Annex 2 - Conditions consistent with the Operating Schedule
1 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
2 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ scheme.
3 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
4 The premises shall fund the employment by the Local Authority of one member of the door supervisor team for a period of one hour after licensable activity has ceased upon the licensed premises on the proviso that other premises within the area are also complying with this condition.
5 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
6 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities. CCTV recordings will be kept for a minimum of 28 days and produced for inspection on request by an authorised officer.
7 The Local Authority CCTV control room will be notified.
a) On any occasion when the premises CCTV or radio system is operative.
b) When the CCTV or radio system has been brought back into use.
8 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
9 The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
10 Only toughened glass vessels are used to dispense beverages to customers.
11 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
12 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Initiative, as are relevant to those premises, and indicated in the associated leaflet.
13 The premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes
14 The premises shall be operated in compliance with the recommendations contained in Safer Clubbing.
15 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
16 Adequate first aid provision is available at all times to include having at least one trained first-aider on the premises at all times the premises are being operated.
17 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
18 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
19 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
20 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
21 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
22 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
23 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
24 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary
25 A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
26 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
27 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
28 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises
29 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
30 The following non standard timings shall apply for the performance of live music, playing of recorded music, performance of dance & facilities for dancing, any entertainment of a similar description and the opening hours of the premises:
In relation to the morning on which summer time begins, references to five o’clock in the morning should be replaced by references to six o'clock in the morning.
On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December).
31 A Supervisors Register will be maintained on site showing the names, addresses and contact details for the DPS and all Personal Licence holders employed at the premises. The Register will state the name of the person in overall charge of the premises at each time the licensed activities are taking place and will be retained for a period of 12 months and produced for inspection on request by an authorised officer.
32 All doorstaff to sign in and out for each shift, this record to be kept for a minimum of 12 months and contain consecutively numbered pages and produced on request for inspection by an authorised officer.
33 All incidents are to be logged. The incident log will contain consecutively numbered pages and be retained for a minimum of 12 months, produced for inspection on request by an authorised officer.
34 Entry will be refused to anyone who is drunk, behaving in a violent or threatening manner, or who has been convicted of behaving in a violent or threatening manner. Signage will state this policy.
35 All bar staff are to be trained in basic licensing law, particularly with regard to serving drunks and persons under 18.
36 Public safety notices re. drugs, alcohol, unlicensed taxis and the Heaven and Hell sensible drinking guide shall be displayed in the toilet areas.
37 Toilet attendants are employed to monitor toilet areas for violence, impropriety, drug use, health and safety checks and general cleaning standards.
38 A fire risk assessment is to be in effect and stored in the fire book (kept in the safe). The Head Doorman or duty manager checks that all fire exits are clear and unlocks them prior to opening, this is recorded in the fire book and all chains are stored on a numbered board.
39 All staff are to be trained in fire evacuation, use of fire fighting equipment and fire alarm stages on induction and thereafter every six months, the training being recorded in the fire book.
40 Customer numbers within the venue are to be recorded on the admission control form (stored in the fire book) every half hour by management.
41 A manager is to check the building for fire risks at the beginning, during and close of each operational session, the checks being recorded in the fire book.
42 There is to be a written procedure for the safe evacuation of disabled persons.
43 All curtains, drapes, fabric, foliage, wallpaper, floorcoverings and upholstery filling materials will be fire retardant. Certificates of compliance will be available on request by an authorised officer.
44 Electrical installations will be inspected and certified by a qualified and competent person at least every five years. These certificates will be kept and made available on request to an authorised officer.
45 Portable appliances will be tested annually by a qualified and competent person. Records will be kept and made available on request to an authorised officer.
46 Gas installations will be inspected and certified by a qualified and competent person annually. These certificates will be kept and made available on request to an authorised officer.
47 Business waste from the premises will be stored correctly and legally.
48 Promotional material discarded by patrons in the immediate area will be swept up by staff.
49 The DPS will ensure all promotional materials are displayed lawfully. The DPS will take measures to encourage any party acting on his behalf to display promotional material lawfully.
50 The premises supports and rigorously enforces the Challenger 21 proof of age policy.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: -
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
51 On occasions when Designated Under 18s events are operated for 14-17 year olds the DPS will undertake to give 28 days written notice of all such events to the Police and Local Authority.
52 At Under 18 events all customers are searched by an SIA registered person of the same gender.
53 At Under 18 events all customers are 'breath checked' for alcohol. Any person found to have consumed alcohol will be refused admission.
54 At Under 18 events any person who is removed from the building or found to have consumed alcohol who is alone or deemed to be vulnerable either due to their age or intoxication will be detained and their parents contacted or be passed to the Police.
55 At Under 18 events designated pick up points for parents are identified so as to limit congestion and minimise public nuisance.
56 At Under 18 events all games machines and cigarette machines will be disconnected. All alcohol and alcohol advertising is to be covered or removed during such events and no alcohol is to be served.
57 Entry to Under 18 events is restricted to those between 14-17 years old. Acceptable ID for 14-16 year olds is the Citizen Card. 17 year olds may use ID as per the Challenger 21 policy.
