Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 The premises are to be equipped with a CCTV system which meets the criteria detailed in Lancashire Constabulary's Guidance Document and which is well maintained and fully functional during the hours the premises are open to members of the public.
3 The premises shall have installed a wall mounted plasma screen, no smaller than 42", mounted in a position within the premises so that patrons can view live recorded CCTV footage.
4 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times when the takeaway is open to the public. This person will be able to show Police recent data or footage with the minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
5 At any time the premises are open to the public after 3am on Fridays and Saturdays, and also on Sundays in a Bank Holiday weekend, the premises licence holder shall employ at least one SIA registered door supervisor. The supervisor shall wear reflective identification as approved by Lancashire Constabulary.
6 Any individual employed on the premises to carry out a security activity must be licensed by the SIA.
7 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
8 Frequent collection of all litter dropped within the vicinity of the licensed premises to be collected and removed, at the licence holder's expense, at a frequency of not less than 60 minute intervals during opening hours. This includes washing away to the gutter any spilled food.
9 The premises licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
10 The licensee shall ensure that staff arriving before 0900 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
11 A fire risk assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
12 A suitable and sufficient procedure should be established, to be followed in the event of an emergency.
13 A suitable and sufficient emergency lighting system to be installed conforming to BS 5266 or equivalent standard.
14 The fire alarm to be maintained in accordance with BS 5839 part 1 or equivalent, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
15 Emergency lighting to be maintained in accordance with BS 5266 or equivalent, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
16 All equipment to be subjected to a suitable system of maintenance, e.g. restaurant extraction system, cooking extraction system and cooking equipment.
17 Staff shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
18 Noise from any mechanical ventilation or refrigeration plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to local residents.
19 The collection and disposal of refuse should not take place externally between the hours of 2200 - 0800.
20 The premises licence holder shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
21 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
