Annex 2 - Conditions consistent with the Operating Schedule
1 CCTV shall be provided in the form of a recordable system, which shall be maintained in good working order correctly time and date stamped.
2 A staff member that is conversant with the operation of the CCTV system will be on the premises at all times licensable activities are taking place, such staff member to comply with any request by the Police to view or be supplied with data or footage without any unreasonable delay.
3 Recordings shall be kept in a secure environment under the control of the DPS or other nominated responsible individual for a minimum period of 31 days and handed to police on request.
4 Appropriate signage representative of the above shall be displayed in conspicuous positions.
5 The premises shall not engage in irresponsible drinks promotions.
6 No person in possession of open or sealed bottles shall be allowed to enter the premises at any time that licensable activities are taking place.
7 Regular toilet checks will be undertaken to ensure the area is not being used for criminal activities.
8 Electrical equipment will be inspected on an annual basis.
9 Fire extinguisher and fire alarm checks will be made and inspected on an annual basis.
10 Signs requesting that customers leave the premises quietly shall be displayed at the exits.
11 A Challenge 21 scheme will be in operation at the premises - the only form of valid identification will be a passport, photo driving licence or PASS hologram ID card.
12 Unaccompanied children will not be allowed to enter the premises.
13 Persons under the age of 18 (accompanied by an adult) will be allowed access to the whole of the premises.
14 On New Year's Eve licensable activities shall be extended from the start of permitted hours on 31 December to the terminal hour for licensable activities on 1st January.
15 An additional hour is permitted on the night the clocks go forward for British Summer Time.
16 No entertainment of an adult nature will take place on the premises.
17 The occupancy limits for the premises are as follows:
Ground Floor 220 persons
First Floor 115 persons
18 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
19 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
20 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.
21 All door staff employed at the entrance/exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
22 The Local Authority CCTV control room will be notified: (a) On any occasion when the CCTV or radio system at the premises is inoperative; & (b) When the CCTV or radio system has been brought back into use.
23 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
24 The premises shall be operated in participation with the 'Pubwatch' Scheme.
25 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
26 Only Toughened glass vessels are used to dispense beverages to customers.
27 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
28 The licence holder and DPS shall erect and maintain signage (in a form approved by the licensing authority) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of doorstaff to enforce a 'no exit with a bottle' policy.
29 The licence holder and DPS shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
30 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
31 Where there is reasonable suspicion that drugs are being carried, the DPS shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
32 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that (a) It is a condition of entry that customers agree to be searched and (b) Police will be informed if anyone is found in possession of controlled substances or weapons.
33 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
34 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
35 Records of Incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
36 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
37 A drugs prevention strategy for the venue shall be developed and applied. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
38 Speakers for the amplification or music or speech should not be positioned in the entrance doorway or lobby
39 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
