Annex 2 - Conditions consistent with the Operating Schedule
1 The Designated Premises Supervisor (DPS) to ensure the premises are operated in accordance with the principles outlined by the 'Nightsafe' Scheme, as are relevant to those premises and indicated in the associated leaflet.
2 The DPS to ensure the premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes.
3 The DPS to ensure that an adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.
4 The DPS to ensure that appropriate measures will be taken to ensure that staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
5 The DPS to ensure that all door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
6 CCTV will be installed internally and externally at the premises and will comply with the following:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system.
The system will display on any recording the correct time and date of the recording.
The system will make recordings during all hours that the premises are open to the public.
The VCR tapes or digital recording will be held for a minimum of 31 days and 28 days respectively after the recording is made and will be made available to the police or any authorised persons acting for a responsible authority for inspection upon request.
The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay, when requested.
The Licence Holder or Designated Premises Supervisor will notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
Appropriate signage informing customers that CCTV is recording will be displayed in conspicuous positions on the premises.
Annual documented maintenance checks of the CCTV system, including the recording system, will be carried out by the Designated Premisies Supervisor to ensure that the system is in good working order and fit for purpose.
The Local Authority CCTV control room will be notified:
a) On any occasion when the premises CCTV or radio system is inoperative
a) When the CCTV or radio system has been brought back into use.
The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and a certificate from a competent person shall be provided stating the reason for the system being so inoperative and the measures which have been taken to satisfy the licence conditions.
7 The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
8 Only toughened glass vessels are used to dispense beverages to customers.
9 The DPS to ensure at least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
10 Adequate first aid provision is available at all times the premises are being operated.
11 Risk assessments carried out by or on behalf of the Designated Premises Supervisor which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
12 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
13 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that: 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
14 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
15 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
16 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
17 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
18 A drugs prevention strategy for the venue will be developed and applied. The strategy will include arrangements for the location of posters and the distribution of other information relating to drug risks, the dangers associated with drugs and the legal provisions relating to drug use.
19 During the final hour of daily trading the DPS will ensure appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
20 The volume of amplified sound used in connection with any regulated entertainment shall at all times be under the control of the DPS or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
21 The DPS will ensure frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
22 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
23 After 23.00 hours noise from any regulated entertainment or mechanical ventilation shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other prearranged limit which does not cause unreasonable disturbance to the residents of these properties or their guests.
24 All external doors to any entrance / exit point, fire exit doors and external windows should be closed during hours of any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
25 A queuing system will be implemented at the main point of entry to assist in the monitoring of customers.
26 No person in possession of an alcoholic drink in an unsealed container will be allowed to enter or leave the premises.
27 The rear fire exit to be alarmed.
28 The Licence holder is to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
All staff involved in the sale of alcohol shall receive suitable training in relation to the proof of age scheme to be applied upon the premises. All such staff to receive regular refresher training at intervals of at least 6 months. Records to evidence this will be made available to officers on request.
29 At least one member of door staff is on duty every Friday and Saturday night, on any Sunday night prior to a bank holiday and on Christmas Eve and New Year’s Eve from 21:00 hours until closing. Door staff to be responsible for the internal security of the premises (in addition to at least one door supervisor responsible for managing entry/exit to the premises).
30 Documentation to be available at the entrance to the premises detailing fire evacuation procedure including maximum capacity, fire assembly points and emergency call points.
31 Signing in sheet to be completed by all members of door staff on duty at the premises to include the times of their tour of duty, SIA badge number, full name printed, signature and date of birth of each individual door supervisor. A quantity of blank incident report forms to be kept with this file at all times and all records shall be produced for inspection on the request of a police officer or authorised person.
32 All members of staff engaged in the supply of alcohol shall attend and successfully achieve the BII level 1 in responsible retailing or similar recognised qualification. Records to evidence this shall be available for inspection to a police officer or authorised officer on request.
33 An incident book will be maintained in which there will be recorded:
All incidents of crime and disorder
Refused sales to suspected under-age and drunken persons.
A record of any person asked to leave the premises.
Details of occasions on which the police are called to the premises.
A record of persons searched on suspicion that drugs are being carried and the reason for such suspicion.
The book will be available for inspection by a police officer or authorised person on demand.
34 Any customer know to have been previously convicted of committing criminal offences relating to violence or drugs (wherein the DPS has been made aware of this by the Police) shall be removed and excluded from the premises.
35 Fixed seating to be provided for 10% of the total capacity for each of the floors of the premises in order to reduce the area in which customers can stand and consume alcohol.
36 The maximum number of persons to be accommodated in the premises at any one time shall be as follows:
Ground floor - 325
First floor - 125
37 The DPS and Licence holder will carry out regular risk assessments with regard to the use of polycarbonate glassware. Such assessments will be documented.
38 All members of staff shall receive suitable training with regard to serving drunks and are to receive regular refresher training at intervals of a maximum of 6 months. Records to evidence this will be made available to authorised officers upon request.
39 Licensable activities will be permitted for an extra hour on Bank Holidays, Christmas Eve, Boxing Day and New Year’s Eve. On these occasions a further 20 minutes will be permitted after the extra hour for consumption of alcohol on the premises.
40 Persons under the age of 18 years shall not be permitted to be on the premises after 22:00 hours.
41 Any person under the age of 16 years must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.
42 Whenever children are allowed on the premises, any entertainment offered within the premises shall be suitable for young persons.
43 When the premises is open to the public and conducting licensable activities until 4am there will be a last entry time of 03:30 hours.
