Additional Conditions

• Annex 1 - Mandatory conditions

   

  1              Alcohol may be sold or supplied:

   

  a)              On weekdays, other than Christmas Day, Good Friday or New Year’s Eve from 11 a.m. to 12 midnight.

  b)              On Sundays, other than Christmas Day, or New Year’s Eve and Good Friday, from 12 noon to 11.30 p.m.

  c)              On Christmas Day, 12 noon to 11.30 p.m.

  d)              On New Year’s Eve, except on a Sunday, 11 a.m. to 12 midnight;

  e)              On New Year’s Eve on a Sunday, 12 noon to 11.30 p.m.

   

  On New Year’s Eve, from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

  The above restrictions do not prohibit the sale or supply of alcohol to any person residing in the licensed premises, or the supply of alcohol to any private friends of a person residing there who are bona fide entertained by him at his own expense.

   

  2              The premises shall be used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises and for the purpose of habitually providing for reward board and lodging, including breakfast and one other at least of the customary main meals.

   

  3              Intoxicating liquor shall not be sold or supplied -

   

  a)              Otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to his meal,

   

  or

   

  b)              Otherwise than to persons residing there or their private friends bona fide entertained by them at their expense, and for consumption by such a person or his private friend so entertained by him either on the premises or with a meal supplied at but to be consumed off the premises.

   

  4              Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.

   

  5              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  6              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

   

  7              Adequate sitting accommodation to be provided in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  Notwithstanding the grant of this licence the applicant will not permit any of the licensable activities granted as a variation until the works detailed in the Fire & Rescue Service Report of 15/8/05 has been completed.

   

  The licence holder and the Designated Premises Supervisor shall nominate another person who will deputise for the DPS in that person's absence and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.

   

  The licence holder and the DPS shall ensure that only toughened glass vessels are used to dispense beer to customers.

   

  The licence holder and the DPS shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles.

   

  The licence holder and DPS shall ensure that at least one personal licence holder is available while the supply or sale of alcohol is being undertaken and shall ensure that person’s identity is known to all other staff engaged in the supply or sale of alcohol.

   

  The licence holder and the DPS shall erect and maintain signage (in a form approved by the licensing authority) on or adjacent to all staffed exits advising patrons of the street drinking order and the intention of door staff to enforce a 'no exit with a bottle' policy.

   

  Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.

   

  The licensee shall ensure that the ventilation to the premises is maintained to satisfy the appropriate Building Regulations.

   

  The licensee shall ensure free cold drinking water is available on request and shall have adequate supplies of chilled soft drinks and bottled water available for sale at the bar(s).

   

  The licence holder shall erect and maintain in a prominent position at every exit a clear and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents.

   

  The licensee shall ensure that staff arriving before 0900 or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbances to nearby residents.

   

  The placing of refuse, such as bottles, into receptacles outside the premises shall take place between 0800 and 2000 so as to prevent disturbance to nearby premises.

   

  The licensee shall ensure that noise or vibration shall not emanate from outside the premises such as to cause persons in the neighbourhood to be disturbed. To this end sound insulation shall be provided and regard must be had to the ventilation requirements for the premises. All sound insulation shall be installed to the satisfaction of the council.

   

  The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.

   

  The Licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services.

   

  The licence holder shall erect and maintain a sufficient number of signs at each bar or alcohol sales point informing customers that sales will not be made to persons under 18 years of age.

   

  No entertainment of an adult or ‘sexual’ nature will take place upon the licensed premises.

   

  Children will only be allowed into the ‘wet lounge’ when accompanied by an adult.
