Annex 2 - Conditions consistent with the Operating Schedule
1 The premises are operated in accordance with the principles outlined by the 'Nightsafe' Scheme, as are relevant to those premises.
2 The premises shall be operated in participation with the 'Pubwatch' and 'Radiolink' schemes.
3 The premises shall be operated in compliance with the recommendations contained in 'Safer Clubbing'.
4 All staff to have received suitable training in relation to the proof of age 'Challenge 21' scheme to be rigorously enforced at the premises. Records to evidence this will be made available to an authorised officer upon request.
5 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' scheme.
6 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
7 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / tabard of a design approved by the Lancashire Constabulary.
8 The premises are to be equipped with a closed circuit television system which meets the criteria detailed in Lancashire Constabulary's guidance document CCTV/AW1*, and which is well maintained and fully functional during the hours the premises are open to members of the public. (*Guidance document CCTV/AW1 available from Blackpool Council Licensing Service).
9 The Local Authority CCTV control room will be notified:
a) On any occasion when the premises' CCTV or radio system is inoperative;
b) When the CCTV or radio system has been brought back into use.
10 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
11 The Radiolink equipment will be 'live' and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
12 Only toughened glass, polycarbonate or other suitable non-glass vessels are used to dispense beverages to customers.
13 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
14 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
15 Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
16 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
17 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
18 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that:
1. It is a condition of entry that customers agree to be searched, and
2. Police will be informed if anyone is found in possession of controlled substances or weapons.
19 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
20 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
21 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
22 A drugs prevention strategy for the venue shall be developed and applied, to include the requirements prescribed by the Lancashire Constabulary.
23 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents.
24 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
25 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
26 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
27 Door staff will monitor and adequately manage any queue that forms to gain entry to the premises.
28 Before any regulated entertainment may take place the premises licence holder shall provide a sound limiter / cut out device, installed at the premises by a reputable sound engineer and the maximum sound level should be agreed and approved by the Head of Environmental Services.
29 Noise from any regulated entertainment, mechanical ventilation or refrigeration plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
30 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
31 All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during hours of any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
32 The collection and disposal of bottles and refuse should not take place externally between the hours of 2200 - 0800 so as to minimise disturbance to nearby residents.
33 The licence holder shall provide adequate ventilation at the premises, so as to ensure that any cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
34 The licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
35 Any artificial light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
36 The consumption of alcohol in any external smoking areas associated with the premises shall be prohibited between the hours of 2200 and 1100, so as to minimise any nuisance or disturbance to properties within close proximity.
37 The means of escape should be safe, free from any obstruction and checked prior to the public being admitted on the premises. Checks shall be documented and records available for inspection by a Fire Officer, Police Officer or authorised officer of the Council.
38 A Fire Risk assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
39 Any staff or responsible persons using the property shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
40 An electrical fire alarm system to be provided incorporating sounders and manually operated call points, with automatic fire detection included in unoccupied areas, storerooms or common corridors in which a fire could develop to the extent that escape routes could be affected before the fire is discovered. The fire alarm to be tested in accordance with BS 5839 part 1, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
41 Escape routes are to be indicated and illuminated by emergency escape lighting which is to be tested in accordance with BS 5266, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
42 The premises will be operated strictly as a private member's club. Photographic identification membership cards will be issued to all approved members. The membership screening process will require the applicant to prove their age and identity by means of authorised photographic documentation, namely passport, driving licence, Portman Group pass, PASS card or any other documentation approved by Blackpool Council and Lancashire Constabulary. Any customer appearing to be under 21 will be refused entry and membership until they are able to produce authorised photographic identification.
43 Membership will be reviewed and possibly terminated if a member becomes persistently disruptive.
44 The maximum capacity of the venue as set by Blackpool Council's Building Control is 300 persons.
45 Door supervisors will operate a clicking in and out system to accurately monitor movement of numbers and will record their findings in a log kept on the door.
46 No person under the age of 18 will be allowed into any part of the venue at any time.
47 The licence holder will observe the criteria relating to the provision of adult entertainment set out in the guidance provided by Blackpool Council.
