Annex 2 - Conditions consistent with the Operating Schedule
1 The premises licence holder, DPS, management and staff will constantly assess any risks to the licensing objectives. They will work in partnership with the authorities and local people alike in this respect. The staff will be properly authorised, equipped, trained and motivated in this task.
2 There will be a written record of authority for all staff who sell alcohol.
3 Comprehensive training will be given to all staff in the main requirements of the Licensing Act 2003, the specific measures and conditions in place to promote the Licensing Objectives and the staff roles and responsibilities. Such records shall be available for inspection by the responsible authorities.
4 Contact details of the Designated Premise Supervisor will be available to all staff and to the authorities.
5 The premises will operate as a hotel with the sale of alcohol being primarily for residents and their bona-fide guests, although the public may use the licensed bars until 2300hrs each day, leaving the hotel 30 minutes later. Non-residents may also enjoy licensable activity at the hotel until 0300 on New Year’s Day.
6 Live and Recorded Music (Regulated Entertainment) shall be limited to the basement bar area.
7 The management and staff will take all necessary steps to ensure that the premises remain free from crime and disorder and neither cause or contribute to crime and disorder in the area.
8 Staffing levels will be maintained appropriately to ensure adequate security.
9 Staff will be trained on security issues including how to identify and refuse service to customers that are drunk or appear to be drunk.
10 There will be a policy of zero tolerance to drugs and weapons at the premises.
11 A CCTV system shall be designed, installed and operated in accordance with the recommendations of the Police and Licensing Authority.
12 The CCTV system shall be in operation at all times when licensable activities are taking place.
13 CCTV recordings will be available for a minimum period of 28 days and handed to the police or duty authorised officers of the council upon request.
14 The CCTV system shall be secure and under the control of the premises holder or other named individual.
15 The management and staff will have an effective policy to maintain a safe venue for customers and staff. Any risk to safety will be assessed before the premises are opened to visitors each day and throughout the hours of operation.
16 The DPS will liaise with the authorities to ensure that all aspects of public safety are adhered to.
17 The entrance and passageways and exit routes within the premises will be kept free from obstruction.
18 Appropriate firefighting equipment will be installed and maintained at the premises and staff trained in its use.
19 Fire risk assessments will be undertaken and acted upon in accordance with current recommendations and requirements.
20 Effective lighting will be maintained and operated to ensure the safety of the residents, visitors and staff.
21 The approved arrangements at the premises, including means of escape provisions, emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.
22 The means of escape provided for the premises shall be maintained, unobstructed, free of trip hazards, be immediately available and clearly identified in accordance with the plans provided.
23 The DPS and staff are mindful of the need to reduce the impact of any nuisance caused by the operation of the premises, and will constantly assess the risk of public nuisance and take immediate steps to eliminate the problem.
24 The premises and public areas nearby will be kept free from litter associated with the operation of the business.
25 Noise, vibrations, smells, light pollution and any other potential nuisance will be monitored and kept to an acceptable level.
26 Notices will be appropriately displayed requesting guests to be quiet and considerate to local residents when they leave the premises.
27 Glass bottles will not be placed in external refuse receptacles between the hours of 22.00 hrs to 08.00 hrs the following morning.
28 Patrons smoking outside the premises will do so in an orderly manner and will be supervised by staff so as to ensure that there is no public nuisance or obstruction of the public highway.
29 Live or recorded music from regulated entertainment shall to be audible at the nearest noise sensitive property, insofar as it would cause a disturbance to local residents.
30 The premise licence holder or his/her representative shall conduct regular assessments of the noise coming from the site on each occasion they are used for regulated entertainment. Appropriate steps shall be taken to reduce the level of noise where it is found to be heard at the facade of the nearest residential property.
31 The premise licence holder will ensure that the loudspeakers shall not be located at entrance lobbies or outside areas.
32 Any complaints received about noise shall be logged and any appropriate remedial action taken as a matter of urgency.
33 The hotel will be promoted as family friendly and suitable for all ages. There will be no inappropriate entertainment, promotions, activities or behaviour tolerated at the premises that might put children at risk.
34 There will be an effective age verification policy in accordance with the mandatory code, this policy will be one of Challenge 25 for age restricted products.
35 There will be an appropriate display of notices relating to the Challenge 25 policy within the premises.
36 Displayed notices will indicate that any customer not appearing to have reached the age of 25 will be required to produce appropriate identification proving that they have turned 18 before being sold alcohol.
37 Appropriate ID for age verification will be a valid passport, photo driving licence, PASS accredited proof of age card or other reliable photo ID, which is recommended and approved for acceptance by the police or other authorities.
38 Staff shall be trained in aspects of responsible alcohol retailing and in particular the Protection of Children including the Challenge 25 policy.
39 Staff training will occur before a staff member is authorised to see alcohol within the premises.
40 An adequate number of licensed door supervisors shall be on duty as appropriate to any risk assessment determined by the premises licence holder.
