Annex 2 - Conditions consistent with the Operating Schedule
1 Non standard timings to apply to all licensed activities and the opening hours of the premises:
An additional hour to the terminal hour on Fridays and Saturdays of Pigeon Weekend and on the weekend of the Illuminations Switch On.
The terminal hour will be 04:00 on Sundays preceding a Bank Holiday Monday with the premises closing at 04.30.
An additional hour to the standard and non-standard terminal hour on the day when British Summertime commences.
New Year’s Eve - from the end of permitted hours on New Year’s Eve to the start of permitted hours on New Year’s Day.
2 CCTV must be installed internally and externally at the premises and must comply with the following:
i. Appropriate signage alerting customers to CCTV recording must be displayed in conspicuous positions on the premises.
ii. The CCTV system must be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises must be covered by the system. The system will incorporate a camera covering each of the main entrance doors and each camera must be capable of providing an image which is regarded as identification standard in all lighting conditions.
iii. The system must record all hours the premises are open to the public.
iv. Recordings must display the correct date and time.
v. Digital recordings must be held for a minimum period of 28 days. The system must, as a minimum, record images of the head and shoulders of all persons entering the premises.
vi. CCTV must be available to be viewed on request from the Police, responsible authorities or an authorised person and footage provided in a viewable format within 48 hours of request, with minimum delay, in line with Data Protection Legislation.
vii. The licence holder must notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the conditions of this licence.
3 When the premises are open for licensable activities on Friday, Saturday, Sundays preceding Bank Holiday Mondays, Boxing Day and New Year’s Eve, there will be two SIA-registered door supervisors on duty from 10pm. On all other opening times an adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment.
4 All door staff on duty shall sign a register when performing duties at the premises. This register is to contain the full names, SIA badge numbers and contact details of that person. Those records are to be made available on request to any relevant authority for the purposes of investigating or preventing crime or apprehending or prosecuting an offender.
5 A zero tolerance drugs policy will be adopted at the premises. The premises shall maintain a written drugs policy, which shall be made available to the Police or an authorised officer of the Council upon request.
6 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
7 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
8 Clearly visible notices shall be displayed advising those attending that:
a) It is a condition of entry that customers agree to be searched and
b) Police will be informed if anyone is found in possession of controlled substances or weapons.
9 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
10 Confiscated and found drugs shall be transferred to the police in accordance with procedures agreed with Lancashire Constabulary.
11 When the premises are open for sale of alcohol after 3am there shall be no new admittance of customers after 3am. For the avoidance of doubt, this condition will not apply to those customers who were on the premises prior to 3am, and who have temporarily exited the premises, e.g. to smoke.
12 An incident book (which may be electronic) will be maintained in which will be recorded:
All incidents of crime and disorder.
Refused sales to suspected underage and drunken persons.
A record of any person asked to leave the premises or that are removed from the premises.
Details of occasions on which the police are called to the premises.
A record of persons searched on suspicion that drugs are being carried and their reason for such suspicion.
The book will be available for inspection by a police officer.
13 The premises shall maintain a written dispersal policy, which shall be made available to the Police or an authorised officer of the Council upon request.
14 At least one personal licence holder will be on the premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
15 Another member of staff shall be nominated to act for the DPS in their absence whose identity is known by all staff when such absence occurs.
16 Only toughened or similar drinking vessels (excluding bottles) shall be used on the premises with the exception of where they are not produced / available for purchase by the operator. This does not include wine or champagne glasses or other such glassware as agreed in writing with the Police Licensing officer.
17 With the exception of bottled beers, bottled champagne, wine and sparkling wine or jam jars / specific cocktail glassware, all alcoholic drinks will be served in polycarbonate or other appropriate non-glass vessels after 1am on Fridays, Saturdays and Sundays preceding Bank Holiday Mondays, Christmas Eve and New Year’s Eve (save for bona fide pre-booked private functions). In relation to bona fide pre-booked private functions taking place at the premises, the use of polycarbonate or other appropriate non-glass drinking vessels will be subject to a risk assessment by the current DPS and made available to the Police or authorised officers of the Council upon request.
18 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery or following entry/ re-entry from any external area of the premises.
19 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises, save for customers taking drinks to and from any external area designated for the purpose of consumption.
20 Frequent collection of drinking vessels will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises
21 The licence holder / DPS shall arrange adequate supervision of any queue which may form to gain entry to the premises.
22 The licence holder shall erect and maintain suitable and sufficient conspicuous signage on the exterior of their premises advising patrons that causing any disturbance or disorder in a queue will result in admission being refused.
23 All internal lobbied doors to any entrance/exit point, fire exit doors and external windows shall be closed after 23:00 hours when any regulated entertainment in the form of live or DJ led recorded music takes place except in the event of an emergency and save for the purposes of access and egress.
24 Noise generated from any regulated entertainment in the form of live or DJ led recorded music, mechanical ventilation and refrigeration plant shall not be audible at premises within close proximity so as to cause a public nuisance.
25 A sound limiter / cut-out device is in place at the premises.
26 Notices will be displayed at the entrance and exits advising customers to leave quietly.
27 The departure of customers from the premises shall be effectively managed by staff who will request patrons to leave quietly and to avoid causing noise, nuisance or disturbance in the area.
28 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
29 There will be no persons under the age of eighteen permitted on the premises after 22.00 hours unless they are attending a pre-arranged private function. All persons under eighteen must be accompanied by an adult at all times.
30 A Challenge 25 proof of age policy shall be implemented and adhered to. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
A recognised proof of age scheme accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
Photo driving licence.
Passport.
Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
If no suitable identification is provided the sale of alcohol to them will be refused.
Suitable signage will be displayed to specify the Challenge 25 policy is in place.
31 All bar staff to receive appropriate training in relation to alcohol sales prior to commencing their duties. This will include the premise licence conditions, underage sales policy and other relevant licensing matters including with regard to serving drunks. All staff receive regular refresher training at regular intervals of at least 6 months. Training documents (which may be in an electronic format) shall be made available to an authorised police officer and licensing authority officer upon request.
