ‘drinking-up’) following the termination of the sale of alcohol.
17 The Licence Holder and the Designated Premises Supervisor shall ensure that the maximum number of persons allowed onto the premises shall not exceed the capacity determined by the Lancashire Fire and Rescue Service.
18 Risk assessments carried out by or on behalf of the Licence Holder which relate to a licensing objective will be made available to the Responsible Authorities.
19 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
20 The Licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate Building Regulations.
21 The Licensee shall ensure free cold drinking water is available on request and shall have adequate supplies of chilled soft drinks and bottled water available for sale at the bar(s).
22 During the final hour of daily trading the Licence Holder and the Designated Premises Supervisor shall ensure that appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
23 The Licence Holder shall erect and maintain in a prominent position at every exit a clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
24 The Licensee shall ensure that staff arriving before 09.00 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
25 The Licensee shall ensure that noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be disturbed. To this end sound insulation shall be provided and regard must be had to the ventilation requirements for the premises. All sound insulation shall be installed to the satisfaction of the Council.
26 The Licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services.
27 No Entertainment of an ‘adult’ or ‘sexual’ nature will take place upon the licensed premises.
28 When functions are taking place on the first floor:
1) the bar as marked on the plan will be used
2) No functions will be booked which target 18 - 21 year olds.
29 Waiter service will be used when the first floor licensed area is used as a residents lounge.
30 Bar staff will patrol the outside area on a regular basis to keep noise at a minimum.
31 Polycarbonate drinking vessels will be used for customers drinking on the forecourt.
32 Consumption of alcohol will not take place outside after 22:00 hours.
33 Signage will be installed to highlight the closure of the outside area at 22:00 hours.
34 The only licensable activities permitted in the outside area is the supply and consumption of alcohol.
35 Children will be accompanied by adults at all times.
36 The Licence Holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.
37 The Licence holder and / or DPS is to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future
38 Staff involved in the supply of alcohol will be appropriately trained and records maintained and available upon request. Appropriate training logs will be updated and a refusals book and the Challenge 25 scheme will be initiated.
39 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
40 The removal and movement of rubbish, bottles and any beer barrels from the premises and their subsequent storage externally to the building prior to collection, shall be undertaken between 0800 and 2200 only to prevent disturbance to local residents from such activities.
41 All external smoking areas provided for the premises shall be located in such a position so that any associated use does not cause a nuisance to any nearby noise sensitive properties. Suitable external receptacles shall be provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
42 The first floor licensed area will be covered by a minimum of three high resolution CCTV cameras (with infra-red night vision).
43 The outside area will be covered by a high resolution CCTV camera (with infra-red night vision).
44 CCTV will be installed internally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The entrance and the bar area are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
b) The system will display on any recording the correct time and date of the recording.
c) The system will make recordings during all hours the premises are open to the public.
d) VCR tapes or digital recording shall be held for a minimum of 31 days and 21 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
e) The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
45 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises is open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested, with subsequent copies of footage to be made available within 7 days if requested.
46 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
47 Bi-annual documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
48 A minimum of ten working days’ notice to Police and Licensing Authority will be given prior to any function taking place.
