Annex 2 - Conditions consistent with the Operating Schedule
1 A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
2 At least one CCTV camera will be in operation at the front of the premises at all times when the premises is in use.
3 Alcohol and soft drinks will be served in plastic or toughened glasses.
4 All bottles sold will be made of plastic (where available). Where glass bottles are to be used the contents will be decanted into plastic or toughened glasses where it is not intended that the contents are to be consumed direct from the bottle.
5 Customers carrying open or sealed bottles or glasses will not be admitted to the premises at any time.
6 Customers will not be permitted to take open containers of alcohol or soft drinks from the premises.
7 All bottles and glasses are to be removed from public areas as soon as the contents have been drunk or are empty.
8 Bottle bins for collection or empty bottles will not be accessible to members of the public.
9 We have a proof of age policy that has been formulated in discussion with the Police and the Licensing Authority.
10 All-inclusive nights or other irresponsible drinks promotions will not be permitted.
11 The Designated Premises Supervisor or a Personal Licence holder will be in charge of the premises when any drinks promotions are taking place.
12 We have an anti-drugs policy that has been agreed following discussion with the Police and the Licensing Authority and is in line with the Safer Clubbing Guidance.
13 A secure facility to store controlled drugs prior to collection is available.
14 A drugs register will be maintained.
15 The Police will be notified of all seizures of controlled drugs.
16 Crime prevention notices are displayed warning customers of the possibility of crime which may target them, e.g. “Bags should not be left unattended”, “Watch out for Pickpockets”.
17 A detailed “Customer Code of Conduct” poster is conspicuously displayed warning customers that if they act in an inappropriate manner they could be barred from all licensed premises in the vicinity.
18 Any restrictions on the admission of children to the premises are conspicuously displayed outside the premises.
19 A Personal Licence holder will be at the premises at all times when alcohol is being sold or regulated entertainment is being provided.
20 We have a policy on the safe management of large groups, i.e. hen and stag parties.
21 A secure area for customer’s personal belongings is available.
22 We provide food that is available at all times when the premises are open
23 We have conducted a suitable Fire Risk Assessment at the premises and implemented the necessary control measures.
24 All exit doors are easily operable without the use of a key, card, code or similar means.
25 Exit doors are regularly checked to ensure they function satisfactorily.
26 All removable security fastenings are removed whenever the premises are open to the public or staff.
27 All fire doors are maintained unobstructed and effectively selfclosing and will not be held open other than with approved devices.
28 Fire resistant doors to service shafts, ducts and cupboards are kept locked shut.
29 Notices detailing the actions to be taken in the event of fire or other emergency are prominently displayed and maintained in good condition.
30 Access is provided for emergency vehicles and kept clear and free from obstruction at all times .
31 The premises have current certificates of inspection for all portable fire fighting equipment. An inspection is carried out every 6 Months and new certificates will be obtained at these intervals.
32 A noise management plan has been devised and is in operation at the premises. Noise or vibration from the premises will be maintained at a level that will not be audible at the façade of any neighbouring noise sensitive premises.
33 Doors and windows will be kept closed when regulated entertainment is taking place. All windows are double glazed to minimise the breakout of noise.
34 All entrances and exits have an effective lobby to minimise the breakout of noise. Noise limiters can be fitted fitted to amplification equipment and have been set at a level agreed with the local authority.
35 Prominent, clear and legible notices are displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
36 Disposal of empty bottles into waste receptacles outside the premises will not be permitted to take place between the hours of 23:00 hrs and 07:00 hrs to minimise disturbance to nearby occupiers.
37 For the final hours of opening the music is reduced in volume and is discernibly quieter. The playing of live or recorded music in garden or outside seating areas of the premises is not permitted after 20:00 hrs.
38 The garden or outside seating areas are closed to the public after 22:00hrs.
39 All fixed plant and equipment at the premises e.g. ventilation systems that produce significant levels of noise are fitted with appropriate means of noise suppression and are restricted in their use so as to minimise disturbance to any neighbouring noise sensitive premises.
40 A full acoustic survey into the impact of noise from the premises will been carried out by a competent person.
41 All ventilation and extract systems are designed and maintained so as to prevent noxious smells causing a nuisance to nearby properties.
42 Light pollution Flashing / bright / flood lights used outside the premises and any security or access lighting installed will not be operated so as to cause a nuisance to nearby occupiers.
43 All external lighting, including floodlighting, is directed away from adjacent occupiers.
44 The premises operates a proof of age policy that has been agreed by the police.
45 When children are allowed on the premises, a “no smoking” area of such a size and design that it genuinely provides a suitable, comfortable area for children and families wishing to be separated from smoking areas will be available on the outside seating area .
46 The licence holder and the DPS are to support and rigorously enforce a Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
(i) UK photo driving licence
(ii) passport
(iii) Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future.
If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be displayed in the premises.
47 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
48 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
49 Security/staff arrangements will be sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular documented checks of toilets.
50 An adequate number of licensed door supervisors shall be on duty as appropriate to any risk assessment determined by the premises licence holder.
51 Alcohol may be sold to non-residents 11.00-23.00 daily with non-residents leaving the premises by 23.00 except on Christmas Eve and New Year’s Eve when they may be sold alcohol and stay on the premises until 01.00.
52 Any outside area which is used for the consumption of alcohol shall cease to be so used at 22:00hrs.
53 Any persons under 18 years of age must be accompanied by a responsible adult and remain the responsibility of the accompanying adult when using the premises. Staff are not allowed to be in sole supervision of children, who remain the responsibility of the accompanying adult at all times.
54 All children must leave the bar area by 23:00 hours.
55 CCTV will be installed internally at the premises and will comply with the following:
a) The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. The entrance and bar areas are to be covered by the system. The system will incorporate a camera covering each of the entrance doors and will be capable of providing an image which is regarded as identification standard.
b) The system will display on any recording the correct time and date of the recording.
c) Digital recording shall be held for a minimum of 28 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for Responsible Authority for inspection upon request.
56 All windows and doors will be closed at or before 23:00 hrs.
57 Residents and bona fide guests of Barrons Hotel and the Tamarind Hotel 56 Hornby Road, Blackpool, may be served alcohol for consumption on the premises 24 hours a day. For the avoidance of doubt, residents of 56 Hornby Road are not permitted to remove alcohol from 58-60 Hornby Road, even to take it back to their own hotel room.
