Annex 2 - Conditions consistent with the Operating Schedule
1 No entertainment of an adult or sexual nature will take place on the premises.
2 Prior to and during any event involving the provision of recorded or live music a noise assessment shall be undertaken to ensure compliance with the following guidelines provided in the Code of Practice on Environmental Noise Control at Concerts (Noise Council 1995):
The music noise level (MNL) when assessed at the prediction stage or measured during sound checks or during the concert shall not exceed the following noise levels when measured 1M from the facade of any sensitive premises for events between 0900 and 2300 hours:
i. For 1 to 3 events per year - the MNL shall not exceed 65dB (A) measured over 15 minutes.
ii. For more than 3 events per year - the MNL shall not exceed the background noise level by more than 15 dB (A) measured over 15 minutes.
A sound limiter / cut out device should be installed by a reputable sound engineer to ensure that the MNL is maintained throughout the event.
3 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
4 The premises licence holder will arrange for litter dropped in the vicinity of the licensed premises to be collected and removed at the licence holder's expense at a frequency of not less than sixty minute intervals during opening hours. For the purposes of this condition 'the collection and removal of litter' should be taken to include the washing away to the gutter of spilled food and similar materials so as to leave the footway in a clean, safe and wholesome condition.
5 At least one personal licence holder (whose identity will be known to all other staff engaged in the sale or supply of alcohol) will be available within the Park while the supply or sale of alcohol is being undertaken.
6 The licence holder and the Designated Premises Supervisor shall nominate another person, who will deputise for the DPS in the DPS's absence, and shall ensure that the identity of the deputy is known by all other staff when such absence occurs.
7 Licensable activity on these premises will be limited to only 60 days per calendar year.
8 An authorisation of sales, signed and dated by the DPS, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises. All staff involved in sales will be at least 18 years of age and will receive training to promote the licensing objectives. All training to be documented and records made available on request to Lancashire Police or any authorised officer.
9 CCTV will be in operation whenever licensable activity is taking place at the premises and will comply with the following:
i. The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the bars, with the exception of the toilets, are to be covered by the system.
ii. The system will display on any recording the correct time and date of the recording.
iii. The system will make recordings during all hours the premises are open to the public
iv. VCR tapes or digital recordings shall be held for a minimum of 30 days after the recording is made and will be made available to the Police, or to any officer acting for a Responsible Authority, for inspection upon request.
v. The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
10 A staff member who is conversant with the operation of the CCTV system will be on the premises at all times the premises are open to the public. This staff member will be able to show Police recent data or footage with the absolute minimum of delay when requested.
11 An A4 advisory sign indicating that CCTV is in operation at the premises should be displayed. To comply with data protection legislation, signs should also include: the person or organisation responsible for the system, the purpose of the system, and details of who to contact regarding the system.
12 The Licence Holder or Designated Premises Supervisor shall notify the Police Licensing Unit on any occasion when the CCTV system is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
13 All alcoholic drinks will be dispensed in either polycarbonate or plastic vessels.
14 The Licence Holder and the DPS are to support and rigorously enforce a Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme Card
OR any other nationally or locally approved form of identification which may be introduced in the future. If no suitable identification is provided, sale of alcohol to them will be refused. Signs promoting this policy shall be prominently displayed at public entrances and alcohol sales areas.
15 All staff to have received suitable training in relation to the proof of age scheme. Records to evidence this will be made available to an authorised officer upon request.
16 Risk assessments carried out by or on behalf of the Licence holder which relate to a licensing objective will be available for inspection by an officer or an authorised officer acting for a Responsible Authority.
17 An adequate number of security staff will be on duty as appropriate to any risk assessment and in accordance with Nightsafe guidelines.
18 All persons conducting security duties must be registered by the SIA and comply with SIA requirements relating to the availability of registration documents for inspection.
19 A record shall be kept on the premises of every person employed at the premises as security or door supervisor. The record is to contain the following details:
i. Name and address
ii. Date of birth
iii. SIA licence number
iv. Time duty commenced and time duty terminated
Said records are to be made available for inspection upon demand by a Police Officer or any officer acting for a Responsible Authority.
20 The premises will have a zero tolerance policy towards drugs.
21 A drugs prevention strategy for the venue shall be developed, applied and documented.
22 Security arrangements are sufficient to discourage the sale and consumption of drugs and shall ensure such arrangements include regular checks of toilet areas.
23 Where there is reasonable suspicion that drugs are being carried, the licensee shall ensure that the outer clothing, pockets and bags of those entering the venue are searched by a trained staff member of the same sex.
24 Confiscated and found drugs shall be stored, disposed, transferred in accordance with procedures agreed with the Lancashire Constabulary.
25 An incident book will be maintained, in which shall be recorded:
i. All incidents of crime and disorder
ii. Refused sales to suspected under age / drunken persons
iii. A record of any person refused admission or asked to leave the premises
iv. Details of occasions upon which the Police are called to the premises
v. The use or discovery of drugs
The incident book will be available for inspection by a Police Officer or any Officer acting for a Responsible Authority.
26 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
27 The Licence Holder and the Designated Premises Supervisor shall ensure that the arrangement for the storage of empty bottles prevents unauthorised access to those bottles
