Annex 2 - Conditions consistent with the Operating Schedule
1 Staff and performers will undertake conflict management training.
2 Hand held metal detectors will be used at the premises.
3 The premises will operate a random search policy as a condition of entry and signage will be displayed to this effect.
4 The premises will be equipped with a fully serviced and maintained fire detection system with monthly operation testing.
5 The premises will be equipped with fully serviced and appropriate fire fighting equipment, and staff will be trained in fire awareness and equipment usage.
6 A tally counter system will control access and egress to / from the premises.
7 A Challenge 21 scheme will be in operation at the premises and staff will be trained in the scheme.
8 Noise from any regulated entertainment, mechanical ventilation or refrigeration plant will be inaudible at the nearest noise sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance.
9 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to customers. Music levels at the premises will be set by an acoustic engineer.
10 All external windows, fire doors and internal doors leading into the licensed area which by their opening would allow noise from regulated entertainment to escape externally and cause disturbance to the occupants of the nearest noise sensitive premises, should remain closed during the provision of the said regulated entertainment except when being used as an escape route in the event of an emergency.
11 The removal and movement of rubbish, bottles and beer barrels from the premises and subsequent storage externally to the building prior to collection shall be undertaken between 08.00 and 22.00 hours only to prevent disturbance to the occupants of the nearest noise sensitive premises from such activities.
12 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by customers, clear and legible notices requiring patrons to leave the premises and the area quietly so as to minimise disturbance.
13 The Premises Licence holder shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
14 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties. Suitable external receptacles shall be provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
15 The lease for the premises at 53 Albert Road will be transferred to the new premises licence holder within four months of the grant of the premises licence.
16 A current list of all persons authorised to sell alcohol shall be kept on the premises. All staff shall receive training as to their responsibilities under the Licensing Act and a record shall be kept for inspection.
17 When dancing takes place, there shall be a minimum of two SIA registered door supervisors on duty. Door supervisors monitoring the entrance to the premises shall wear a high visibility jacket or tabard. A door register and incident book shall be kept on the premises which shall contain full personal details of all supervisors on duty including the time of commencement and termination of duty. An incident book will be maintained, in which shall be recorded:
i. All incidents of crime and disorder
ii. Refused sales to suspected under age / drunken persons
iii. A record of any person refused admission or asked to leave the premises
iv. Details of occasions upon which the Police are called to the premises
v. The use or discovery of drugs
These records will be available for inspection by a Police Officer or authorised person.
18 CCTV shall be installed which will cover internally and externally the entrance doors and public areas of the premises and it shall be operative at all times when the premises are open to the public. Images, which shall be of evidential quality, shall be retained for a minimum of 28 days. There shall be at least one member of staff on duty who will be conversant with the system and be capable of downloading images as and when necessary. Appropriate signage indicating the presence of CCTV shall be displayed.
19 Bi-annually documented maintenance checks of the CCTV system, including the recording system, will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
20 A drug strategy shall be in operation which shall include the displaying of relevant posters, the regular examination of toilet areas. Confiscated or found drugs shall be stored and disposed of in accordance with procedures agreed with Lancashire Constabulary.
21 Staff will be trained in drugs awareness.
22 Drug detection torches will be used.
23 The premises shall be a member of the local Pubwatch scheme where one is in operation.
24 Persons shall not be allowed to leave the premises in possession of glasses or bottles. Notices will be displayed informing customers accordingly. Signage will be displayed reminding patrons of the 'Designated Public Place Order' and the penalties on conviction.
25 No persons under the age of 18 shall be allowed on the premises when open for business.
26 A personal licence holder shall be available either in person or available by telephone when the premises are open to the public. In the absence of the Designated Premises Supervisor a staff member shall be nominated to act on his/her behalf.
27 Adequate first aid provision is available at all times to include having at least one trained in first-aid on the premises at all times the premises are being operated.
28 Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
29 All performers to produce photographic identification to the premises licence holder to prove that they are over the age of 18. The licence holder is to keep copies of such ID on the premises which should be produced upon request to a Police Officer or authorised officer. Valid forms of ID are a PASS card, Photographic Driving Licence or Passport.
30 All performers to sign a register which shall contain the full name of each performer on duty and include the time of commencement and termination of duty. These records will be available for inspection by a Police Officer or authorised person.
