Annex 2 - Conditions consistent with the Operating Schedule
1 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Initiative, as are relevant to those premises, and indicated in the associated leaflet.
2 The premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes.
3 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
4 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ scheme.
5 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
6 All door staff employed at the entrance / exit of the licensed premises will wear a reflective armband of a design approved by the Lancashire Constabulary.
7 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
8 The Local Authority CCTV control room will be notified:
a) On any occasion when the premises CCTV or radio system is operative,
b) When the CCTV or radio system has been brought back into use.
9 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
10 The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
11 Only toughened glass vessels are used to dispense beverages to customers.
12 The Licence Holder will endeavour to have at least one personal licence holder to be available on the licensed premises while the supply or sale of alcohol is being undertaken (who’s identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
13 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
14 Adequate first aid provision is available at all times to include having at least one trained first-aider on the premises at all times the premises are being operated.
15 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
16 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
17 A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
18 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
19 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
20 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
21 Noise from any regulated entertainment will be inaudible at the nearest sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance.
22 All reasonable measures shall be taken to ensure that noise from regulated entertainment shall be contained within the premises, and any noise break out shall not dominate the background noise environment in the street or other public places.
23 Regular assessments of the noise coming from the premises during regulated entertainment shall be made and the nosie level adjusted accordingly.
24 Where considered necessary the management will implement a search policy to prevent drugs or offensive weapons being brought onto the premises.
25 Known drugs offenders / dealers will be barred and information shared with licensed premises in the area.
26 Any person found using drugs will be removed from the premises. Any person found to be dealing drugs will be detained and the Police informed immediately. Drugs seized will be handed over to the Police.
27 There will be regular inspection and maintenance of Fire Extinguishers.
28 All outdoor bottle banks will be kept secure.
29 Striptease entertainment shall only be given by the performers and no audience participation will be permitted.
30 Performances of lapdancing will take place only in designated areas approved by the Council and arrangements for private access to the dressing room shall be maintained at all times while striptease is taking place and immediately thereafter.
31 While striptease is taking place no person under the age of 18 will be on the licensed premises and a clear notice shall be displayed at the netrance to the premises in a prominent position so that it can be easily read by persons entering the premises on the following terms:
"No person under the age of 18 will be admitted."
32 There shall be no physical contact between the customer and performer before, during or after the performance. Notices outlining this shall be clearly displayed at tables and will also be on display at the entrance to the premises and at each bar.
33 Performers will be aged not less than 18 years.
34 There will be no displays of signage outside the premises or photographs or other images which indicate and suggest that striptease or similar dancing takes place in these premises.
35 There shall be at least 2 supervisors on the premises when dancing takes place and at any time when such dance or performers are taking place in the licensed area the number of covers made available to the public shall not exceed 100.
36 There will be a house monitor who will be positioned in the area of dancing at all times.
37 There will be an adequate number of prominently positioned and regularly emptied vermin proof litter bins with clear signage.
38 The area around the premises will be cleaned on a regular basis, and refuse will be removed regularly and in a manner sensitive to needs of local residents.
39 Air conditioning or ventilation machinery will not produce excessive noise, and noise will not escape through ventilation and extraction systems.
40 The emptying of bins into skips will be avoided late at night or early in the morning, particularly when containing glass. Late night and early morning refuse collections will be avoided.
41 No external speakers shall be operated on the premises.
42 No persons under 18 years of age are allowed in the premises at any time during which they are open for trade.
43 Prominent signage will be displayed regarding the laws relating to children and alcohol.
44 The Licence holder is to support and rigorously enforce Challenger 21 proof of age policy.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: -
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
