Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 There will be substantial refreshment available at all times the premises are open for trade.
3 The primary purpose of the premises shall be that of a café serving food, with the sale of alcohol secondary.
4 There will be no off sales.
5 The premises are to be equipped with a CCTV system which meets the criteria detailed in the Lancashire Constabulary's Guidance document and which is well maintained and fully functional during the hours the premises are open to members of the public.
6 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times when the venue is open to the public. This person will be able to show police recent data or footage with the minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
7 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the 'Nightsafe' Scheme.
8 The licence holder is to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.
9 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
10 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
11 The premises shall be operated in participation with the 'Pubwatch' Scheme.
12 The premises shall maintain a drinks pricing policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor liaison body recognised by the Licensing Authority.
13 Only toughened glass vessels are used to dispense beer to customers.
14 No open bottles / containers are to leave the premises. The licence holder shall erect and maintain signage on or adjacent to all exits advising patrons of the Street Drinking Order and that drinks may not be consumed outside the confines of the licensed area.
15 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
16 Clearly visible notices, in a form prescribed by the Council, shall be displayed advising those attending that (1) It is a condition of entry that customers agree to be searched and (2) Police will be informed if anyone is found in possession of controlled substances or weapons.
17 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
18 Any customers known to have been previously convicted of committing criminal offences relating to drugs shall be excluded from the premises.
19 Records of Incidents involving the use and/or detection of drugs shall be maintained and those records shall be available for inspection.
20 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
21 The Licensee shall ensure that staff arriving before 0900 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbance to nearby residents.
22 Any background music will be unamplified and shall be at a level which does not cause unreasonable disturbance to residents in the area.
23 All doors and windows in the function room and adjoining corridors / access rooms shall be closed during regulated entertainment except in the event of an emergency.
24 The placing of refuse such as bottles into receptacles outside the premises shall take place between 0800 and 2100 hours so as to prevent disturbance to nearby premises.
25 The Licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services. Any new or substantial alteration to the ventilation system shall comply with Defra's "Guidance on the control of odour and noise from commercial kitchen exhaust systems".
26 In the event of any complaint(s) about noise or odours from any plant or equipment, such as the ventilation system, the licensee shall employ the services of a reputable sound consultant and / or ventilation engineer to undertake a detailed assessment. A copy of this report shall be made available to Environmental Protection for their comments and approval. Any works shall be carried out in accordance with the assessment and to the satisfaction of the Environmental Services Division.
27 Health and safety posters / procedures manual will be in place, and the premises will be equipped with a fire procedures poster, accident book, first aid kit, smoke detectors, fire extinguishers (to be tested annually).
28 All areas are to be cleared of bottles / glasses on a regular basis and exits / entrances to be kept clear at all times in case of an emergency.
29 Notices will be displayed at the exits requesting that customers leave the premises quietly and in an orderly fashion. Noise levels will be checked in relation to outside areas on a regular basis to ensure that no noise nuisance is caused to any neighbours. Any complaints will be logged and dealt with accordingly.
