Annex 2 - Conditions consistent with the Operating Schedule
1 There are no restictions on the provision of alcohol, regulated entertainment and late night refreshment to residents and their bona fide guests.
2 Sale by retail of alcohol on the premises only to non-residents is permitted Monday to Sunday from 11.00 to midnight (extended to 01.00 for those persons attending a pre-arranged private function). Only the areas highlighted and referred to on the plan as Games Room / Pool Room, Ballroom, Dining Room, Bar Lounge and Front Patio will be open to non-residents between the authorised hours.
3 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
4 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
5 At least one personal licence holder is available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
6 Only toughened glass vessels are to be used to dispense beer to customers.
7 Until such time as the means of escape from all parts of these premises has been improved to the satisfaction of the Fire Authority and appropriate occupancy figures have been set by that authority and confirmed, by them, in writing, those elements of this licence which refer or relate to the provision of entertainment or to the supply of alcohol to non-residents of the hotel will have no effect.
8 The primary purpose of the premises operation will be as a hotel providing residential accommodation and ancillary facilities for hotel residents.
9 There will be no off sales of alcohol from the premises.
10 At the end of permitted hours all bars available to non-residents will be closed until all non-residents have vacated the premises and there will be no further sales or supply of alcohol until the premises are clear of the general public.
11 Any risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be available for inspection by an Officer or Authorised Person.
12 The premises will be operated in accordance with the general principles of the local 'Nightsafe' initiative, as far as they are relevant to the nature of the operation of the premises.
13 The Designated Premises Supervisor, when present, and all members of staff will ensure that all lawful instructions and/or directions given by the Police are complied with.
14 Another member of staff will be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
15 There will be no promotions that encourage illegal, irresponsible or immoderate consumption of alcohol.
16 No person in possession of a drink in a sealed or unsealed container will be allowed to enter the premises except for the purposes of delivery.
17 Adequate provisions will be made to prevent unauthorised access to the storage of empty bottles.
18 All parts of the premises will at all times be kept free from defect and no structural changes or alterations on any part of the premises will be made without the prior approval of the Council.
19 All exits and escape routes to the exits (including external escape routes) from the premises will be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises. External escape routes will also be kept free from ice and snow.
20 All doors or gates both inside and outside the premises which are on an escape route will be fitted only with approved fasteners and will at all times be properly maintained, free from obstruction and be capable of being opened easily and fully so that they do not restrict the public leaving the premises.
21 Where a door on an escape route opens against the direction of exit travel, it will be locked in the open position by a tamper-proof fastening when the premises are in use and there will be a clearly visible notice in capital letters which contains the following words: "THIS DOOR WILL BE KEPT LOCKED IN THE OPEN POSITION WHEN THE PREMISES ARE OCCUPIED" displayed in a clearly visible position next to the door.
22 All exit doors from the premises or enclosure(s) surrounding it will be capable of being opened by any person without the use of a key, card, code or other similar means and be kept free from all fastening devices when the premises are open to the public.
23 All exit routes and doors on such routes will be checked at regular intervals when the premises are open to the public to ensure that they are free from defect, obstruction, trip hazards and surfaces are not slippery.
24 The method of opening any exit door or gate from the premises will be clearly displayed immediately above or below the fastening in white block lettering on a green background in letters not less than 50mm high.
25 Where a fire-resisting door is fitted within the premises and that door is required to be kept closed at all times then the door will be clearly marked on both sides with a sign bearing the words "FIRE DOOR KEEP CLOSED" in block letters not less than 50mm high and clearly visible when the premises are open to the public.
26 Any door or gate in the premises which is not an exit door or gate will have a sign bearing the word "PRIVATE" in block letters not less than 50mm high.
27 Any chain, padlock or any other device used to lock an exit door when the premises are not in use will be removed and stored when the premises are open to the public.
28 The furniture or seating in the premises will be arranged so that it does not obstruct any exit, route to any exit or to any facility within the premises.
29 Where any furnishing or fitting in the premises including wall, floor and ceiling linings requires further periodic treatment to maintain the surface spread of flame qualities, they will be treated in accordance with the manufacturer's specifications.
30 No curtain, hanging or any other decoration will be positioned so as to obstruct any exit, sign or fire fighting equipment.
31 Notices will be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other emergency arises and how to call the Fire Service.
32 A person who is nominated for the purpose of taking control in the event of a fire, fire alarm, emergency or event which may affect the safety of persons attending the premises will be on and in charge of the premises at all times when any licensable activity is being provided. That person will be responsible for calling the Fire Service in the event of any fire and that person will also be responsible for meeting the Fire Service and guiding them to the fire.
33 Any outbreak of fire of any kind will be reported to the Fire Service immediately.
34 Clear and unobstructed access will be available to the premises for use by the emergency services and emergency service vehicles at all times.
35 There will be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
36 When the public are present, the lighting levels in all parts of the premises will be capable of providing sufficient illumination for them to leave the premises safely. The lighting level will be maintained by an emergency lighting system which will automatically operate when the electricity supply to the main lighting is interrupted.
37 The controls for the emergency lighting will be protected from unauthorised use and accidental operation and the system designed so that the emergency lighting cannot be altered.
38 Every battery which is used to power an emergency light or exit sign will be maintained in a fully charged condition at all times.
39 Regular inspection of all normal and emergency lighting will take place. All faults discovered will be repaired immediately or if that cannot be done then as soon as is possible.
40 No temporary electrical wiring or distribution system will be installed in the premises unless the installation is carried out by a suitably qualified and competent person. The licence holder will obtain a certificate from that person that the installation is fit for the purpose and complies with British Standard 7671 and where applicable, British Standard 7909. A copy of that certificate will be produced by the licence holder if requested to do so by an authorised Officer of the Council or an authorised Officer of Lancashire Constabulary and the Fire Rescue Service.
41 The premises will be provided with adequate lavatory accommodation which will, at all times, when the premises are in use be kept clean, ventilated, disinfected and supplied with hot and cold water, soap, toilet tissue, hand drying and sanitary towel disposal facilities as appropriate.
42 No explosive, liquefied petroleum gas or any other highly flammable materials will be used or stored on the premises unless notified to the Licensing Authority and is used in accordance with any guidance given by Lancashire Fire and Rescue Service.
43 No pyrotechnics including fireworks will be used or stored at the premises unless notified to the Licensing Authority and they are used in accordance with any guidance given by Lancashire Fire Service.
44 No dry ice machines or cryogenic fog, smoke machines or fog generators will be used at the premises unless notified to the Licensing Authority and used in accordance with any guidance given by Lancashire Fire Service.
45 Lasers will only be used on the premises in accordance with the requirements for the safe use of lasers as set down in the HSE Guide, The Radiation of Safety Lasers Used for Display Purposes [HS(G)95] and BS60825: Safety of Laser Products British Standard 4803: part 3.
46 No strobe light will be used in the premises unless a notice which can be clearly seen and easily read warning that strobe lights are in use in the premises is displayed at each entrance to the premises.
47 No nuisance will be caused by noise coming from the premises or by vibration transmitted through the structure of the premises.
48 A clear, legible and conspicuous notice requesting patrons to avoid causing noise, nuisance or disturbance to local residents shall be displayed at the exit from the premises.
49 Reasonable steps will be taken to encourage customers to leave the premises and the area quietly.
50 Refuse, such as bottles will be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.
51 No light from or on the premises and any other light under the control of the premises will be provided where that light causes a nuisance to any nearby premises.
52 There will be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy will require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport indicating that they are over 18 years of age.
53 A notice or notices will be displayed in and at the entrance to the premises where they can be clearly seen and read and will indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
54 Children in the licensed areas will be required to be supervised by an adult at all times.
55 Soft drinks and non-alcoholic drinks will always be available.
56 CCTV will be installed internally and externally at the premises and will comply with the following:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system.
The system will display on any recording the correct time and date of the recording.
The system will make recordings during all hours the premises are open to the public.
VCR tapes or digital recording shall be held for a minimum of 31 days and 28 days respectively, after the recording is made and will be made available to the Police or any authorised persons acting for a Responsible Authority for inspection upon request.
The system will, as a minimum record, images of the head and shoulders of all persons entering the premises.
57 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay when requested.
58 The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
59 Appropriate signage alerting customers to CCTV recording shall be displayed in conspicuous positions on the premises.
60 Quarterly documented maintenance checks of the CCTV system, including the recording system will be undertaken by the Designated Premises Supervisor to ensure that the system is in good working order and fit for purpose.
61 The Licence Holder and Designated Premises Supervisor shall ensure that an appropriate number of licensed door supervisors are on duty whenever the premises are open for the purpose of a licensable activity or when patrons are upon the premises. An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe Scheme. A minimum of one door supervisor will be on duty from 19.00 hours until the terminal hour when the premises is open to non-residents on Friday, Saturday and Sunday.
