Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              Intoxicating liquor shall be sold/supplied only to:

   

  a)              Residents in the hotel and their bona fide guests

  b)              Persons having a bona fide meal at a cost not less than the usual tariff rate for lunch and dinner and only during such meals

  c)              Persons attending organised functions

   

                Intoxicants to be served only in the dining room, sun lounge, bar and functions room as shown on the deposited plan.

   

                There is to be no display of intoxicants or display of intoxicants outside the premises.

   

                A notice to the above effect to be placed in each public room.

   

  2              There are no off sales.

   

  3              Alcohol shall not be sold or supplied except during permitted hours.  Permitted hours means:

   

  a)              Monday to Sunday 1100 to 0200

  b)              On the Friday to Monday of Easter, May, Spring and August Bank Holiday weekends, and Christmas Eve and Christmas Day, permitted hours for alcohol and late night refreshment may be extended until 0300

   

  On New Year’s Eve, from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  The above restrictions do not prohibit:

   

  a)              During the first twenty minutes after the above hours the consumption of the alcohol on the premises;

  b)              During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;

  c)              During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;

  d)              Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

  e)              The ordering of alcohol to be consumed off the premises, or the dispatch by the vendor of the alcohol so ordered;

  f)              The sale of alcohol to a trader or club for the purposes of the trade or club;

  g)              The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  h)              The taking of alcohol from the premises by a person residing there; or

  i)              The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or

  j)              The supply of alcohol for consumption on the premises to person employed there for the purposes of business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  4              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  5              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              Regulated entertainment will be restricted to the basement functions room which has a maximum capacity of 120 persons.

   

  2              The provision of late night refreshment is restricted to the restaurant and functions room.

   

  3              No person under the age of 14 shall be in the bar of the licensed premises when the bar is open unless accompanied by a person over the age of 18.

   

  4              The licence holder and DPS shall ensure that the premises are equipped with a closed-circuit television system which is provided and maintained to the satisfaction of Lancashire Constabulary.

   

  5              The licence holder and DPS shall ensure that the premises are operated in accordance with the standards described in the 'Nightsafe' leaflet.

   

  6              Any risk assessment carried out by or on behalf of the licence holder which relates to a licensing objective will be available for inspection by an officer or a responsible authority.

   

  7              The licence holder shall erect and maintain in a prominent position at every exit a clear and conspicous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.

   

  8              The licence holder shall ensure that staff arriving before 0900 or departing late at night when the business has ceased trading conduct themselves in such a manner as to avoid disturbance to nearby residents.

   

  9              The licence holder shall ensure that noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be disturbed.

   

  10              The volume of amplified sound used in connection with entertainment shall, at all times, be under the control of the licence holder or the management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

   

  11              The licence holder shall ensure that free cold drinking water is available on request and shall have adequate supplies of chilled soft drinks and bottled water available for sale at the bar.

   

  12              Accompanied children will only be allowed to remain on the premises between the hours of 1100 and 2300.

   

  13              The licence holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.

   

  14              For the avoidance of doubt the time restrictions with regard to the sale of alcohol do not apply to residents in the hotel or their bona fide guests.

   

  15              On the Friday to Monday of Easter, May, Spring and August Bank Holiday weekends, plus Christmas Eve and Christmas Day, permitted hours for Live Music, Recorded Music and Provision of Facilities for Dancing may be extended until 0400.

   

  16              The means of escape should be safe, free from any obstruction and checked prior to the public being admitted on the premises. Checks shall be documented and records available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.

   

  17              A fire risk assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.

   

  18              Any staff or responsible persons using the property shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.

   

  19              A fire alarm system to be provided that conforms to the Regulatory Reform (Fire Safety) Order 2005. The fire alarm to be tested in accordance with BS 5839 part 1. Tests shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.

   

  20              Escape routes, where necessary, are to be indicated and illuminated by emergency escape lighting which is to be tested in accordance with BS 5266. Tests shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.

   

  21              The occupancy of the licensed area is limited to the number of adequate escape routes and the floor area and shall be calculated and part of the risk assessment.
