Annex 2 - Conditions consistent with the Operating Schedule
1 An incident book will be kept at the premises and made available to the responsible authorities when requested.
2 The premises will operate a "Challenge 25" policy. Signage reminding customers of this will be displayed. The only documents accepted as proof of age are:
a) Proof of age card bearing the "PASS" hologram symbol
b) UK or European photo driving licence or recognised National Identity Card
c) Passport
3 All staff to be trained in relation to underage sales and the Challenge 25 policy and will be made fully aware of their responsibilities in relation to verifying the ages of customers and be able to question potential underage customers who may attempt to purchase alcohol. An incident log will be kept at the premises.
4 Training will be recorded and updated every four months. Training will be provided in the prevention of proxy sales, sales to intoxicated persons and street drinkers, permitted licensed hours, conflict management and any other relevant matters regarding the licensing objectives. All staff will be fully trained before being allowed to sell alcohol without supervision. A training log will be kept for all staff members, in which staff sign to say that they have received the relevant training in respect of the licensing objectives and the Licensing Act 2003.
5 The premises licence holder shall ensure that a register of refused sales of all age restricted products (a refusals log) is kept and maintained at the premises. The refusals log to contain details of the time and date, a description of the attempting purchaser, description of the age restricted product they attempted to purchase, the reason the sale was refused and the name / signature of the salesperson refusing the sale.
6 All staff to be trained in the use of the refusals log. The book will be examined on a regular basis (at least weekly) by the licence holder or DPS and the date and time of each examination to be endorsed in the book. Analysis of staff refusals and data such as the time/day of refusals to be carried out by the licence holder or DPS on a regular basis in order to predict trends and identify staff training and compliance issues.
7 The licence holder shall ensure that a CCTV system is installed at the premises of evidential standard acceptable to the Police. The system shall be maintained in good working order and fully operational covering all internal areas of the premises to which the public have access plus the area immediately outside the premises. The entry point shall be covered enabling frontal identification (full head and shoulder images) of every person entering the premises in any light condition to an evidential standard.
8 Management and permanent members of staff will be trained in the operation of the CCTV system with at least one member of staff on duty who is able to download images from the system.
9 The CCTV system will have the capability to download footage onto either disc or memory stick which can be played on a computer. CCTV footage will be retained for a minimum of 31 days with the correct date and time showing. Footage shall be made available to Police or Local Authority Officers upon request.
10 If the CCTV system is broken the premises licence holder shall notify the licensing authority immediately and get the fault rectified as soon as practicable. The licence holder shall ensure that a log is kept with details of the dates of all work/repairs carried out on the CCTV system including the name and phone number of the engineer. The CCTV cameras' views are not to be obstructed.
11 The CCTV system shall, except for maintenance by a contractor between 09.30 and 22.00 hours, be fully operational and recording twenty four hours each day.
12 No beer, lager or cider above 6% will be sold at the premises.
13 There will be no deliveries of alcohol between 20.00 and 09.00 the following day.
14 No single cans of beer, lager or cider will be sold - cans will be sold in a minimum of 4 cans per transaction.
15 Details will be kept of staff members' name, date of birth and address.
16 Notices will be displayed asking customers to leave the premises quietly.
17 Notices will be displayed asking patrons not to drop litter after leaving the premises. Daily litter patrols will take place.
18 No spirits or wine to be sold in bottles less than 35cl.
19 Signage will be displayed at the entrance to the premises, at the display section of alcohol and at the point of sale advising customers of the policy in regards to proxy sales, no sales of single cans and sales to street drinkers.
20 All staff involved in the sale of alcohol are to hold a Personal Licence.
21 Shop window to be kept sufficiently clear so that persons can easily see in and out of the premises.
22 No more than 15% of display space shall be for alcohol. All alcohol will be in view of the counter. Expensive alcohol products and all spirits are to be kept behind the counter.
