Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              Alcohol shall not be sold or supplied except during permitted hours.  Permitted hours means:

   

  a)              Monday to Sunday 1000 - midnight

  b)              On Christmas Day, Boxing Day and the Friday to Monday of Easter, May, Spring and August Bank Holiday weekends permitted hours for the sale of alcohol, provision of regulated entertainment and late night refreshment shall be extended by one hour.

  c)              On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December)

   

  The above restrictions do not prohibit:

   

  a)              During the first thirty minutes after the above hours the consumption of the alcohol on the premises;

  b)              During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;

  c)              During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;

  d)              Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

  e)              The ordering of alcohol to be consumed off the premises, or the dispatch by the vendor of the alcohol so ordered;

  f)              The sale of alcohol to a trader or club for the purposes of the trade or club;

  g)              The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  h)              The taking of alcohol from the premises by a person residing there; or

  i)              The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or

  j)              The supply of alcohol for consumption on the premises to person employed there for the purposes of business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

   

  2              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence, or his personal licence is suspended.

   

   

  3              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  4              Exhibition of films

   

                Where the film classification body is specified in the licence, unless the following applies, admission of children must be restricted in accordance with any recommendations made by that body

   

                Where  -

   

  a)              The film classification body is not specified in the licence,

   

  or

   

  b)              The relevant licensing authority has notified the holder of the licence that this condition is applied to the film in question,

   

                Admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

   

  5              Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  A noise limiter is to be installed and calibrated in agreement with the Local Authority.

   

  The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

   

  Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly.

   

  The placing of refuse such as bottles into receptacles outside the premises shall take place only between the hours of 0800 and 2230 so as to prevent disturbance to nearby premises.

   

  The premises shall be operated in participation with the ‘Pubwatch’ scheme (radio link if applicable).

   

  All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.

   

  The company will monitor the need for door supervisors and in doing so will take into account any advice given by the Police.

   

  Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.

   

  Only toughened glass vessels are used to dispense beverages to customers.

   

  At least one personal licence holder will be contactable while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.

   

  The DPS will abide by the company's drug policy.

   

  Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.

   

  Text and / or radio pagers, where already used, will be used for the additional hours granted.

   

  The existing CCTV system will continue to operate during the additional hours granted.

   

  There will be no promotions that encourage illegal, irresponsible or immoderate consumption.

   

  Managers are required to liaise with local neighbours as part of their duties and resolve any reasonable concerns.

   

  No adult entertainment (paid for by the company of a nude physical nature) is permitted at the premises. Any children under 16 remain the responsibilty of the accompanying adult when using the premises (and / or exterior area). Staff are not allowed to be in sole supervision of children which remains the responsibility of the accompanying adult at all times.
