Annex 2 - Conditions consistent with the Operating Schedule
1 On Christmas Eve, Christmas Day, Boxing Day and the Friday, Saturday, Sunday and Monday of Easter, May, Spring and August Bank Holiday weekends the terminal hour for all licensable activites and the opening times of the premises shall be extended by one hour. Licensable activities are permitted to take place from the end of licensed hours of New Year's Eve to the start of Licensed hours on New Year's Day.
2 The premises are operated in accordance with the principles outlined by the 'Nightsafe' Scheme, as are relevant to those premises, and indicated in the associated leaflet.
3 The premises shall be operated in participation with the 'Pubwatch' scheme (Radiolink if applicable).
4 An adequate number of Licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' scheme.
5 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement authorities.
6 Where Radiolink equipment is in use it will be 'live' and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business (if applicable).
7 Only toughened glass vessels are used to dispense beers to customers.
8 Another member of staff shall be nominated to act for the DPS, in their absence, whose identity is known by all other staff when such absence occurs.
9 Risk assessments carried out by or on behalf of the Licence Holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
10 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
11 Records of incidents involving the use and / or detection of drugs shall be maintained and those records shall be available for inspection.
12 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
13 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
14 The DPS, when present, and all members of staff will ensure that all lawful instructions and / or directions given by the Police are complied with.
15 No person in possession of a drink in a sealed container will be allowed to enter the premises except for the purposes of delivery.
16 There will be no promotions that encourage illegal, irresponsible or immoderate consumption of alcohol.
17 Adequate provisions will be made to prevent unauthorised acess to the storage of empty bottles.
18 Staff will be given suitable training in relation to the proof of age scheme to be applied upon the premises.
19 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
20 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
21 The maximum number of persons allowed in the premises will be restricted to 200, with a limit in the function room of 124 and in the games/function room of 76.
22 Adequate and appropriate means of escape and fire fighting equipment will be available on the premises.
23 Adequate and appropriate first aid equipment and materials will be available on the premises.
24 Refuse such as bottles will be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.
25 No light from or on the premises and any other light under the control of the premises will be provided where that light causes a nuisance to any nearby premises.
26 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents when leaving the premises late at night will be displayed on the premises.
27 The volume of amplified sound used in connection with entertainment will at all times be under the control of the licensee or management and the controlling mechanism will be operated from a part of the premises inaccessible to the public. A sound pressure level cut off will be installed.
28 Where the final hour of trading is after midnight, appropriate announcements will be made to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance.
29 No nuisance will be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.
30 A notice or notices will be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
31 There will be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy will require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.
32 Accompanied children under 16 will be permitted in the bar area in line with the provisions of the Licensing Act 2003.
