Annex 2 - Conditions consistent with the Operating Schedule
1 On Christmas Eve and New Year's Eve the permitted hours for live music and recorded music, facilities for making music and facilities for dancing may be extended until 0100 the following morning.
2 On Christmas Eve and New Year's Eve the permitted hours for supply of alcohol may be extended until 0200 the following morning.
3 The fire alarm will be maintained and serviced quarterly and tested weekly.
4 Notices will be placed at entrances and exits asking patrons to leave quietly.
5 Noise from any regulated entertainment will be inaudible at the nearest noise sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the nearest noise sensitive premises.
6 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to patrons.
7 The removal and movement of rubbish, bottles and any beer barrels from the premises and their subsequent storage externally to the building prior to collection, shall be undertaken between 0800 and 2200 hours only, to prevent disturbance to local residents from such activities.
8 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties. Suitable external receptacles shall be provided for the disposal of all discarded smoking litter, so as to prevent waste litter being deposited onto the highway.
9 No intoxicating liquor shall be supplied otherwise than to a person who has attained the age of 18 years and is :
a member of the Club who has been a member for at least 24 hours, or whose application or nomination for membership was made at least 2 days before his admission to the Club;
OR
a bona fide guest of such a member.
OR
any person attending a social function organised by or on behalf of the Club or a Club member.
10 At least one personal licence holder (whose identity will be known to all other staff engaged in the sale or supply of alcohol) will be available whenever the sale or supply of alcohol is being undertaken, except in the case of emergency.
11 The licence holder and the Designated Premises Supervisor shall nominate another person, who will deputise for the Designated Premises Supervisor in the DPS’s absence, and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
12 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
13 CCTV will be installed internally and externally at the premises. Said CCTV system shall comply with the following criteria: (a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises, with the exception of the toilets, shall be covered by the system. (b) The system shall be recording during all hours the premises are open to the public. (c) VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the police for inspection upon request. (d) the system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
14 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show recent data or footage with the absolute minimum of delay when requested to a police officer or to a Local Authority Enforcement Officer.
15 The Licence holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
16 The licence holder will give 10 working days’ notice to the police of any occasion when a private function is to be held at the premises. On occasions when this provision has not been complied with, the licence holder must inform the police of all private functions and the police have the power of veto in relation to any functions in which the police are given less than 10 working days’ notice. Risk assessments will be produced in relation to such functions, with consideration given to the employment of SIA registered doorstaff.
17 A signing-in book will be kept by the door of the premises. Whenever a member is accompanied by a guest, or any other person he or she must sign the book and write in the name and address of his/her guest. This condition does not apply to those persons attending private functions at the premises.
18 The licence holder and the DPS are to support and rigorously enforce a Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
(i) UK photo driving licence
(ii) passport
(iii) Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
19 All staff to have received suitable training in relation to the proof of age scheme to be applied on the premises. Records to evidence this will be made available to an authorised officer upon request.
20 Any person under the age of 16 must be accompanied by a responsible adult and remains the responsibility of the accompanying adult at all times when using the premises. Members of staff are not allowed to be in sole supervision of children.
21 Functions which specifically target young people, for example 18th birthday parties, will not be allowed to take place at the premises.
22 Whenever children are allowed upon the premises, any entertainment offered within the premises shall be suitable for young persons.
23 The premises will have a zero tolerance policy towards drugs.
24 An incident book will be maintained, in which shall be recorded :
a. All incidents of crime and disorder
b. Refused sales to suspected under age / drunken persons
c. A record of any person refused admission or asked to leave the premises
d. Details of occasions upon which the Police are called to the premises
e. The use or discovery of drugs
25 That book shall be available for inspection by a Police Officer or authorised person.
26 During the final hour of daily trading the licence holder and the Designated Premises Supervisor shall ensure that appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and to advise patrons of any taxi free-phone or collection arrangements available upon the premises.
27 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
