Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult nature will take place on the premises.
2 The premises are open to the public and may provide late night refreshment until midnight on Sunday to Thursday and until 0100 the following morning on Friday and Saturday evenings.
A terminal hour of 0100 to apply on the Sunday and Monday of each Bank Holiday weekend and the Thursday before Easter Holiday weekend, Christmas Eve, Boxing Day and New Year's Eve where they fall on a Sunday to Thursday inclusive.
3 The premises will be closed to the public but will continue to provide pre-ordered delivery of hot food between the hours of midnight and 0100 on Sunday to Thursday inclusive, between 0100 and 0300 on Friday and Saturday and between 0100 and 0200 on the Sunday and Monday of each Bank Holiday Weekend and the Thursday before Easter Holiday weekend, Christmas Eve, Boxing Day and New Year's Eve where they fall on a Sunday to Thursday inclusive.
All orders will be taken by telephone with delivery only to a permanent fixed address. All details will be recorded in an order book and made available for inspection by an authorised officer.
4 The premises are to be equipped with a closed circuit television system which meets the criteria detailed in Lancashire Constabulary's Guidance Document CCTV/AW1, and which is well maintained and fully functional during the hours the premises are open to members of the public. CCTV recordings shall be retained for a period of 30 days and made available within a reasonable time upon request by the enforcement authorities.
5 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises is open to the public. This staff member will be able to show Police recent data or footage with the absolute minimum of delay when requested. This data or footage reproduction should be almost instantaneous.
6 There will be maintained, on the premises, at all times, an adequate and appropriate supply of first aid equipment and materials.
7 Adequate and appropriate means of fire fighting equipment will be available on the premises.
8 This undertaking must be operated in compliance with the Health and Safety at Work etc Act 1974 and all relevant regulations made there under. No additional safety measures are considered appropriate for these premises.
9 The licensee shall ensure that staff arriving before 9.00 hours or departing late at night when the business has ceased trading conduct themselves in such a manner to avoid disturbances to nearby residents.
10 The premises License holder will arrange for litter dropped in the vicinity of the licensed premises to be collected and removed at the License Holder's expense at a frequency of not less than sixty minute intervals during opening hours.
11 For the purpose of conditions above 'the collection and removal of litter' should be taken to include the washing away to the gutter of spilled food and similar materials so as to leave the footway in a clean, safe and wholesome condition.
12 Prominent, clear and legible notices shall be displayed at all exits requesting the public to respect the needs of local residents and to leave the premises and the area quietly.
13 The placing of refuse such as bottles into receptacles outside the premises shall take place at the following specified times so as to prevent disturbance to nearby premises.
14 The Licensee shall ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to nearby properties, and that the premises shall be adequately ventilated to the satisfaction of the Head of Environmental Services. Any new or substantial alteration to the ventilation system shall comply with DEFRA's "Guidance on the control of Odour and Noise from commercial Kitchen Exhaust Systems".
15 In the event of any complaint(s) about noise or odours from any plant or equipment, such as the ventilation system, the licensee shall employ the services of a reputable sound consultant and/or a ventilation engineer to undertake a detailed assessment. A copy of this report shall be made available to Environmental Protection for their comments and approval. Any works required to remedy the complaint shall be carried out in accordance with the assessment and to the satisfaction of the Environmental Services Division.
16 The Premises Licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather.
17 The collection and disposal of any waste/refuse should not take place externally between the hours of 22.00-08.00 hrs.
18 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
