Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 Noise from the ventilation system shall not exceed 5dBA , when measured at any point one meter from the facade of premises used for residential acommodation, and after 2300 on any day the ventilation system shall be inaudible and free from perceptible vibration in the adjoining buildings.
3 In the event of any complaint(s) about noise or odours from any plant or equipment, such as the ventilation system, the licensee shall employ the services of a reputable sound consultant and / or ventilation engineer to undertake a detailed assessment. A copy of this report shall be made available to Environmental Protection for their comments and approval. Any works shall be carried out in accordance with the assessment and to the satisfaction of the Environmental Services Division.
4 The licensee shall ensure that staff arriving before 09.00 or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbances to nearby residents.
5 The premises licence holder will arrange for litter dropped in the vicinity of the licensed premises to be collected and removed at the license holder's expense at a frequency of not less than sixty minute intervals during opening hours.
6 For the purpose of conditions above the 'collection and removal of litter' should be taken to include the washing away to the gutter of spilled food and similar materials so as to leave the footway in a clean, safe and wholesome condition.
7 The placing of refuse such as bottles into receptacles outside the premises shall not take place after 2200 so as to prevent disturbance to nearby premises.
8 Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly.
9 The takeaway has four CCTV security cameras, all of which record in colour. These cameras are connected to a multiplex recorder which records for 24 hours a day.
10 CCTV tapes shall be retained for 31 days and recordings shall be made available to the police upon request.
11 The premises shall have installed a wall mounted plasma screen, no smaller than 32", mounted in a position within the premises so that patrons can view live recorded CCTV footage.
12 The delivery of take-away food stops at 01.00 hours. Delivery of stock to the takeaway is every Tuesday before 1900 and is delivered to the rear of the building to minimise disruption to traffic.
13 There are provisions within the premises for waste litter.
14 The licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services. Any new or substantial alteration to the ventilation system shall comply with DEFRA's "Guidance on the control of Odour and Noise from Commercial Kitchen Exhaust Systems".
15 The premises licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
16 The collection and disposal of any waste / refuse should not take place externally between the hours of 22.00 - 08.00.
17 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
