Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 No intoxicating liquor shall be sold or supplied on the premises otherwise than to a person who has attained the age of 18 years and:
i) is attending a pre-arranged private function, OR
ii) is taking a table meal there and for consumption by such a person as ancillary to his meal
3 The Premises Licence Holder and Designated Premises Supervisor shall nominate another person who will deputise for the Designated Premises Supervisor in the DPS's absence and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
4 There will be sufficient members of staff in the function room and dining room to ensure glasses are cleared on a regular basis.
5 No patrons shall remain on the licensed premises (except for a period of 20 minutes to enable 'drinking up') following the termination of licensable activity.
6 At the terminal hour for the supply of alcohol the exit doors will be manned by staff to prevent any persons attempting to gain access from outside or to take glasses or bottles off the premises. Taxis will be arranged if required and the premises licence holder will actively discourage excessive drinking and drunken behaviour.
7 Empty bottle bins are kept behind the bar / kitchen service area where customers have no access.
8 The premises will have a zero tolerance policy towards drugs. Regular checks of toilets will take place to ensure that no drug activity can take place.
9 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
10 Where functions are not aimed specifically at family groups children will be expected to vacate the premises by 9pm and this will be made clearly visible by way of notices at the premises. A clear distinction will be made between functions aimed at families or where children are not permitted.
11 The function room has a maximum capacity of 50 people. Further capacity is provided in the dining room.
12 At least one personal licence holder (whose identity will be known to all other staff engaged in the sale or supply of alcohol) will be available whenever the sale or supply of alcohol is being undertaken, except in the case of emergency.
13 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
14 CCTV will be installed internally at the premises. Said CCTV system shall comply with the following criteria:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, shall be covered by the system.
b) The system shall be recording during all hours the premises are open to the public.
c) VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the Police for inspection upon request.
d) The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
15 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a Police Officer or to a Local Authority Enforcement Officer.
16 The licence holder and the DPS are to support and rigorously enforce a Challenge 21 Proof of Age Policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i) UK photo driving licence
ii) Passport
iii) Proof of age standards scheme card
OR any other nationally or locally approved form of identification which may be introduced in the future.
If no suitable indentification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
17 All staff to have received suitable training in relation to the proof of age scheme to be applied on the premises. Records to evidence this will be made available to an authorised officer upon request.
18 Any person under the age of 16 must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.
19 Functions which specifically target young people, for example 18th birthday parties, will not be allowed to take place at the premises.
20 An incident book will be maintained, in which shall be recorded:
a. All incidents of crime and disorder
b. Refused sales to suspected under age / drunken persons
c. A record of any person refused admission or asked to leave the premises
d. Details of occasions upon which the Police are called to the premises
e. The use or discovery of drugs
21 That book shall be available for inspection by a Police Officer or authorised person.
22 The total capacity of the premises will not exceed 50 persons.
23 The outside area will be closed for the consumption of alcohol from 9pm onwards.
24 Alcohol will only be served in toughened glass or polycarbonate vessels only.
25 Noise from any regulated entertainment will be inaudible at the nearest noise sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the nearest noise-sensitive premises.
26 All external windows, fire doors and internal doors leading into the licensed area which by their opening would allow noise from regulated entertainment to escape externally and cause disturbance to occupants of the nearest noise sensitive premises should remain closed during the provision of the said regulated entertainment except when being used as an escape route in the event of an emergency.
27 The removal and movement of rubbish, bottles and any beer barrels from the premises and their subsequent storage externally to the building prior to collection, shall be undertaken between 08.00 and 22.00 hours only, to prevent disturbance to local residents from such activites.
28 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by customers, clear and legible notices requiring patrons to leave the premises and the area quietly so as to minimise disturbance to local residents.
29 All external smoking areas provided for the premises shall be located in such a position so that any associated use does not cause a nuisance to any nearby noise sensitive properties. Suitable external receptacles shall be provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
