Annex 2 - Conditions consistent with the Operating Schedule
1 Noise from any regulated entertainment or mechanical ventilation will be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
2 The volume of amplified sound used in connection with any regulated entertainment shall, at all times, be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
3 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
4 All internal or lobbied doors to any entrance / exit point, fire exit doors and external windows should be closed during hours of any regulated entertainment.
5 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
6 Licensed door supervisors will be on duty whenever the premises are open for the purpose of a licensable activity or when patrons are upon the premises. The minimum number of door supervisors will be appropriate to risk assessment in accordance with the criteria as stipulated by the ‘Nightsafe’ initiative.
7 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
8 The premises shall fund the employment by the Local Authority of one member of the door supervisor team for a period of one hour after licensable activity has ceased upon the licensed premises.
9 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
10 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
11 The Local Authority CCTV control room will be notified on any occasion when the premises CCTV or radio system is operative, or when the CCTV or radio system has been brought back into use.
12 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
13 The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
14 Toughened glass vessels are used to dispense beverages to customers.
15 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
16 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme.
17 The premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes.
18 The premises shall be operated in compliance with the recommendations contained in Safer Clubbing.
19 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
20 Adequate first aid provision is available at all times to include having at least one trained first-aider on the premises at all times the premises are being operated.
21 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
22 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
23 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
24 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons
25 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
26 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
27 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
28 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
29 A drugs prevention strategy for the venue shall be developed and applied, to include the requirements prescribed by Lancashire Constabulary
30 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents.
31 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises
32 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
33 All staff are to receive adequate training in order that the Licensing Objectives are ahdered to.
34 The Licence holder is to support and rigorously enforce the Challenge 21 proof of age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The only forms of identification acceptable are a UK photo driving licence, Passport or Proof of Age Standards Scheme Card.
35 Staff are trained to refuse service of alcohol to any person who, in the Management's opinion, has already consumed enough alcohol.
36 Door staff are on duty to ensure patrons exit the club safely and that incidents of crime and disorder do not take place outside the club or in the surrounding area.
37 The maximum number of persons allowed upon the premises at any one one time is 220.
38 All escape routes and fire exits will be clearly lit and will remain unobstructed at all times in case of emergency. Adequate fire safety equipment is installed and such equipment is tested on a regular basis.
39 Door staff are trained to deal with emergencies and will assist the emergency services should they need to gain access to the premises.
40 No special effects such as strobe lighting, pyrotechnics or smoke machines are currently in use at the premises. If such equipment is to be used in the future patrons will be warned in advance that such equipment is in use.
41 Rubbish will be disposed of in accordance with any guidelines prescribed by the Council. Steps will be taken to ensure that any refuse disposed of will not pose a fire hazard.
42 Door staff will monitor and adequately manage any queue that forms to gain entry to the premises.
43 No children are permitted upon the premises. The minimum age of entry is 18 years.
44 The Market Street entrance can only be used as an entrance / exit after 1800 hours (but it may be used as an outside area for smokers at any time the premises are open to trade.)
45 Two licensed door supervisors will be at the Market Street entrance at all times that the entrance is being used.
46 A maximum of five smokers will be permitted to use the smoking area at any one time. This area is to be supervised.
47 At closing time, the premises' security team will be available to ensure that patrons leave the premises safely. The security team will remain in the vicinity until all patrons have dispersed.
48 Patrons will not be permitted to take drinks outside into the smoking area. A licensed door supervisor / staff member will monitor patrons and ensure that this condition is imposed.
49 The advertisement of the premises from the Market Street entrance will be done in an appropriate and discreet manner, so as not to expose children to any unsuitable images.
