Annex 2 - Conditions consistent with the Operating Schedule
1 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Initiative, as are relevant to those premises, and indicated in the associated leaflet.
2 The premises shall be operated in compliance with the recommendations contained in Safer Clubbing.
3 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
4 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ scheme.
5 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
6 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard/armband of a design approved by the Lancashire Constabulary.
7 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
8 The Local Authority CCTV control room will be notified:
a) On any occasion when the premises CCTV or radio system is operative,
b) When the CCTV or radio system has been brought back into use.
9 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
10 Only toughened glass vessels are used to dispense beverages to customers.
11 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
12 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
13 Adequate first aid provision is available at all times.
14 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
15 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
16 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
17 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
18 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
19 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
20 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
21 A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
22 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
23 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
24 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
25 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
26 The DPS will maintain a daily record comprising of the following:
i. Start time and finish of each door supervisor
ii. A record of the door staff SIA Badge numbers
iii. The door staff's printed names and signatures on a legible form recorded at the beginning and the end of each tour of duty.
The record will be kept securely on the premises for at least six months and shall be produced on request to the Police or other authorised person.
27 No person in possession of a drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery.
28 No drink shall be removed from the premises in an unsealed container and off sales shall terminate at 2300 on Fridays, Saturdays and Sundays preceding Bank Holidays.
29 The Licence holder is to support and rigorously enforce Challenger 21 proof of age policy.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: -
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
30 A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
31 The Licence Holder and / or DPS or a person nominated by them shall be a member of and regularly attend at the meetings of any Pub and Club watch scheme for the area within which the premises is located and would register in and use any Community radio network available in the South Shore area.
32 The Licence Holder will maintain records of all checks and precautions relating to Health and Safety at Work, Fire Safety, Food Safety and Crime and Disorder.
33 The Licence Holder will display (at a suitable location upon the premises) campaign material produced by the community safety partnership.
34 Door staff will be equipped with 'clickers' to keep and record an accurate record of the capacity for the premises.
35 The Licence Holder shall arrange adequate supervision of any queue which may form to gain entry to the premises.
36 The Licence Holder shall erect and maintain signage in a form approved by the Licensing Authority on or adjacent to the staffed exit advising patrons of the Street Drinking Order and the intention of door staff to enforce a 'no exit with a bottle' policy.
37 No nuisance shall be caused by noise coming from the premises or vibration transmitted through the structure of the premises. In this condition reference to noise and vibration shall also include any noise or vibration arising from any ventilation, air conditioning or refrigeration equipment provided or used in association with the licensed premises.
38 The Licence Holder will ensure that the fire doors at the rear of the premises are not used as an entrance or exit and are only used in the event of an emergency or for the removal of rubbish and similar and the reception of goods or service.
The operation of the rear doors will be monitored.
In particular the disposal of bottles and rubbish will be undertaken only between 0800 and 2200.
The Licence Holder will ensure that entry and exit by patrons will solely be by means of the Waterloo Road entrance.
The inner doors at the foot of the entrance staircase and the double doors giving access to the emergency exits adjacent to the beer store will be kept closed.
39 The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents.
40 No deliveries, removal of bottles and refuse and other vehicle movements onto the premises will take place before 0730 and after 2000.
41 There shall be no emission from the premises of any offensive smells, which are likely to cause a nuisance.
42 There shall be provided at the premises covered and lockable containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.
43 No light from or on the premises and any other light under the control of the premises shall be provided where that light causes a nuisance to nearby premises.
44 The Licence Holder will ensure that entertainment provided upon the premises is inaudible at the boundary at the nearest point to any occupied dwelling and for this purpose shall undertake a noise assessment, employing a suitably qualified sound consultant to identify any necessary remedial works in agreement with the Head of Environmental Services. The applicant will not undertake any extension of hours for amplified regulated entertainment until such works are complete.
45 The Licence Holder shall erect and maintain suitable and sufficient signage on the exterior of the premises advising patrons that any disturbance or disorder while awaiting admission will result in admission being refused.
46 The Licence Holder shall erect and maintain suitable and sufficient signage at the exit of the premises requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
47 No person under the age of 18 years shall be permitted on the premises between 2100 and 0900 when they are being used primarily for the purposes of supply of alcohol except when attending a private function at the premises.
48 The premises licence holder and the DPS shall at all times comply with the Portman Group Code of Practice and with the requirements or recommendations of any Portman Group Retailer Alert Bulletin.
49 The maximum number of persons to be accommodated in the premises or in any particular part of the premises at any one time shall be 400.
