Annex 2 - Conditions consistent with the Operating Schedule
1 The primary purpose of the premises is that of members only club for persons over the age of 21 only; the premises is not to be used for any other use.
2 No intoxicating liquor shall be supplied otherwise than to:
a) A member of the club who has been a member for at least 24 hours or whose nomination or application for a membership was made final at least 24 hours before his admission.
b) A guest of such a member bona fide entertained by him at his own expense and the name and address of any such guest should be recorded.
3 A list of the names and addresses of all members shall be kept on the premises (including the date they became members) and produced on demand for inspection by an authorised officer on request.
4 All members shall be required to provide valid photographic identification prior to first entry at the premises. Acceptable forms of identification are recognised photographic identification cards such as driving licence or passport. Records shall be kept detailing the identification produced and must be made available to an authorised officer on request.
5 A signing in and out register will be maintained at the premises, wherein the names of members' and guests' arrival / departure time / date will be duly recorded and must be made available to an authorised officer on request. The premises operates a computerised logging in system so the premises licence holder knows who is in the premises at any given time.
6 No person under 21 years old shall be allowed on the premises.
7 There shall be no advertisement or promotional material used by the premises that is unsuitable to be viewed by children. Any exterior signage shall be discreet and shall not display any imagery that suggests or indicates relevant entertainment takes place at the premises. Any external displays or advertising may only be displayed with the prior approval of the Licensing Service, Blackpool Council.
8 No advertisements or other notices or items shall be displayed so as to be visible from the exterior of the premises, subject to condition 7.
9 As a general rule the name of the premises shall be of an un-contentious nature and light colours used throughout to the Council’s approval
10 The exterior and entrance to the licensed premises shall be suitably screened so as to prevent any part of the interior being visible from outside the premises.
11 There shall be a solid outer and inner door fitted with automatic closures with such devices being maintained in good working order.
12 The premises shall maintain a refusals log whereby on any occasion a person is refused entry details shall be recorded. The log must be made available on request by the Police or an authorised officer of the Council.
13 An incident book will be maintained, in which shall be recorded:
i. All incidents of crime and disorder
ii. Refused sales to suspected under age / drunken persons
iii. A record of any person refused admission or asked to leave the premises.
iv. Details of occasions upon which the Police are called to the premises.
v. The use or discovery of drugs.
14 The licensee shall ensure that no part of the licensed premises shall be used by prostitutes (male or female) for soliciting or for any immoral purposes.
15 Neither the licence holder nor any employee or other person shall seek to obtain custom for the licensed premises by means of personal solicitation, by means of flyers, handouts or any like thing, outside or in the vicinity of the licensed premises.
16 CCTV will be installed internally and externally at the premises and will comply with the following:
a. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The system will incorporate a camera covering each of the entrance doors and the smoking area, and will be capable of providing an image which is regarded as identification standard.
b. The system will display on any recording the correct time and date of the recording.
c. The system will make recordings during all hours the premises are open to the public.
d. VCR tapes or digital recording shall be held for a minimum of 28 days, after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
e. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
17 A staff member who is conversant with the operation of the CCTV system will be available to attend the premises within an hour if requested by Police. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
18 Alcohol will be served in plastic glasses for consumption in the bar area only.
19 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
20 All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during hours of any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
21 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
22 A Challenge 25 proof of age policy shall be implemented and adhered to. All staff to have received suitable training in relation to the Challenge 25 proof of age scheme. Records to evidence this will be made available to an authorised officer upon request.
23 The premises operates a zero tolerance drugs policy. Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
24 Staff will be regularly trained in the Licensing Objectives.
25 No alcohol will be sold from the Touchwood Hotel, 37 St Chads Road, whilst this premises is open and Mr Patrick Christopher Maher remains as DPS on the Touchwood Hotel.
26 Clear notices will be displayed at exits asking patrons to leave the premises quietly.
27 Deliveries are to be made at a reasonable hour so as not to disturb local residents.
28 Any outside lighting is to be positioned in such a way so as not to disturb nearby residents.
