Annex 2 - Conditions consistent with the Operating Schedule
1 Noise from any Regulated Entertainment or Mechanical Ventilation will be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of those properties or their guests.
2 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
3 The volume of amplified sound used in connection with any Regulated Entertainment shall, at all times, be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
4 All external windows and doors should be closed during any hours of Regulated Entertainment, except in the case of an emergency.
5 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
6 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment in accordance with the guidance under the ‘Nightsafe’ scheme.
7 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
8 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
9 Only toughened glass vessels are used to dispense beverages to customers.
10 At least one personal licence holder will be contactable while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
11 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Initiative, as are relevant to those premises, and indicated in the associated leaflet.
12 The premises shall be operated in participation with the ‘Pubwatch’ scheme.
13 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
14 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
15 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
16 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
17 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
18 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
19 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
20 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
21 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
22 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
23 The Licence holder and the DPS shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
24 The Licence holder and the DPS shall erect and maintain signage (in a form approved by the Licensing Authority) on or adjacent to all staffed exits advising patrons of the street Drinking Order and the intention of door staff to enforce a 'no exit with a bottle' policy.
25 The licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate Building Regulations.
26 The licensee shall ensure that free cold drinking water is available on request and adequate supplies of chilled soft drinks and bottled water are available for sale at the bar(s).
27 The Licensee shall ensure that staff arriving before 0900 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbances to nearby residents.
28 Litter arising from take away food premises may cause nuisance in thoroughfares some distance from the Licensed premises. The Council's Director of Technical Services may publish a plan to locate approved receptacles in appropriate positions to mitigate this nuisance. The Licence Holder will provide a litter receptacle of a type approved by the Director of Technical Services to be located in a position identified on the published plan or in the absence of such a plan in a position in the vicinity of the licensed premises.
29 The Licence Holder will arrange for litter dropped in the vicinity of the licensed premises to be collcted and removed at the licence holder's expense at a frequency of not less than sixty minute intervals during opening hours.
30 For the purpose of the two conditions above the 'collection and removal of litter' should be taken to include the washing away to the gutter of spilled food and similar materials so as to leave the footway in a clean, safe and wholesome condition.
31 The placing of refuse, such as bottles, into receptacles outside the premises shall take place between 0800 and 2200 hours so as to prevent disturbance to nearby premises.
32 The Licensee shall ensure that noise or vibration shall not emanate from outside the premises such as to cause persons in the neighborhood to be disturbed. To this end sound insulation shall be provided and regard must be had to the ventilation requirements for the premises. All sound insulation shall be installed to the satisfaction of the Council.
33 Unaccompanied children will not be allowed upon the premises except when patronising the fish and chip shop.
34 The licence holder shall not permit the admission of persons under 18 years of age to the licensed premises and shall operate a Challenger 21 proof of age policy: Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: UK photo driving licence, Passport, Proof of Age Standards Scheme Card.
35 No entertainment of an 'adult' or 'sexual' nature will take place upon the licensed premises.
36 The Licence Holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.
