Annex 2 - Conditions consistent with the Operating Schedule
1 Intoxicants to be sold / supplied only to persons taking meals at the premises.
2 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
3 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
4 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
5 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
6 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises, and indicated in the associated leaflet.
7 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
8 Frequent collection of all litter dropped within the vicinity of the licensed premises to be collected and removed at the licence holder's expense at a frequency of not more than 60 minute intervals during opening hours. This includes washing away to the gutter any spilled food.
9 The volume of any recorded music shall not be played at a level that predominates over other activities within the premise and in turn, shall not cause a nuisance or disturbance to any property within close proximity.
10 The Premises Licence holder shall ensure that adequate ventilation is provided so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
11 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
12 The licence holder will ensure a 'no proof - no sale' policy in relation to alcohol sales. The only acceptable forms of proof of age are as follows :
(i) Photo driving licence
(ii) Passport
(iii) PASS accredited proof of age card.
13 A fire risk assessment to be completed by a competent person and the significant findings made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
14 A suitable and sufficient fire alarm system to be installed conforming to BS 5839 part 1 or equivalent standard, this should include coverage of the accommodation above.
15 A suitable and sufficient emergency lighting system to be installed conforming to BS 5266 or equivalent standard.
16 The fire alarm to be maintained in accordance with BS 5839 part 1, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
17 Emergency lighting to be maintained in accordance with BS 5266 this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
18 All equipment to be subjected to a suitable system of maintenance e.g. restaurant extraction system, cooking extraction system, cooking equipment.
19 Suitable and sufficient fire fighting equipment to be provided and maintained.
20 Shall shall receive training in action to be taken in the event of a fire or suspicion of a fire, this shall be recorded and records made available for inspection by a Fire Officer, Police Officer or authorised Officer of the Council.
21 Emergency exits and routes to emergency exits to be indicated by appropriate signage. Signage to be provided indicating the method of emergency exit operation.
22 A suitable and sufficient means of escape to be provided at the rear of the premises e.g. steps.
23 All fire escape routes are to be kept clear of obstructions.
24 Training will be provided to staff on responsible drinking.
25 Records will be kept of any instance of disorder on the premises.
26 No alcohol will be allowed to be consumed outside.
27 Signs will be posted asking patrons to keep noise down.
28 All windows and doors are to be kept closed after 2200 hours.
29 Children must be accompanied by an adult.
30 Staff will be given training on 'Challenge 25'.
31 Staff will refuse to serve those below 21 years of age.
32 Noise from any Mechanical Ventilation or Refrigeration Plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
33 All internal doors to any entrance/exit point, fire exit doors and external windows shall be closed during hours of any Regulated Entertainment except in the event of an emergency, save for the purpose of access and egress.
34 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimize disturbance to nearby residents.
35 The Premises Licence Holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external receptacles provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway. Furthermore, any waste produced at the premises shall be removed by a Licensed Waste Carrier or disposed of at a Licensed Waste Disposal centre.
36 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties.
37 The collection and disposal of bottles and refuse should not take place externally between the hours of 22.00 - 08.00 so as to minimise disturbance to nearby residents.
