Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 The hours for all licensable activities and the opening hours of the premises shall be extended from the end of permitted hours on New Year's Eve to the beginning of permitted hours on New Year's Day.
3 On the Sundays of Bank Holiday weekends permitted hours for all licensable activities shall be extended to 0200 with the premises closing at 0230.
4 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request of Lancashire Police or any authorised officer.
5 The management will use their best endeavours to ensure that bottles and glasses are not removed from the grounds of the premises.
6 The licence holder and DPS shall erect and maintain signage (in a form approved by the licensing authority) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of doorstaff to enforce a 'no exit with a bottle' policy.
7 The Premises Licence Holder, the Designated Premises Supervisor or a nominated representative will be a member of the local Pubwatch scheme and will regularly attend the meetings.
8 At least one Personal Licence holder will be available on the premises where the sale of alcohol is taking place, except in an emergency. Their identity will be known to all of the staff engaged in the supply or sale of alcohol.
9 In the absence of the Designated Premises Supervisor, another member of staff should be nominated to act for them and their identity should be known to all of the staff.
10 The premises will comply with the Nightsafe guidance.
11 CCTV will be installed internally and externally at the premises. Said CCTV system shall comply with the following criteria:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, shall be covered by the system.
The system shall display on any recording the correct time and date of the recording
The system shall be recording during all hours the premises is open to the public.
VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the Police for inspection upon request.
The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises
12 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises are open to the public. This staff member will be able to show Police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
13 The Police Licensing unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
14 The Licence Holder and the DPS shall develop and apply a Drugs Prevention Strategy for the venue, including:
The display of information provided by the relevant agencies
The exclusion of customers known to have been convicted of offences relating to drugs
The searching of outer clothing, pockets and bags by trained staff of the same sex as the person being searched, where there is a reasonable suspicion that an individual is in possession of controlled substances or weapons
Arrangements to discourage the sale or use of drugs and regular inspection of toilet areas
Arrangements for the storage, transfer and disposal of confiscated or found drugs
15 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that:
1. It is a condition of entry that customers agree to be searched, and
2. Police will be informed if anyone is found in possession of controlled substances or weapons
16 An incident book will be maintained, in which shall be recorded:
All incidents of crime and disorder
Refused sales to suspected under age / drunken persons
A record of any person refused admission or asked to leave the premises
Details of occasions upon which the Police are called to the premises
The use or discovery of drugs
That book shall be available for inspection by a Police Officer or authorised person.
17 Whenever the premises is to open to the public for the purpose of carrying on licensable activities, a risk assessment will be carried out and door supervisors shall be used whenever appropriate in accordance with the risk assessment. Said risk assessment will be documented and will be made available to an authorised officer upon request.
18 A record shall be kept on the premises of every person employed at the premises as a door supervisor. The record shall contain the following details:
Name and address
Date of Birth
SIA licence number
Time duty commenced and time duty terminated
Said records shall be made available for inspection upon demand by the Police.
19 When live entertainment is taking place there will be an SIA registered door supervisor inside the premises.
20 All door supervisors positioned outside the premises will wear high visibility clothing at all times - jackets in the winter and vests / waistcoats in the summer.
21 There will be a 30 minute 'wind down period' where the tempo and volume of music will notably lower to allow a staggered departure of patrons from the premises.
22 Only toughened or polycarbonate glasses, or any other form of drinks vessel agreed with Lancashire Constabulary, will be used at the premises.
23 There will be a maximum capacity of 150 per floor.
24 When live entertainment is taking place, 25% seating will be provided, and at all other times, 50% seating will be provided.
25 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every public exit.
26 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises which is inaccessible to the public.
27 Regular assessments of the noise coming from the premises during the provision of regulated entertainment shall be made, the noise level shall be adjusted accordingly and a log detailing such checks and adjustments shall be maintained.
28 There will be a 'Challenge 25' policy in operation at the premises, requiring any individual who looks to be under the age of 25 years to provide identification to prove that they are over the age of 18 years. The only forms of identification to be accepted will be a photo card driving licence, a valid passport, a PASS accredited proof of age card, or any other form of identification agreed with Lancashire Constabulary.
29 There will be no children under the age of 18 years allowed on the premises at any time unless in attendance at a pre-arranged private function of which Lancashire Constabulary has been notified at least seven days in advance.
30 The premises will not host any events which are targeted specifically at those who are aged eighteen years or under.
31 All staff will receive suitable training upon commencement of their employment and suitable refresher training in relation to the proof of age scheme adopted by the premises. Training records in relation to the proof of age scheme will be made available to an authorised officer upon request.
32 A Fire Risk Assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
