Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 The Personal Licence Holder will always be present on the premises when it is open. If the Personal Licence holder is unable to be present a policy will be in place to ensure that the Personal Licence Holder will be contactable by text, mobile phone or landline.
Each member of staff will be aware of the policy to contact the Personal Licence Holder if any of the four licensing objectives is not being met or there is an issue which may compromise the four objectives.
It is the responsibility of the Personal Licence Holder to supervise and be vigilant that the four objectives are being met and if they may be compromised ensure that the correct policy is put in place to continue the promotion of the four objectives.
3 The consumption of alcohol will only be permitted where customers are eating in the premises.
4 All staff will receive full training, supervision and continued support to ensure:
• Zero tolerance policy on drunkenness and over exuberant behaviour that falls below an acceptable standard. This is to be monitored closely with any customers being asked to leave the premises before behaviour becomes a problem or anti-social disturbance for other people outside the premises;
• Zero tolerance on the use and supply of drugs for which full support and co-operation will be given to the appropriate authorities at all times. All staff will be trained and supervised to spot and encourage the early detection of any use/sale of drugs on the premises. This will include consideration of entry and search procedures. Vigilance of customers' mood and demeanour compared to known or suspected alcohol intake on entering and whilst on the premises.
• Zero tolerance on any form of violent behaviour towards staff and customers. Support and co-operation will be given to the relevant authorities if any form of violent behaviour is manifest in whatever form. Staff will receive training on how to diffuse potentially violent scenarios and will be trained on the procedures that should be put in place should such an episode occur.
• Zero tolerance to any form of anti-social behaviour. The premises licence holder will participate as fully as possible in any local schemes which fosters contact between the local police and other licensed premises to warn of possible situations of disorder.
5 Signs will be displayed which encourage only responsible drinking.
6 The premises licence holder will promote the benefits of a “designated driver” scheme and discourage in any way possible drink driving.
7 The sale of alcoholic drinks will end before the premises closes to aid in the gradual dispersal of customers.
8 At all times one trained first aider will be on the premises. The first aider will keep a training book.
9 Whilst recorded music is played through speakers the sound levels will not be excessive in nature. Music will be played to accompany and enhance the customer experience as background music.
10 All staff will be trained on emergency protocols including public safety to include appropriate methods of exiting the premises in the event of a fire. Sign posting of all staff to those staff members who are first aid trained. Staff training on what to do in other emergencies such as medical intervention, contact with the police.
11 Staff will be trained to be aware of all and any fire hazards which there may be or which may be created ancillary to their activities. This will include training and supervision of the removal of all packaging which may constitute a fire hazard and its safe disposal. Such training will extend to other such hazards such as hazards from broken glass.
12 All parts of the premises will be adequately illuminated and those portions to which the public has access and all routes of escape for customers and staff shall be provided with adequate means of illumination.
13 No explosive or highly inflammable material shall be stored on the premises and any fire hazard will be removed.
14 When disabled people are present on the premises adequate arrangements will be in place to enable their safe evacuation in the event of an emergency and disabled persons on the premises will be made aware of those arrangements.
15 In order to avoid nuisance, the premises licence holder will ensure that:
• Noise or vibration will not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed. Noise from the premises should not be audible within any noise sensitive premises (e.g. dwelling) with windows open for normal ventilation especially after 11pm. This will be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises. The criteria that will be applied are (i) Before 11pm - Noise emanating from the premises will not be clearly distinguishable above other noise. (ii) After 11pm - Noise emanating from the premises will not be distinguishable above background levels of noise.
• The volume of sound used in connection with the entertainment provided shall at all times be under the control of the Licensee/Management and the controlling mechanism shall be operated from a part of the Premises not accessible to the public.
• Prominent, clear and legible notices will be displayed at all exits requesting the public to respect the needs of local residents/businesses and to leave the premises and the area quietly.
• The placing of refuse, such as bottles, into receptacles outside the premises will take place at times that will prevent disturbance to nearby properties. Placing of refuse, bottles into receptacles will be limited to the period of 9am to 5pm.
• Deliveries of kegs, bottles, food or other materials necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents/businesses. Deliveries will be limited to the hours of 9am to 5pm
• We will ensure that staff who arrive early morning or depart late at night when the business has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents.
• Doors and windows will be kept shut as far as practical (not impacting on ventilation/room temperature) to reduce noise break out.
• Customers will be asked not to stand around talking in the street outside the premises and asked to leave the vicinity quickly and quietly.
• An announcement will be made prior to closing requesting patrons’ cooperation in leaving the premises and vicinity as quietly and quickly as possible.
• Staff will be positioned at exits particularly at closing times to ensure noise from patrons leaving the premises is minimised.
• Cooking, noxious or persistent smells from the premises will not cause a nuisance to nearby properties and the premises must be properly vented.
16 A Challenge 21 proof of age policy shall be implemented and adhered to. All staff to have received suitable training in relation to the Challenge 21 proof of age scheme. Records to evidence this will be made available to an authorised officer upon request. Refresher training will take place at 3 monthly intervals.
17 The only forms of identification that will be accepted at the premises will be the driving licence, Passport and Government approved PASS cards.
