Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              Alcohol shall not be sold or supplied except during permitted hours.  Permitted hours means:

   

  a)              On Monday to Sunday 11.00 to 03.00 hours the following day

  b)              On the Friday to Monday of Easter, May, Spring and August Bank Holidays 11.00 to 04.00 hours the following day

  c)              On Christmas Day and Boxing Day 11.00 to 04.00 hours the following day

  d)              On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or if there are no permitted hours on the following day, midnight on 31st December)

   

  The above restrictions do not prohibit:

   

  a)              During the first sixty minutes after the above hours the consumption of the alcohol on the premises;

  b)              During the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;

  c)              During the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;

  d)              Consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;

  e)              The ordering of alcohol to be consumed off the premises, or the dispatch by the vendor of the alcohol so ordered;

  f)              The sale of alcohol to a trader or club for the purposes of the trade or club;

  g)              The sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

  h)              The taking of alcohol from the premises by a person residing there; or

  i)              The supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or

  j)              The supply of alcohol for consumption on the premises to person employed there for the purposes of business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  2              Replace the permitted hours condition for those days with the following

   

  3              Subject to the following paragraphs, the permitted hours on weekdays shall extend until two o’clock in the morning following except that -

   

  a)              The permitted hours shall end at midnight on any day on which music and dancing is not provided after midnight; and

  b)              On any day that music and dancing end between midnight and 3am, the permitted house shall end when the music and dancing end.

   

  4              In relation to the morning on which summer time begins, paragraph1 of this condition shall have effect -

   

  a)              With the substitution of references to four o’clock in the morning for references to three o’clock in the morning [ or one hour following the hour actually specified in the licence]

   

  5              Except on Sundays immediately before bank holidays, the permitted hours on Sundays shall extend until 3am in the morning following, except that -

   

  a)              The permitted hours shall end at midnight on any Sunday on which music and dancing is not provided after midnight;

  b)              Where music and dancing end between midnight on any Sunday and thirty minutes past midnight, the permitted hours on that Sunday shall end when the music and dancing end.

   

  6              On Sundays immediately before bank holidays, the permitted hours shall extend until 4am in the morning following, except that -

   

  a)              The permitted hours shall end at midnight on any Sunday on which music and dancing is not provided after midnight;

  b)              Where music and dancing end between midnight on any Sunday and 4am, the permitted hours on that Sunday shall end when the music and dancing end.

   

  The sale of alcohol must be ancillary to the use of the premises for music and dancing.

   

  7              No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:

   

  a)              He is the child of the holder of the premises licence.

  b)              He resides in the premises, but is not employed there.

  c)              He is in the bar solely for the purpose of passing to or from some part of the premises that is not a bar and to or from some part of the premises where there is no other convenient means of access or egress.

  d)              The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which holding of the licence is ancillary.

   

  In this condition “bar” includes any place exclusively or mainly used for the consumption of intoxicating liquor.  However, an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

   

  8              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence, or his personal licence is suspended.

   

  9              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  10              Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  11              The terms, conditions and restrictions detailed in the Blackpool Borough Council Entertainments Licences (Standard Conditions) Regulations 1985 must be adhered to at all times.

   

  12              The premises shall not be used for public entertainment on Sunday except between the hours defined by the schedule and then only for (a) musical entertainment as defined by the Sunday Entertainments Act 1932, and (b) dancing in respect of which an admission charge is not made.

   

  13              The maximum number of persons to be accommodated in the premises or in any particular part of the premises at any one time shall be as follows:-

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              The provision of Regulated Entertainment and Late Night Refreshment are permitted:

   

  a)              On the Friday to Monday of Easter, May, Spring and August Bank Holidays 11.00 to 04.00 hours the following day

  b)              On Christmas Day and Boxing Day 11.00 to 04.00 hours the following day

   

                On these occasions the premises is permitted to remain open for an additional hour.

   

  2              Any externally located Regulated Entertainment shall finish at 23.00 hours.

   

  3              The premises will follow and support the 'Nightsafe' initiative.

   

  4              The premises will follow the drinks promotion protocol.

   

  5              Use of toughened glassware throughout.

   

  6              Use of SIA registered door supervisors.

   

  7              Music levels under control of licence holder or duly appointed representative.

   

  8              Children allowed on the pier and in bar areas, but substantial fenced segregation barriers and signs in place in front on bars noting the areas for over 18's.

   

  9              The Licence holder is to support and rigorously enforce Challenger 21 proof of age policy.

   

  Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18.  The following are the only forms of identification acceptable: -

   

  i.              UK photo driving licence

  ii.              Passport

  iii.              Proof of Age Standards Scheme Card

   

  10              Staff training in place on their responsibilities with regards to children under the age  and this training to be recorded.

   

  11              The premises shall be operated in participation with the 'Pubwatch' and 'Radiolink' schemes.

   

  12              The premises shall be operated in compliance with the recommendations contained in Safer Clubbing.

   

  13              An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.

   

  14              Appropriate measures will betaken to ensure staff prevent the removal of bottles or glasses from the cartilage and grounds of the licensed premises.

   

  15              All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / tabard of a design approved by the Lancashire Constabulary.

   

  16              The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.

   

  17              The Local Authority CCTV control room will be notified:

   

                a) On any occasion when the premises CCTV or radio system is inoperative.

                b) When the CCTV or radio system has been brought back into use.

   

  18              The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.

   

  19              The Radiolink equipment will be 'live' and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.

   

  20              At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (who's identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.

   

  21              Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.

   

  22              Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.

   

  23              Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.

   

  24              Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.

   

  25              Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.

   

  26              Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.

   

  27              Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.

   

  28              Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.

   

  29              A drugs prevention strategy for the venue shall be developed and applied.  The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.

   

  30              During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.

   

  31              Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.

   

  32              A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.

   

  33              Noise from any Regulated Entertainment will be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to neighbouring residents or their guests.

   

  34              The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

   

  35              All internal lobbied doors to any entrance / exit point, fire exit doors and external windows should be closed during hours of any Regulated Entertainment except in the event of an emergency, sace for the purposes of access and egress.

   

  36              The licensee shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistant smells generated at the premises do not cause nuisance to properties within close proximity.
