• Annex 1 - Mandatory conditions

   

  1              The non-standard timings for alcohol are as follows:

   

  a)              On Christmas Eve until 02.30 hours the following day

  b)              On New Years Eve until 03.00 hours the following day

  c)              Valentines Day, on a Sunday, until 00.00 hours

   

  2              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence, or his personal licence is suspended.

   

  3              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  4              Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

  5              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  An irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -

   

  a.              Games or other activities which require or encourage, or are designed to require or encourage individuals to -

  i.              Drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  ii.              Drink as much alcohol as possible (whether within a time limit or otherwise);

  b.              Provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined by section 159 of the Act);

  c.              Provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  d.              Provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependant on -

  i.              The outcome of a race, competition or other event or process, or

  ii.              The likelihood of anything occurring or not occurring;

   

  6              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  7              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

  8              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. The policy must require individuals who appear to the responsible person to be under 18 year of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  9              The responsible person shall ensure that -

  a.              Where any of the following alcoholic drink is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  i.              Beer or cider: ½ pint;

  ii.              Gin, rum, vodka or whisky: 25ml or 35ml; and

  iii. Still wine in a glass: 125ml; and

  b.              Customers are made aware of the availability of these measures.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              The non-standard timings for the Provision of Late Night Refreshment are as follows:

   

  a)              On Christmas Eve until 02.30 hours the following day

  b)              On New Years Eve until 03.00 hours the following day

   

                The premises are permitted to open for the same hours, but also until 00.00 hours on Valentines Day when it falls on a Sunday.

   

  2              All staff to be trained with regard to licensing objectives, complying with local authority requirements.

   

  3              No sale of alcohol to persons under 18 years of age.

   

  4              Persons of 17 years of age may have alcohol with a meal when accompanied by an adult.

   

  5              The establishment supports the efforts of the responsible authorities in relation to crime prevention and alcohol awareness, supporting Portman Group campaigns.

   

  6              Patrons asked to leave in an orderly manner.

   

  7              Taxi's ordered from inside the restaurant.

   

  8              Customers made aware of taxi rank directly opposite the premises.

   

  9              Children only admitted with adults.

   

  10              All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.

   

  11              Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.

   

  12              At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.

   

  13              Noise from any Regulated Entertainment, Mechanical Ventilation or Refrigeration Plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.

   

  14              The volume of amplified sound used in connection with any Regulated Entertainment shall, at all times, be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

   

  15              All external doors to any entrance / exit point, fire doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purpose of access and egress.

   

  16              Vibration produced as a result of any Regulated Entertainment shall not be perceptible in any adjoining or nearby sensitive properties.

   

  17              There shall be placed ay all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.

   

  18              The collection and disposal of bottles and refuse should not take place externally between the hours of 22.00 and 08.00 hours.

   

  19              The Premises Licence holder shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.

   

  20              The Premises Licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.

   

  21              Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.

   

  22              The supply and consumption of alcohol is permitted in the outside area from 11.00 - 22.00 Monday to Saturday and 12.00 - 22.00 on Sundays (opening hours of the outside area are 10.00 - 22.00 Monday to Sunday.)

   

  23              The supply of intoxicating liquor will be by waiter/waitress service only and only to persons seated at tables. 

   

  24              The outside seating area is to be clearly defined, with a removable barrier enclosing the tables and chairs. 

   

  25              All furniture in the outside area is to be either fixed or, if not fixed, to be removed from the outside after the premises have closed for trading.

   

  26              Drinking in the outside area will be from polycarbonate vessels only. 

   

  27              The outside area of the venue will be checked by a competent person at intervals of a minimum of 30 minutes.
