Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

   

  3              (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  4              The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  5               (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either a holographic mark, or an ultraviolet feature.

   

  6               The responsible person must ensure that -

   

  (a) where any of the following alcoholic drinks are sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

   

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  7              (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

                (2) In this condition:-

  a.              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  i.              P is the permitted price,

  ii.              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  iii.              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  b.              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  c.              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  i.              the holder of the premises licence,

  ii.              the designated premises supervisor (if any) in respect of such a licence, or

  iii.              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  d.              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  e.              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

                (3) Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

   

                (4) Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax, the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              No entertainment of an adult nature will take place on the premises.

   

  2              An additional hour shall be added to the opening hours of the premises and the permitted hours for the supply of alcohol on the morning of Friday, Saturday, Sunday and Monday of an official English bank holiday weekend, and on the morning British Summertime commences, and on the morning of 25th and 27 December.

   

  3              Permitted hours for supply of alcohol and the opening of the premises shall be extended from the end of permitted hours on 31 December to the start of permitted hours on 1 January.

   

  4              The premises shall contain sufficient furniture and seating in order that they do not become a High Volume Vertical Drinking establishment defined in Paragraph 10.41 Statutory Guidance.

   

  5              An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.

   

  6              There will be a dispersal policy to prevent crime and disorder and to promote public safety.

   

  7              Recorded music will cease with alcohol sales. There will then be a further period of 30 minutes when incidental background music only will be played whilst drinking containers are collected, and patrons gradually dispersed towards the exits. Closure of the premises to the public will occur 30 minutes after alcohol sales terminate.

   

  8              The premises will operate under the principles outlined in the 'Nightsafe' scheme, as are relevant to the premises.

   

  9              The licence holder and / or DPS shall be a member of the Pubwatch, Clubwatch or Bar U scheme. The DPS or duty manager shall attend each meeting and will enforce the rules of such a scheme related to barred or excluded persons entering the premises.

   

  10              The premises shall be a member of the 'Radio Link' scheme whilst such a scheme is in operation. The Radio Link equipment will be live and monitored by the head doorman or other responsible member of staff authorised by the DPS.

   

  11              All staff shall receive suitable training, in particular in relation to the prevention of underage sales and sales to drunken persons. Records of such training will be available to an authorised person upon request.

   

  12              There shall be no drinks promotions which would contravene the British Beer and Pub Association Standards for the Management of Responsible Drinks Promotions including Happy Hours or the Social Responsibility for the Production and Sale of Alcoholic Drinks in the UK.

   

  13              There shall be provided at the premises door supervisors who are registered with the SIA on the nights considered appropriate, and in such a number as the Premises Licence Holder considers are sufficient as a consequence of a risk assessment to control the entry of persons to the premises and for the keeping of order in the premises when they are used for licensable activities. Such a risk assessment will be agreed with the Divisional Licensing Officer, Lancashire Constabulary.

   

  14              A record shall be kept on the premises by the DPS of every person employed on the premises as a door supervisor. The record shall contain the following details:

                i              Name, address

                ii              Date of Birth

                iii              SIA licence number

                iv              Time commenced duty and time terminated duty

   

                That record shall be available for inspection on demand by an authorised person, the SIA or a Police Constable.

   

  15              An incident book will be maintained, in which shall be recorded

                a.              All incidents of crime and disorder

                b.              Refused sales to suspected under age / drunken persons

                c.              A record of any person refused admission or asked to leave the premises

                d.              Details of occasions upon which the police are called to the premises

                e.              The use or discovery of drugs.

                That book shall be available for inspection by a Police Officer or authorised person.

   

  16              Door supervisors will ensure that no customer shall enter or leave the premises from / to the public highway or public place with any open bottle, glass or container except by way of trade delivery.

   

  17              Door delivery shall control the queue to the premises to ensure that customers are advised of the amount of time they are going to have to wait to gain entry and to prevent any customers who have behaved in such a way as to cause a public nuisance or disturbance from entering the premises.

   

  18              Door supervisors registered with the SIA shall keep an accurate record of the numbers in attendance in the premises at any one time by the use of counting devices or other electronic means provided by the premises, and the person in charge of the premises / door supervisors shall provide this information to the Police / authorised person on demand.

   

  19              All door staff will wear conspicuous clothing as agreed with the Divisional Licensing Officer, Lancashire Constabulary.

   

  20              CCTV shall be provided in the form of a recordable system capable of providing pictures of evidential quality in all lighting conditions to a sufficient standard as agreed with the Divisional Licensing Officer, Lancashire Constabulary.

   

  21              The CCTV equipment shall be maintained in good working order, correctly time and date stamped. Any technical defect will be repaired as soon as possible.

   

  22              Recordings shall be kept in date order, numbered consequentially and kept for a period of 31 days and handed to police on request under Section 19 of the Data Protection Act 1994.

   

  23              Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions in the premises.

   

  24              A sign shall be prominently displayed at the exit to the premises informing customers that they are leaving the premises into a public CCTV monitored area for their safety.

   

  25              There shall be in force for the premises a search policy for prospective customers, which shall be developed in liaison with and to the satisfaction of Lancashire Constabulary, whereby as a condition of entry, customers consent to search for drugs and weapons.

   

  26              There shall be displayed at the entrance to the premises a notice informing prospective customers of the search policy.

   

  27              Any drugs confiscated or coming into possession of the premises shall be stored, disposed of and transferred in accordance with procedures agreed with the Divisional Licensing Officer, Lancashire Constabulary.

   

  28              There will be a zero tolerance drugs policy referred to in the statutory guidance and safer clubbing publication.

   

  29              At least one personal licence holder who will be contactable at all times, shall be designated during the sale of alcohol hours. His identity and phone number will be available to the duty supervisor. All staff shall be aware of the identity of the duty supervisor.

   

  30              Risk assessments shall be carried out to promote the licensing objectives and will be available for inspection by an authorised person.

   

  31              The premises will be subject to risk assessment under the Regulatory Reform (Fire Safety) order 2005 from which the maximum safe capacity will be derived.

   

  32              There will be frequent collections of drink containers and glassware to avoid accumulation.

   

  33              No public nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.

   

  34              The Control of Noise at Work regulations 2005 will apply to these premises.

   

  35              Noise levels eminating from any licensable activity at the premises shall not at any time exceed the limits laid down in the Permitted Level of Noise (England) Directions 2008.

   

  36              The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.

   

  37              There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly.

   

  38              During the final hour of daily trading, appropriate announcements will be made or images projected to inform customers of the need to leave the premises without causing annoyance, nuisance or disturbance. They will be reminded of the location of any transport free-phone or nearest taxi rank or hailing point.

   

  39              All external doors and windows in any room where regulated entertainment is taking place shall be closed at all times except in emergency and to facilitiate immediate access or egress.

   

  40              All external lighting and signage, except that identified as necessary under the Health and Safety at Work Act risk assessment, will be extinguished immediately after the terminal time for the sale of alcohol, unless such lighting is requested by the Divisional Licensing Officer, Lancashire Constabulary, to improve lighting levels in supporting public CCTV coverage.

   

  41              No bottle bins will be emptied into external trade wastebins between 2300 and 0700 hours.

   

  42              Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of one of the following:

                i.              A recognised proof of age card accredited under the British Retail Consortium's Proof of Age Standards Scheme (PASS)

                ii.              Photo driving licence

                iii.              Passport

                iv.              Citizen card supported by the Home Office

                v.              Official ID card issued by HM Forces or EU bearing a photograph and birth of the holder

   

  43              British Beer and Pub Association and/or Trading Standards 'Challenge 21' posters / notices shall be prominently displayed at the entrance to the premises and near to the alcohol servery.

   

  44              No person under the age of 18 years shall be allowed to enter or remain on the premises after 21.00 hours, and before 21.00 hours shall only be admitted in the company of a person of at least 18 years. The exception to this condition  shall be where a person under the age of 18 years is attending a pre-arranged, private function, in which case they shall not be allowed to enter or remain on the premises after midnight.

   

  45              Signs shall be prominently displayed at the entrance to the premises stating the restriction of entry to the premises by persons under 18 years of age.

   

  46              Any gaming machine in the premises will comply with the Code of Practice issued by the Gambling Commission under Section 24 of the Gambling Act 2005.

   

  47              Where commercially available, toughened glasses will be utilised at the premises.
