Annex 2 - Conditions consistent with the Operating Schedule
1 The capacity of the premises is as follows:
- 150 persons on the First Floor
- 60 persons on the Second Floor
2 Children are only allowed to attend the premises for private functions if accompanied by an adult up to 20.00 hours. Children will not be permitted in the bar area whilst the premises are open.
3 A Challenge 21 policy is in place at the premises:
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
4 All staff to have received suitable training in relation to the Challenge 21 proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
5 All customers will be asked to leave quietly at the end of permitted licensed hours. Signs are placed at the exit to remind customers.
6 Noise from any regulated entertainment or mechanical ventilation shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
7 The volume of amplified sound used in connection with any regulated entertainment shall, at all times, be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
8 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
9 All internal lobbied doors to any entrance / exit point, fire exit doors and external windows should be closed during hours of any regulated entertainment except in the case of an emergency, save for the purposes of access and egress.
10 CCTV will monitor the premises 24 hours a day.
11 CCTV will be installed internally and externally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
b) The system will display on any recording the correct time and date of the recording.
c) The system will make recordings during all hours the premises are open to the public.
d) VCR tapes or digital recording shall be held for a minimum of 31 days and 28 days respectively, after the recording is made and ill be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
e) The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
12 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises is open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
13 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
14 Bi-annual documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
15 The local authority CCTV control room will be notified:
a. On any occasion when the premises CCTV or radio system is inoperative, and
b. When the CCTV or radio system has been brought back into use
16 The Police licensing unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
17 A drugs prevention strategy for the venue shall be developed and applied. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
18 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
19 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
20 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
21 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
22 There shall be no drinks promotions which would contravene the British Beer and Pub Association Standards for the Management of Responsible Drinks Promotions, including Happy Hours, or the Social Responsibility for the Production and Sale of Alcoholic Drinks in the UK.
23 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
24 The Licence holder and DPS shall erect and maintain signage (in a form approved by the licensing authority) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of doorstaff to enforce a 'no exit with a bottle' policy. No glasses are permitted to be taken outside.
25 Exhibition of films will take place on the First Floor only.
26 Staff are to be trained to deal with security matters and crowd control.
27 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
28 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
29 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
30 Functions which specifically target young people aged 17-18 years (for example birthday parties) will not be allowed to take place on the premises.
31 An incident book will be maintained, in which shall be recorded:
(a) All incidents of crime and disorder
(b) Refused sales to suspected under age / drunken persons
(c) A record of any person refused admission or asked to leave the premises
(d) Details of occasions upon which the Police are called to the premises
(e) The use or discovery of drugs
That book shall be available for inspection by a Police Officer or authorised person.
32 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment, however on the following occasions at least one SIA registered member of door staff will be on duty from 22:00hrs until close:
· Friday, Saturday and Sunday of every bank holiday weekend
· Christmas Eve and New Year's Eve
· When a private function takes place on the premises.
33 No entertainment of an adult or sexual nature, no nudity or semi-nudity will be permitted in the premises
