Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 The means of escape shall be maintained safe and free from any obstruction when any relevant persons are admitted on the premises.
3 A fire risk assessment to be completed by a competent person and the significant findings made available for inspection by the Fire Service, Police or authorised Officer of the Council.
4 Any staff or responsible persons using the property shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by the Fire Service, Police or authorised Officer of the Council.
5 A fire alarm system to be provided that conforms to the Regulatory Reform (Fire Safety) Order 2005. The fire alarm to be tested in accordance with BS 5839 part 1. Tests shall be recorded and records made available for inspection by the Fire Service, Police or authorised Officer of the Council.
6 Escape routes, where necessary, are to be indicated and illuminated by emergency escape lighting (maintained in the licensed areas) which is to be tested in accordance with BS 5266. Tests shall be recorded and records made available for inspection by the Fire Service, Police or authorised Officer of the Council.
7 The occupancy of the licensed area is limited to the number of adequate escape routes and the floor area and shall be calculated and part of the risk assessment.
8 Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption, with or otherwise as an ancillary to, meals served in the licensed premises.
9 The Licence holder is to support and rigorously enforce the Challenge 21 proof of age policy.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
10 Noise from any regulated entertainment shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
11 All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during hours of any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
12 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
13 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.
14 The collection and disposal of bottles and refuse should not take place externally between the hours of 2200 and 0800 hours.
15 The premises licence holder shall provide adequate ventilation so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
16 The premises licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external receptacles provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
17 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
18 All external smoking areas provided for the premises shall be located in such a position so that any associated use does not cause a nuisance to any nearby noise sensitive properties.
19 Evidence of the safety of the electrical installation must be available on site for inspection and the documentation renewed at least every five years.
20 Evidence (Portable Appliance Testing) of the safety of electrical appliances in use at the premises must be available on site for inspection and must be renewed annually.
21 Evidence of the safety and maintenance of all gas appliances in the premises must be available on site for inspection and renewed annually.
22 Intoxicants to be served to residents and bona fide guests only.
23 Children are not permitted in the bar area at any time unless accompanied by an adult.
