Annex 2 - Conditions consistent with the Operating Schedule
1 Sale of alcohol will be permitted at any time:
a. To persons staying at the premises, for consumption either on or off the premises,
b. To any guest of a person staying at the premises, for consumption on the premises,
c. To persons employed on the premises for the purposes of the business carried on there, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises, for consumption on the premises.
2 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.
3 The premises shall be operated in participation with the ‘Pubwatch’ scheme (radio link if applicable).
4 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
5 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
6 Only toughened glass vessels are used to dispense beverages to customers.
7 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
8 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
9 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
10 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
11 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
12 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
13 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
14 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
15 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
16 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
17 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
18 Noise from any regulated entertainment will be inaudible at the nearest sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to neighbouring residents or their guests.
19 Regulated entertainment should only take place in the rear ground floor function room.
20 All external windows in the function room to remain closed during regulated entertainment except in the event of an emergency.
21 Regular assessments of noise coming from the premises during regulated entertainment to be made and the noise level adjusted accordingly.
22 The premises will adopt a 'No Proof - No Sale' policy and will only accept photo driving licences, passports or Proof of Age Standards Scheme (PASS) accredited proof of age cards.
23 The maximum number of persons to be accommodated in the bar area or any part of the bar area at any one time shall be 400.
24 The licensee shall exclude any customers known to have been previously convicted of committing criminal offences relating to drugs.
25 The licensee shall provide and maintain suitable and sufficient surveillance.
26 The licensee shall store, dispose, transfer confiscated drugs and / or supervise individuals who are believed to have committed a criminal offence in accordance with procedures agreed with the Lancashire Constabulary.
27 The licensee shall develop and apply a drugs prevention strategy for the venue. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drug risks, the dangers associated with drugs and the legal provisions relating to drug use.
28 The licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate Building Regulations.
29 The licensee shall provide free cold drinking water available on request and shall have adequate supplies of chilled soft drinks and bottled water available for sale at the bar(s).
30 The licensee and all managers shall produce evidence to demonstrate that they are suitably trained in all aspects of the safe and efficient running of the venue.
Conditions in relation to Boxing Events:
1 Boxing events will be restricted to no more than five occasions per year. On these occasions no less than 14 days written notice will be given to the Police and the Licensing Authority.
2 No alcohol to be served or consumed in the arena and no children under the age of 18 are allowed on the premises. All drinks to be served in plastic containers and bottles.
3 There will be adequate stewarding provided by a professional security company. All stewards will be licensed.
4 The arena will be cleared immediately after the event has finished.
