Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 All external windows and doors will be kept closed during regulated entertainment except in the event of an emergency, and for the purposes of access and egress.
3 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
4 Regular assessments of the noise coming from the premises during regulated entertainment shall be made and the noise level adjusted accordingly.
5 Prominent, clear and legible notices shall be displayed at all exits requesting customers to respect the needs of local residents and to leave the premises and the area quietly.
7 The placing of refuse, such as bottles, into receptacles outside the premises shall take place between 0800 and 2100 hours.
8 Within two months of the granting of the licence, at least one personal licence holder (whose identity will be known to all other staff engaged in the sale or supply of alcohol) will be available on the premises whenever the sale or supply of alcohol is being undertaken, except in the case of emergency.
9 The licence holder and the Designated Premises Supervisor shall nominate another person, who will deputise for the Designated Premises Supervisor in the DPS’s absence, and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
10 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
11 CCTV will be installed internally and externally at the premises. Said CCTV system shall comply with the following criteria:
(a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, shall be covered by the system.
(b) The system shall be recording during all hours the premises are open to the public.
(c) VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the police for inspection upon request.
(d) the system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
12 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a police officer or to a Local Authority Enforcement Officer.
13 The Licence holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
14 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.
15 The licence holder will give 10 working days’ notice to the police of any occasion when a private function is to be held at the premises. On occasions when this provision has not been complied with, the licence holder must inform the police of all private functions and the police have the power of veto in relation to any functions in which the police are given less than 10 working days’ notice. Risk assessments will be produced in relation to such functions, with consideration given to the employment of SIA registered doorstaff.
16 Within one month of the granting of the premises licence, the door to the venue will be fitted with an electronic key pad. All members of the Club will be issued with an electronic key fob which operates the key pad. Whenever the premises are operating as a members’ club and there is no door supervisor on duty, the door will be kept locked so that entry is restricted to members and their guests only by way of the electronic key pad. These requirements will not apply to those who are attending a pre-arranged private function.
17 A signing-in book will be kept by the door of the premises. Whenever a member is accompanied by a guest, he or she must sign the book and write in the name and address of his/her guest.
18 A record shall be kept on the premises of every person employed at the premises as a door supervisor. The record is to contain the following details:
(i) Name and address
(ii) Date of birth
(iii) SIA licence number
(iv) Time duty commenced and time duty terminated
Said records are to be made available for inspection upon demand by a Police officer or any authorised officer.
19 All door staff will comply with SIA requirements relating to the availability of registration documents for inspection.
20 All door staff employed at the entrance / exit of the licensed premises will wear a reflective jacket / tabard of a design approved by the Lancashire Constabulary.
21 The licence holder and the DPS are to support and rigorously enforce a Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
(i) UK photo driving licence
(ii) passport
(iii) Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
22 All staff to have received suitable training in relation to the proof of age scheme to be applied on the premises. Records to evidence this will be made available to an authorised officer upon request.
23 Any person under the age of 16 must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.
24 Persons under the age of 16 are not allowed to remain on the premises after 21.00 hours unless they are attending a pre-arranged function.
25 Functions which specifically target young people aged 17-18 years (for example birthday parties) will not be allowed to take place on the premises.
26 Whenever children are allowed upon the premises, any entertainment offered within the premises shall be suitable for young persons.
27 The premises shall be a member of the local Pubwatch scheme and the local Pubwatch protocols shall be adhered to. Entry will be refused to any persons who can be identified as currently under Pubwatch ban.
28 The premises will have a zero tolerance policy towards drugs.
29 A drugs prevention strategy for the venue shall be developed, applied and documented. This strategy shall include arrangements for the location of posters and the distribution of other information relating to drugs risks, the dangers associated with drugs and the legal provisions relating to drug use.
30 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
31 Clearly visible notices shall be displayed advising those attending that
(a) It is a condition of entry that customers agree to be searched and
(b) Police will be informed if anyone is found in possession of controlled substances or weapons.
32 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
33 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
34 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
35 An incident book will be maintained, in which shall be recorded:
(i) All incidents of crime and disorder
(ii) Refused sales to suspected under age / drunken persons
(iii) A record of any person refused admission or asked to leave the premises
(iv) Details of occasions upon which the Police are called to the premises
(v) The use or discovery of drugs
36 That book shall be available for inspection by a Police Officer or authorised person.
37 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises. The Licence holder and the Designated Premises Supervisor shall erect and maintain signage on or adjacent to all exits advising patrons of the Street Drinking Order and the intention of staff to enforce a no exit with a bottle policy.
38 The licence holder and the Designated Premises Supervisor shall ensure that only toughened glass or polycarbonate vessels are used to dispense beverages to customers.
39 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
40 During the final hour of daily trading the licence holder and the Designated Premises Supervisor shall ensure that appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
