Annex 2 - Conditions consistent with the Operating Schedule
1 The premises are to operate in accordance with the principles outlined by the 'Nightsafe Scheme'.
2 The premises are to join the 'Pubwatch' and 'Radiolink' Schemes.
3 The premises are to be operated within the recommendations outlined in safer clubbing.
4 The premises are to support and follow the Drink Promotions Protocol for Friday / Saturday night as agreed with Blackpool Police.
5 A personal licence holder to be on the premises at all times whilst the sale of alcohol is being undertaken, and will be nominated to act for the Designated Premises Supervisor in their absence. This person's identity will be known to all staff.
6 The Flying Handbag links to the Flamingo at 23.00 hours when the external door of the Flying Handbag is closed and an internal connecting door is opened.
7 CCTV is to be installed internally and externally, and will be maintained by a reputable contractor.
8 The Local Authority CCTV control room will be notified:
a) On any occasion when the premises CCTV or radio system is operative.
b) When the CCTV or radio system has been brought back into use.
9 Only SIA registered door staff will be used in the recommended local authority ratio.
10 Radiolink to be in operation whilst premises is open.
11 Toughened glassware to be used throughout the premises.
12 Door staff to assist in customer dispersal at close of business.
13 Clearly visible notices in relation to drugs in line with police / local authority guidelines to be in place.
14 Capacity to be set in conjunction with the responsible authority at 1,640.
15 The company employs its own Health and Safety Officer.
16 Sound levels are to be under the control of the Designated Premises Supervisor or their designated representative.
17 Sound System is fitted with a limiter.
18 DJ / Staff and notices ask customers to leave the premises quietly at the close of business.
19 Customers who cause a nuisance arriving / leaving the premises will be cautioned and ultimately banned if there is no improvement in their behaviour.
20 Under 18's are not allowed on the premises.
21 The Licence holder is to support and rigorously enforce Challenger 21 proof of age policy.
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: -
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
22 All staff trained and records kept in relation to the service of under 18's.
23 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the ‘Nightsafe’ scheme.
24 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
25 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket/tabard of a design approved by the Lancashire Constabulary.
26 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
27 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
28 Adequate first aid provision is available at all times to include having at least one trained first-aider on the premises at all times the premises are being operated.
29 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
30 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
31 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
32 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
33 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
34 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
35 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
36 A drugs prevention strategy for the venue shall be developed and applied. The strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
37 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
38 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
39 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
40 Noise from any Regulated Entertainment, Mechanical Ventilation or Refrigeration Plant shall be inaudible within the nearest noise sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
41 All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purposes of access and egress.
42 Vibration produced as a result of any Regulated Entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
43 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.
