Annex 2 - Conditions consistent with the Operating Schedule
1 On the Friday to Monday of Easter, May, Spring and August Bank Holiday weekends, Christmas Day and Boxing Day, licensable activities shall be extended until 0500, with the premises closing to the public one hour after all licensable activities cease.
2 On New Year's Eve hours may be extended from the end of permitted hours on New Year's Eve to the start of permitted hours on New Year's Day.
3 On no more than 12 occasions per calendar year and following 10 working days' written notice to be given to the Police and Licensing Authority, the hours for the provision of licensable activities currently provided at the premises may be extended to such time as agreed with the Police, the Police having the power to veto any such application on the crime prevention objective.
4 An additional hour may be permitted to the standard times on the day when British Summer Time begins.
5 The premises are operated in accordance with the principles outlined by the ‘Nightsafe’ Scheme, as are relevant to those premises.
6 The premises shall be operated in participation with the ‘Pubwatch’ and ‘Radiolink’ schemes.
7 The premises shall be operated in compliance with the recommendations contained in Safer Clubbing.
8 All staff to have received suitable training in relation to the ‘Challenge 25’ proof of age scheme which is adopted at the premises. The following forms of identification will be acceptable: photo driving licence, passport, proof of age standards scheme card, any other locally or nationally approved form of identification which may be introduced in the future. Records to evidence this will be made available to an authorised officer upon request.
9 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe Scheme.
10 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
11 All door staff employed by the premises will wear a high visibility jacket or tabard approved by Blackpool Council and / or Lancashire Constabulary whilst on duty.
12 The premises are to be equipped with a closed circuit television system, which is appropriate to its purpose and provided and maintained to the satisfaction of the enforcement Authorities.
13 The Local Authority CCTV control room will be notified:
a) On any occasion when the premises CCTV or radio system is inoperative.
b) When the CCTV or radio system has been brought back into use.
14 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
15 The Radiolink equipment will be ‘live’ and will be monitored by the Head Doorman or another responsible person while the licensed premises are open for business.
16 The premises are only to use polycarbonate glasses and PET bottles and/or will decant all glass bottles into polycarbonate vessels at all times licensable activity is taking place.
17 At least one personal licence holder will be available on the licensed premises while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
18 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
19 Adequate first aid provision is available at all times.
20 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or a Responsible Authority.
21 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
22 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
23 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that 1. It is a condition of entry that customers agree to be searched and 2. Police will be informed if anyone is found in possession of controlled substances or weapons.
24 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
25 Records of incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
26 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
27 A drugs prevention strategy for the venue shall be developed and applied. To include the requirements prescribed by the Lancashire Constabulary.
28 During the final hour of daily trading appropriate announcements are made or images are projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents.
29 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licensee or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
30 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
31 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at every exit.
32 Door staff will monitor and adequately manage any queue that forms to gain entry to the premises.
33 Noise from any regulated entertainment, mechanical ventilation, refrigeration plant or licensed gaming machines shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of these properties or their guests.
34 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
35 All internal lobbied doors to any entrance / exit point, fire exit doors and external windows should be closed during hours of any regulated entertainment except in the event of an emergency, save for access and egress.
36 The collection and disposal of bottles and refuse shall not take place externally between the hours of 2200 and 0800.
37 The premises licence holder will ensure that all staff at the premises are trained in the sale of alcohol.
38 Soft drinks will be available until 30 minutes before the premises closes.
39 No entertainment of an adult nature will take place on the premises.
40 The premises will be constructed in accordance with drawing numbers BG-06-300E (Basement), BG-06-301G (Ground Floor), and BG-06-308D (First Floor) and as referenced in Annex 4 (PL1660/1/4, PL1660/2/4, PL1660/3/4), or in the case of alteration to those drawings, any further drawing served on the responsible authorities and licensing authority prior to the opening of the premises.
41 That part of the premises hatched blue (Che Bar) on the plan numbers BG-06-300E, BG-06-301G and BG-06-308D together with the external roof garden / smoking area will be permitted to operate prior to the construction of the remainder of the premises. The remainder of the premises will commence operation once construction has been completed. That part of the premises hatched blue on the plans together with the external roof garden / smoking area and the remainder of the premises will comply with the conditions attached to the premises licence.
42 An approved electronic identification scanner system will be used at the entrance of Che Bar & Coco Club. The scanner must be in operation whenever door staff are present at the premises.
43 The Designated Premises Supervisor and anyone employed in a management capacity shall attend the Blackpool Council Compliance Awareness Course, and all bar staff to attend the BIIAB Responsible Retailing Course or an equivalent approved course within eight weeks of the commencement of their employment.
44 All door staff to be positioned on raised platforms when on static points inside the premises.
45 A minimum of one member of door staff to be present in the roof top smoking area after 2200 hours at all times until 30 minutes after licensable activities have ceased.
46 No boxing machines to be in operation in the premises.
47 At any time after 2200 hours on every Friday and Saturday and every Bank Holiday Sunday and during all other peak operating periods when occupancy is above 800 persons at the premises Che Bar will only use one entrance, that being on Talbot Square and a separate exit, that being on Market Street.
48 No dancing to be permitted on the tables or furniture inside the premises save for on the dance podiums specifically designed for the purpose and compliant with building regulations.
49 Any customers known to have been previously convicted or of committing criminal offences relating to violent or drug offences (wherein the designated premises supervisor has been made aware of this by the Police) shall be removed and excluded from the premises.
50 Additional CCTV cameras are to be installed in Coco Club to ensure that all public areas are covered and additional external CCTV cameras to be installed to adequately provide CCTV coverage to the external perimeter of the premises in agreement with Lancashire Constabulary.
