Annex 2 - Conditions consistent with the Operating Schedule
1. The licence holder shall provide and maintain suitable and sufficient CCTV surveillance systems as approved by Lancashire Constabulary.
2. The licence holder shall arrange and ensure that the supply of drinks to customers is made only in plastic containers or cans.
3. The licence holder shall ensure that the premises are operated in accordance with the standards described in the Nightsafe leaflet.
4. The licence holder shall erect and maintain suitable, sufficient and conspicuous signs on the exterior of the premises advising customers that causing any disturbance or disorder in a queue will result in them not being served.
5. Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be made available to the responsible authorities.
6. The licence holder shall ensure that the ventilation to the premises is maintained to satisfy the appropriate building regulations.
7. The licence holder shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services.
8. The licence holder shall arrange adequate supervision of any queue of customers.
9. The licence holder shall erect and maintain in a prominent position clear and conspicuous notices requesting patrons to avoid causing noise nuisance or disturbance to local residents.
10. The licence holder shall ensure that staff when leaving the premises late at night after the business has ceased trading will not cause nuisance or disturbance to nearby residents.
11. Litter arising from takeaway food premises may cause a nuisance in thoroughfares some distance from the licensed premises. The Council’s Director of Technical Services may publish a plan to locate approved receptacles in appropriate positions to mitigate this nuisance. The licence holder will provide a litter receptacle of a type approved by the Director of Technical Services to be located in a position identified on the published plan or in the absence of such a plan in a position in the vicinity of the licensed premises.
12. The licence holder will arrange for litter dropped in the vicinity of the premises to be collected and removed at the licence holder’s expense at a frequency of not less than 60 minute intervals during opening hours.
13. For the purpose of the condition above the collection and removal of litter should be taken to include the washing away to the gutter of spilled food and similar materials so as to leave the footway in a clean safe and wholesome condition.
14. The placing of refuse such as bottles into receptacles outside the premises shall take place between 08.00-22.00 so as to prevent disturbance to nearby premises.
15. Unaccompanied children will not be served after 22.00.
16. The licence holder shall produce a health and safety management plan to be agreed with the health & safety department of the Council. Such plan shall be reviewed and updated every 12months.
17. The licence holder shall obtain written evidence of the safety and maintenance of the electrical installation for the premises and such written evidence shall be reviewed and updated at least every five years.
18. The licence holder shall obtain written evidence if the safety of the electrical equipment in use at the premises (PAT testing) and such written evidence shall be reviewed and updated every 12 months.
19. The licence holder will provide an assessment as to whether there is asbestos present in the premises.
20. The licence holder shall obtain written evidence of health & safety training relating to management and employees and such written evidence shall be reviewed and updated every 12months.
21. This licence shall not take effect until all work has been done and required evidence has been produced to the satisfaction of the health and safety department, and the relevant officer has notified the licensing service to this effect in writing.
