Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult or sexual nature will take place on the premises.
2 The licence holder and DPS shall ensure only toughened glass vessels are used to dispense beers to customers, and ensure that empty bottles are stored safely to prevent unauthorised access.
3 The licence holder shall erect signage advising that no alcohol shall be taken and consumed off the premises and no alcohol may be purchased for persons under 18 years of age.
4 Signage will be displayed in prominent locations adjacent to exits advising patrons about the street drinking ban.
5 The licence holder and DPS shall nominate another person to act as DPS in their absence, all staff shall be aware of the identity of the deputy.
6 Frequent collection of glasses and bottles shall be undertaken in and around the licensed area.
7 Free cold drinking water will be available upon request. Adequate supplies of soft drinks and bottled water shall be on sale at the bars.
8 Notices shall be displayed requesting patrons to avoid causing noise or nuisance to nearby properties when entering and exiting the building. This shall include staff leaving late at night and arriving early in the morning.
9 The placing of refuse such as bottles to take place between the hours of 0800 and 2000 to prevent disturbance to nearby premises.
10 Music and entertainment to be monitored on a regular basis with a noise meter, and regular readings to be recorded.
11 Children are only allowed in the licensed area when accompanied by an adult.
12 Noise from any regulated entertainment will be inaudible at the nearest noise sensitive premises or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to local residents
13 The volume of amplified sound used in connection with entertainment shall at all times be under the control of the Licensee or Management and the controlling mechanism shall be operated from a part of the premises inaccessible to customers.
14 All external windows, fire doors and internal doors leading into the licensed area which by their opening would allow noise from regulated entertainment to escape externally and cause disturbance to local residents, should remain closed during the provision of the said regulated entertainment except when being used as an escape route in the event of an emergency.
15 The removal and movement of rubbish, bottles and beer barrels from the premises and subsequent storage externally to the building prior to collection shall be undertaken between 08.00 and 20.00 hours only to prevent disturbance to local residents from such activities.
16 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by customers, clear and legible notices requiring patrons to leave the premises and the area quietly so as to minimize disturbance to local residents.
17 All external smoking areas provided for the premises shall be located in such a position, so that any associated use does not cause a nuisance to any nearby noise sensitive properties. Suitable external receptacles shall be provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway.
18 Licensable activities are permitted for residents and non-residents attending a pre-booked function only.
19 Intoxicants shall be sold/supplied only to: (a) Persons residing there and their private friends, bona fide entertained by them at their own expense and for consumption by such persons or their private friends on the premises. (b) Persons attending bona fide pre-arranged functions by invitation only.
20 The terminal hour for sale of alcohol to non residents attending pre-arranged functions is 1am.
21 Each person booking a function will be asked to sign a contract detailing all expectations of parties concerned which will include upholding all licensing objectives.
22 Functions are likely to be weddings, anniversaries and funerals etc. The premises licence holder does not intend to hold parties for young people.
23 The licence holder and/or DPS is to support and rigorously enforce the Challenge 21 Proof of Age policy. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future. If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
24 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
25 CCTV, which complies with the following criteria, will be installed at the premises:
a. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary.
b. The system shall display on any recording the correct time and date of the recording.
c. The system shall be recording during all hours the premises is open to the public.
d. VCR tapes or digital recording shall be held for a minimum of 30 days after the recording is made and will be made available to the Police for inspection upon request.
e. The system shall, as a minimum, record images of the head and shoulders of all persons entering the premises.
f. A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the club is open to the public. This staff member will be able to show police or any authorised person recent data or footage with the absolute minimum of delay when requested.
26 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by a police officer or any authorised officer of a responsible authority.
