Annex 2 - Conditions consistent with the Operating Schedule
1 The supply of alcohol, provision of late night refreshment, provision of regulated entertainment and the opening hours of the premises are permitted an additional hour on the following occasions:
a) On Maundy Thursday, Good Friday, Easter Sunday and Easter Monday
b) On the Friday to Monday of the May Bank Holiday
c) On the Saturday to Monday of the Spring and Summer Bank Holidays
d) On Christmas Eve, Christmas Day, Boxing Day and the day following Boxing Day
e) On New Year's Eve
2 At least one personal licence holder (whose identity will be known to all other staff engaged in the sale or supply of alcohol) will be available on the premises whenever the sale or supply of alcohol is being undertaken, except in the case of emergency.
3 The licence holder and the Designated Premises Supervisor shall nominate another person, who will deputise for the Designated Premises Supervisor in the DPS’s absence, and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
4 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
5 The licence holder and the Designated Premises Supervisor shall ensure that an appropriate number of licensed door supervisors are on duty whenever the premises are open for the purpose of a licensable activity or when patrons are upon the premises. A minimum of 2 door supervisors are to be on duty from 21.00 hours until the terminal hour of the premises on every Thursday, Friday and Saturday.
6 A record shall be kept on the premises of every person employed at the premises as a door supervisor. The record is to contain the following details:
Name and address
Date of birth
SIA licence number
Time duty commenced and time duty terminated
Said records are to be made available for inspection upon demand by a Police officer or any authorised officer.
7 The licence holder and the Designated Premises Supervisor shall arrange adequate supervision of any queue, which may form to gain entry to the premises.
8 The licence holder shall erect and maintain suitable and sufficient conspicuous signage on the exterior of the premises advising patrons that causing any disturbance or disorder in a queue will result in admission being refused.
9 The licence holder and the Designated Premises Supervisor shall ensure sufficient door staff are employed to ensure the dispersal of patrons from the curtilage and grounds of the licensed premise immediately after the end of each period of licensable activity.
10 The Licence holder and the Designated Premises Supervisor shall ensure that the door supervisors take appropriate measures to prevent the removal of bottles or glasses from the licensed premises.
11 All door staff will comply with SIA requirements relating to the availability of registration documents for inspection.
12 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / tabard of a design approved by the Lancashire Constabulary.
13 CCTV will be installed internally and externally at the premises and will comply with the following:-
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, are to be covered by the system;
The system will display on any recording the correct time and date of the recording;
The system will make recordings during all hours the premises is open to the public;
VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the Police for inspection upon request;
The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
14 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested.
15 An A4 advisory sign indicating that CCTV is in operation at the premises should be displayed on the outside of the building, at the main entrance and inside the premises. To comply with data protection legislation, signs should also include: the person or organisation responsible for the system; the purpose of the system; and details of who to contact regarding the system.
16 The licence holder and the Designated Premises Supervisor shall participate in the Pubwatch and Radiolink schemes and the local Pubwatch protocols shall be adhered to. Entry will be refused to any persons who can be identified as currently under Pubwatch ban.
17 The Radiolink equipment will be live and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
18 The Licence holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
19 The Local Authority CCTV control room will be notified: (a) On any occasion when the premises CCTV or radio system is inoperative & (b) When the CCTV or radio system has been brought back into use.
20 No patrons shall remain on the licensed premises (except for a period of 60 minutes to enable drinking-up) following the termination of licensable activity.
21 No new customer will be allowed to gain entry to the premises after 02.30 hours.
22 The premises are operated in accordance with the principles outlined by the Nightsafe Initiative, as are relevant to those premises, and indicated in the associated leaflet.
23 The licence holder and the Designated Premises Supervisor shall ensure that only toughened glass or polycarbonate vessels are used to dispense beverages to customers, and only polycarbonate vessels may be taken to the outside drinking area.
24 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
25 The licence holder and the Designated Premises Supervisor shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.
26 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by a police officer or an authorised officer acting for a Responsible Authority.
27 The Licence holder and the Designated Premises Supervisor shall erect and maintain signage (in a form approved by the licensing authority) on or adjacent to all staffed exits advising patrons of the Street Drinking Order and the intention of door staff to enforce a no exit with a bottle policy.
28 The Licence holder and the Designated Premises Supervisor shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
29 There shall be no drinks promotions which would contravene the British Beer and Pub Association Standards for the Management of Responsible Drinks Promotions, or which may encourage binge drinking.
30 Club Scan, or similar equipment, to be in operation on any entrance door to the premises and to be actively operated by a door supervisor from 2000 hours until last entry at the premises on a Thursday, Friday and Saturday. Any person appearing to be under 25 shall have either a driving licence, passport, or PASS accredited Proof of Age card recorded and processed through the scanning equipment.
31 The licence holder and the DPS are to support and rigorously enforce a Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
(i) UK photo driving licence
(ii) passport
(iii) Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future. If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
32 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
33 Unaccompanied persons under 18 years of age will not be allowed upon the premises at any time the premises are operating.
34 No person under 18 years of age will be allowed to remain on the premises after 2100 hours unless attending a pre-arranged private function.
35 No entertainment of an adult or sexual nature will take place on the premises.
36 The premises will have a zero tolerance policy towards drugs.
37 A drugs prevention strategy for the venue shall be developed, applied and documented. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
38 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
39 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that (a) It is a condition of entry that customers agree to be searched and (b) Police will be informed if anyone is found in possession of controlled substances or weapons.
40 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
41 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
42 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
43 An incident book will be maintained, in which shall be recorded :
All incidents of crime and disorder
Refused sales to suspected under age / drunken persons
A record of any person refused admission or asked to leave the premises
Details of occasions upon which the Police are called to the premises
The use or discovery of drugs
That book shall be available for inspection by a Police Officer or authorised person.
44 The licence holder and the Designated Premises Supervisor shall ensure that the maximum number of persons allowed onto the premises shall not exceed 480 persons, which is the capacity determined by the Lancashire Fire and Rescue Service.
45 The licensee shall ensure free cold drinking water is available on request and shall have adequate supplies of chilled soft drinks and bottled water available for sale at the bar(s).
46 During the final hour of daily trading the licence holder and the Designated Premises Supervisor shall ensure that appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
47 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
48 All internal lobbied doors to any entrance / exit point; fire exit doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purposes of access and egress.
49 The licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external receptacles provided for the disposal of all smoking related litter so as to prevent waste litter being deposited onto the highway.
50 The licence holder and the Designated Premises Supervisor shall ensure that the premises are operated in compliance with the recommendations contained in Safer Clubbing.
51 The licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate building regulations.
52 The licence holder shall erect and maintain in a prominent position at every exit a clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.
53 The licence holder and the Designated Premises Supervisor shall ensure sufficient door staff are employed at exits from the premises to remind departing patrons of the need to avoid causing nuisance or disturbance to local residents.
54 The licensee shall ensure that staff arriving before 0900 or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
55 The placing of refuse, such as bottles, into receptacles outside the premises shall take place between 08.00 and 22.00 hours so as to prevent disturbance to nearby premises.
56 The licensee shall ensure that noise or vibration shall not emanate from the premises such as to cause persons in the neighbourhood to be disturbed. To this end sound insulation shall be provided and regard must be had to the ventilation requirements for the premises. All sound insulation shall be installed to the satisfaction of the Council.
57 The licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services.
58 Noise from any regulated entertainment, mechanical ventilation or refrigeration plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
59 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
60 Any artificial light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
61 Alcohol sold for consumption 'off' the premises will be sold in a drinking vessel to patrons seated in the pavement cafe area exclusively.
62 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties.
