Annex 2 - Conditions consistent with the Operating Schedule
1 Till prompts regarding underage sales will be in place.
2 Whenever the DPS is not at the premises another person shall be nominated by them to be the responsible person to manage the premises.
3 No entertainment of an adult nature will take place on the premises.
4 A written delegation of authority record will be kept at the premises whereby non personal licence holders are authorised to make sales on behalf of a personal licence holder.
5 At least one Personal Licence holder will be available (this does not mean necessarily present at the premises) at all times that alcohol is on sale.
6 A digital CCTV system will be installed and maintained, such system to be fit for the purpose and to be to the reasonable satisfaction of the Police.
7 The CCTV system will incorporate a camera covering each of the entrance doors and the alcohol display areas and will be capable of providing an image which is regarded as identification standard. The precise positions of the cameras may be agreed, subject to compliance with Data Protection legislation, with the Police from time to time.
8 The CCTV system will incorporate a recording facility and any recording shall be retained and stored in a suitable and secure manner for a minimum of 31 days and shall be made available, subject to compliance with Data Protection legislation, to the Police for inspection on request.
9 The CCTV system will display on any recording the correct time and date of the recording.
10 A system will be in place to maintain the quality of the recorded CCTV image.
11 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show Police recent data or footage with the absolute minimum of delay when requested.
12 All cashiers shall be instructed to record in an incident book / register:
i. All incidents of crime and disorder occuring at the premises.
ii. Details of occasions when the Police are called to the premises.
This record will be available for inspection by a Police Officer on request.
13 The licence holder shall ensure that all cashiers are trained to ask any customer attempting to purchase alcohol, who appears to be under the age of 25 years (or older if the licence holder so elects), for evidence of age. This evidence shall be photographic, such as passport or photographic driving licence until other effective identification technology (for example thumb print or pupil recognition) is introduced. All cashiers will be instructed, through training, that a sale shall not be made unless this evidence is produced.
14 All staff engaged or to be engaged in the sale of alcohol on the premises shall receive the following training in age restricted sales:
i. Induction training which must be completed and documented prior to the sale of alcohol by the staff member,
ii. Refresher / reinforcement training at intervals of no less than 6 months.
15 All cashiers shall be trained to record refusals of sales of alcohol in a refusals register. The register will contain:
i. Details of the time, day and date the refusal was made
ii. The name of the staff member refusing the sale
iii. A description of the young person attempting to purchase
iv. Details of the alcohol the young person attempted to purchase.
16 The licence holder will at all times maintain adequate levels of staff. Such staff levels will be disclosed, on request, to the licensing authority and the Police. There must be a minimum of 2 members of staff on duty from 18.00 hours until closing on Friday, Saturday and Sunday. This condition is only in force from 1 April to 5 November each year.
17 Signage will be displayed at the exit of the premises requesting customers leaving the premises late at night to do so quietly and with consideration so as not to disturb nearby residents and to remind customers that drinking on the street is prohibited.
