• Annex 1 - Mandatory conditions

   

  1              Alcohol may be sold or supplied:

   

  a)  Monday to Sunday, 11.00 a.m. to 01.00 a.m.

   

  On New Year’s Eve, from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  The above restrictions do not prohibit:

   

  a)              During the first twenty minutes after the above hours the consumption of the alcohol on the premises;

  b)              During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;

  c)              Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

   

  2              The premises shall be used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.

   

  3              Intoxicating liquor shall not be sold or supplied on the premises otherwise than to persons taking table meals there and for consumption by such a person as ancillary to his meal.

   

  4              Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.

   

  5              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  6              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              Noise from any Regulated Entertainment or Mechanical Ventilation shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.

   

  2              The volume of amplified sound used in connection with any Regulated Entertainment shall, at all times, be under the control of the Licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.  (This can replace the condition relating to the production of music and sound levels found within the current Public Entertainments Licence).

   

  3              Vibration produced as a result of any Regulated Entertainment shall not be perceptible in any ajoining or nearby sensitive properties.

   

  4              All internal lobbied doors to any entrance/exit point, fire exit doors and external windows should be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purposes of access and egress.  (This will ensure that noise cannot emanate directly out of the property from both sets of doors being left open).

   

  5              The applicant shall have regard to the Duty of Care on Waste and for that purpose shall provide suitable receptacles for the storage of waste and ensure that these receptacles are constructed in such a way that they prevent the breaking open of the same and removal of the waste by vandals, thieves, animals, accident or weather.

   

  6              The Licensee shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.

   

  7              The License Holder will continue to comply with existing capacity limits.

   

  8              Persons under 18 years of age will only be allowed on the premises when accompanied by a person over 18 and taking a table meal.
