Annex 2 - Conditions consistent with the Operating Schedule
1 Performances where content of an adult nature is being performed will be strictly over 18s only. These may include adult comedians (where language may be used), and revue shows (where partial nudity may be displayed).
2 An additional hour to licensable activities and the opening hours of the premises shall be permitted on the day that British Summertime commences.
3 An additional hour is permitted for the supply of alcohol and the opening hours of the premises on the Friday to Monday of Bank Holiday weekends, the Friday to Sunday of Illuminations Switch On weekend, and on Christmas Eve, Christmas Day, Boxing Day, New Year's Eve and New Year's Day.
4 Prior to commencing their employment duties, members of staff will be trained in relation to the Licensing Objectives so as to prevent crime and disorder, prevent public nuisance, promote public safety and promote the protection of children from harm. Said training will be documented and produced to an authorised officer upon request.
5 In the absence of the Designated Premises Supervisor, another personal licence holder (whose identity should be known to other members of staff) should be nominated to deputise for him or her.
6 An incident book shall be maintained at the premises and will record details of:
i. All incidents of crime and disorder
ii. Refused sales to drunken persons;
iii. A record of any person refused admission or asked to leave the premises;
iv. Details of occasions upon which the Police have been called to the premises;
v. The use of or discovery of drugs.
Said book must be made available for inspection by an authorised officer upon request.
7 There will be a "Challenge 25" scheme in operation at the premises, requiring any individual who appears to be under the age of 25 to provide identification to prove that they are over the age of eighteen. In the event that the individual is unable to provide said identification, then the sale of alcohol will be refused. The only forms of identification which will be accepted as proof of age are:
- a valid UK Passport;
- a valid UK photocard driving licence;
- A PASS card; and / or,
- any other form of identification previously agreed with representatives from the Blackpool Police Licensing Unit.
8 All staff who are involved with the sale of alcohol will receive training in relation to the "Challenge 25" scheme prior to commencing their employment duties and on at least one occasion every three months thereafter. Said training will be documented and produced to an authorised officer upon request.
9 CCTV will be installed internally and externally at the premises and will comply with the following:
• The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system, with the exception of the toilets. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
• The system will display on any recording the correct time and date of the recording.
• The system will make recordings during all hours the premises are open to the public.
• Recording shall be held for a minimum of 28 days after the recording is made and will be made available to an authorised officer upon request.
• The system will record images of the head and shoulders of all persons entering the premises.
10 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested by an authorised officer.
11 The Licence Holder shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
12 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
13 Bi-Annual documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Licence Holder to ensure that the system is in good working order and fit for purpose.
14 The premises will be operated in conjunction with the local Pubwatch Scheme (where such a scheme is in operation).
15 Notices shall be displayed in a prominent position at the entrance to the premises advising patrons that it is a condition of entry that they agree to be searched and that any individual found to be in possession of a weapon or controlled substances shall be detained and reported to the Police.
16 The premises licence holder will risk assess the requirement for door supervisors at the premises and shall employ door supervisors in such numbers and at such times as is deemed necessary by the risk assessment. The requirement to provide door supervisors as determined by risk assessment will equally apply in respect of private functions and ticketed events where admission is only permitted by ticket purchases in advance.
17 A record must be kept on the premises of every person employed at the premises as a door supervisor. The record must contain the following information:
i. Name and address;
ii. Date of birth;
iii. SIA licence number;
iv. Time duty commenced and time duty terminated.
Said record must be made available for inspection upon demand by an authorised officer.
18 The management will ensure that patrons do not leave the premises with any open vessels containing alcohol.
19 Only vessels made of toughened glass or any equivalent material previously agreed in writing with representatives of Blackpool Police Licensing Unit will be utilised at the premises.
20 Whenever any form of regulated entertainment is taking place, regular assessments will be made of noise coming from the premises and steps taken to reduce the level of noise where it is likely to cause a disturbance to any local residents.
21 There shall be adequate supervision and control over any external areas of the premises to prevent any disturbance to any residents in the vicinity of the premises.
22 Bottles and glasses will not be disposed of outdoors between the hours of 22:00 and 08:00.
23 Notices will be displayed at public exits, in a clear and prominent position, requesting that patrons respect the needs of any local residents and leave the premises and the area quietly.
24 Signs will be displayed in prominent positions around the premises encouraging smoking customers to utilise the smoking area situated on the ground floor.
25 Children shall be excluded from the premises on occasions which are deemed appropriate by the management.
26 Persons under the age of fourteen will not be permitted on the premises unless accompanied by a responsible adult.
27 On the occasions when the premises will be utilised for family orientated entertainment the following will apply:
a. No children will be admitted unless accompanied by an adult
b. External signage will make it clear that the premises are being used for family entertainment and entry will be conditional upon appropriate behaviour
c. Family sessions will conclude at the time advertised at the entrance (after which time the premises will be cleared and prepared for the evening session)
d. Any member of the entertainment team of floor staff in potential contact with children will have a requirement to be CRB checked (enhanced) before commencing employment.
28 Seating inside the premises will be provided as determined by a risk assessment.
29 Whenever licensable activities are available at the premises a waiter/waitress service shall be available.
30 Any outside areas are to be monitored and supervised by management and staff, when occupied, during the hours the premises are open to the public.
31 There is to be no change in the venue concept without prior discussion with the police and responsible authorities and an appropriate application being lodged for a variation of this concept condition.
32 The licence holder will adhere to their outside management, smoking and dispersal policies.
Conditions specific to the Viva Arena, Round Room & Festival Suite:
33 The maximum occupancy of the premises will be 1250
34 Admission will only be permitted to:
a. Customers who have purchased a ticket for a show/event at the premises
b. Members of the venue membership scheme
c. Customers whose names appear on a guest list, with any such customers having booked in advance.
d. Attendees of a pre-booked function.
