Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 On Christmas Day, Boxing Day, and the Friday to Monday of Easter, May, Spring and August Bank Holiday weekends, the terminal hour for all licensable activities will be extended until 0500 hours, with the premises closing at 0530.
3 On New Year's Eve permitted hours shall be extended from the end of permitted hours on 31 December to the start of permitted hours the following day.
4 The licence holder and the designated premises supervisor shall ensure that an appropriate number of licensed door supervisors are on duty whenever the premises are open for the purpose of a licensable activity or when patrons are upon the premises. The number of door staff shall be in accordance with a written risk assessment determined by the licence holder having regard to the supervision of any queue, the dispersal of patrons at the terminal hour, preventing the removal of bottles and glasses, and reminding patrons of the need to avoid disturbance to local residents.
5 All door staff will comply with SIA requirements relating to the availability of registration documents for inspection and all door staff employed at the entrance/exit of the licensed premises will wear a reflective jacket of a design approved by the Lancashire Constabulary.
6 The licence holder and the DPS shall ensure that (a) the premises are equipped with a CCTV system which is provided and maintained to the satisfaction of the Lancashire Constabulary and (b) the DPS and one other person whose identity is known to the police will be conversant with the operation of the CCTV system and they will provide the police with all possible assistance with the minimum delay.
7 The licence holder or DPS shall notify the Police Licensing Unit on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
8 The Radiolink equipment will be live and will be monitored by the head doorman or another responsible person while the licensed premises are open for business.
9 The licence holder and the DPS shall ensure that only toughened glass vessels are used to dispense beer to customers and that all drinks sold after 1900 hours on Friday, Saturday and Sunday are dispensed in polycarbonate or similar appropriate non glass vessels.
10 The licence holder and the DPS shall ensure that the premises are operated in accordance with Nightsafe, shall participate in the Pubwatch and Radiolink schemes and shall ensure that the premises are operated in compliance with the recommendations contained in Safe Clubbing.
11 The licence holder and the DPS shall, in the absence of the DPS, identify another Personal Licence Holder who will deputise upon the premises for the DPS. The identity of the Deputy shall be made known to all other staff.
12 Risk assessments carried out by or on behalf of the licence holder under the Health & Safety at Work etc Act 1974 will be available for inspection by an officer of a Responsible Authority.
13 The licence holder and the DPS shall erect and maintain signage (in a form approved by the Licensing Authority) on or adjacent to all staffed exits, advising patrons of (a) the Street Drinking Order and the intention of door staff to enforce a no exit with a bottle policy; (b) advising patrons that causing any disturbance or disorder in a queue will result in admission being refused; (c) requesting patrons to avoid causing noise, nuisance or disturbance to local residents, and (d) advising that customers must agree to searching of outer clothing, pockets and bags, and that the police will be informed if anyone is found in possession of a controlled substance or weapon.
14 The licence holder and the DPS shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees’ Forum or any successor liaison body recognised by the Licensing Authority.
15 The licence holder and/or DPS shall develop and apply a Drugs Prevention Strategy for the venue, including (a) the display of information provided by the relevant agencies; (b) the exclusion of customers known to have been convicted or offences relating to drugs; (c) the searching of outer clothing, pockets and bags; (d) arrangements to discourage the sale or use of drugs and regular inspection of toilet areas; (e) arrangements for the storage, transfer and disposal of confiscated or found drugs; (f) arrangements for the provision of free cold drinking water; and (g) arrangements for recording incidents involving the use and/or detection of drugs and making those records available for inspection.
16 The licence holder and DPS shall ensure that staff arriving before 0900 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents and that the placing of refuse and bottles into receptacles outside the premises shall take place between 0800 and 2200 hours.
17 The licence holder and the DPS shall ensure that the maximum number of persons allowed onto the premises shall not exceed the capacity determined by the Lancashire Fire and Rescue Service.
18 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises and the licence holder shall ensure that the storage arrangements for empty bottles prevent unauthorised access to those bottles.
19 The licensee supports and will continue to rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: UK photo Driving Licence, Passport, Proof of Age Standards Scheme Card.
20 All staff to have received suitable training in relation to the Proof of Age Scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
21 The licence holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.
22 Any restrictions imposed by the licence holder, DPS and/or the terms of this licence will be prominently and clearly displayed at the entrance(s) to the licensed premises.
23 Noise from any regulated entertainment, mechanical ventilation or refrigeration plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the resident of these properties or their guests.
24 The volume of amplified sound used in connection with any regulated entertainment shall, at all times, be under the control of the licence holder, DPS or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
25 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
26 All external doors to any entrance/exit point and any external windows shall be closed by 0000 hours during hours of any regulated entertainment, except in the event of an emergency, save for the purpose of access and egress. All fire exit doors shall remain closed during hours of any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
27 The licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
28 Any artificial light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
