Annex 2 - Conditions consistent with the Operating Schedule
1 Non standard timings applicable to all licensable activities:
i. From the end of permitted hours on New Year's Eve to the start of permitted hours on New Year's Day;
ii. An additional hour on Christmas Eve, Boxing Day, St George's Day, St Patrick's Day, the Thursday preceeding Good Friday, and the Friday, Saturday and Sunday of each Bank Holiday weekend.
2 No irresponsible sales promotions of alcoholic beverages shall be offered to customers.
3 No customers carrying open or sealed bottles shall be admitted to the premises at any time that the premises are open to the public.
4 A sign will be displayed on the premises indicating the standard hours during which the sale of alcohol is permitted.
5 The Designated Premises Supervisor will be a member of the local Pubwatch.
6 Notices detailing the action to be taken in the event of fire or other emergencies, including how the fire brigade shall be summoned, are to be prominently displayed.
7 A sign will be located at the exit(s) requesting that customers leaving the premises do so quietly and with consideration to neighbours.
8 No one under the age of 18 will be allowed to enter or remain on the premises.
9 Noise from any regulated entertainment will be inaudible at the nearest sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to neighbouring residents or their guests.
10 There shall be no audible noise or perceptible vibration through the fabric of the building or structure to any habitable part of any adjoining property. (Habitable part means any part of the building or outdoor space, in substantial use at the time of the entertainment and does not include bathrooms, toilets, corridors or access lobbies).
11 The volume of amplified sound used in connection with entertainment shall, at all times, be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
12 Should the licence holder upgrade their entertainment facilities, they shall consult with the Local Authority as to the suitability of these facilities and shall carry out any testing or measurements and install any equipment or carryout any works necessary to attenuate or minimize the effects of noise or vibration, as directed by the Head of Environmental Services or his representative.
13 During regulated entertainment all windows and doors will remain closed except in the event of an emergency and for access and egress.
14 SIA registered door supervisors will be used on Friday and Saturday evenings from 21.00 during the season (Easter to the end of the Illuminations) and a risk assessment will be carried out during the winter to determine the requirements of such supervisors. This will be reviewed regularly.
15 All fire doors will be maintained effectively and shall be self closing and shall not be held open other than by approved devices.
16 Weekly health and safety checks will be carried out at the premises along with risk assessments and fire risk assessments which will be reviewed regularly.
17 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
18 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
19 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the Licensing Objectives. All training to be documented and records made available on request to Lancashire Police or any officer acting on behalf of a Responsible Authority.
20 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.
21 CCTV will be installed internally and externally at the premises. Said CCTV system shall comply with the following criteria:
(a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, shall be covered by the system.
(b) The system shall be recording during all hours the premises are open to the public.
(c) VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the police for inspection upon request.
(d) the system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
22 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises are open to the public. This staff member will be able to show police, or any officer acting for a Responsible Authority, recent data or footage with the absolute minimum of delay when requested.
23 The licence holder shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
24 The licence holder and the DPS are to support and rigorously enforce a Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
UK photo driving licence
passport
Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
If no suitable identification is provided, sale of alcohol to them will be refused.
Signs promoting this policy shall be prominently displayed around the premises.
25 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
26 The premises will have a zero tolerance policy towards drugs.
27 An incident book will be maintained, in which shall be recorded :
All incidents of crime and disorder
Refused sales to suspected under age / drunken persons
Details of any person refused admission or asked to leave the premises
Details of occasions upon which the police are called to the premises
The use or discovery of drugs
That book shall be available for inspection by a Police Officer or authorised officer of a responsible authority.
28 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
