Annex 2 - Conditions consistent with the Operating Schedule
1 a) On New Years Eve permitted hours for provision of recorded music, late night refreshment, supply of alcohol and the opening hours of the premises may be extended to the start of permitted hours on following day.
b) On Christmas Eve, Christmas Day, New Years Day, and Bank Holidays, the permitted hours may be extended by one hour for provision of recorded music, late night refreshment, supply of alcohol and the opening hours of the premises.
2 Alcohol shall not be sold or supplied on the premises otherwise than to:
a) Persons taking table meals on the premises and for consumption as an ancillary to the meal only during such meals.
b) Persons attending pre-arranged private functions, not organised by the Designated Premises Supervisor, Premises Licence Holder or any other employee at the premises.
3 The supply of alcohol will be by waiter/waitress service (except to those attending a pre-arranged private function) and only to persons seated at tables.
4 All licensable activites are permitted on the Ground Floor only. Recorded music may not be played in the external areas.
5 CCTV will be installed internally and externally at the premises and will comply with the following:
The CCTV system shall be installed, maintained and operated to the reasonable satisfaction of Lancashire Constabulary. All public areas of the premises are to be covered by the system.
The system will display on any recording the correct time and date of the recording.
The system will make recordings during all hours that the premises are open to the public.
The VCR tapes or digital recording will be held for a minimum of 31 days and 28 days respectively after the recording is made and will be made available to the police or any authorised persons acting for a responsible authority for inspection upon request.
The system will, as a minimum, record images of the head and shoulders of all persons entering the premises.
A staff member who is conversant with the operation of the CCTV system will be on the premises at all times that the premises are open to the public. This staff member will be able to show police recent data or footage with the absolute minimum of delay, when requested.
The Licence Holder or Designated Premises Supervisor will notify the Police Licensing Unit on any occasion when the CCTV is to be inoperative for a period in excess of one working day and shall provide a certificate from a competent person stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
Appropriate signs informing customers that CCTV is recording will be displayed in conspicuous positions on the premises.
Monthly documented maintenance checks of the CCTV system, including the recording system, will be carried out by the Designated Premisies Supervisor to ensure that the system is in good working order and fit for purpose.
6 The Police Licensing Unit shall be notified on any occasion when the CCTV or radio system is to be inoperative for a period in excess of one working day and a certificate from a competent person shall be provided stating the reason for the system being inoperative and the measures which have been taken to satisfy the licence conditions.
7 The licence holder will maintain a strict door policy and continue to encourage a more mature audience. In addition, and where appropriate, the licence holder will liaise with the local Town Centre Forum and consider adoption of any relevant crime and disorder initiative.
8 The licence holder is to support and rigorously enforce the Challenge 25 proof of age policy.
Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:
i. UK photo driving licence
ii. Passport
iii. Proof of Age Standards Scheme card.
9 All staff are to have received suitable training in relation to the proof of age scheme to be applied upon the premises. All staff are to receive regular refresher training at intervals of a maximum of six months. Records to evidence this will be made available to an authorised officer upon request.
10 An adequate number of licensed door supervisors will be on duty as appropriate to any risk assessment and in accordance with the guidance under the Nightsafe scheme.
11 Appropriate measures will be taken to ensure staff prevent the removal of bottles or glasses from the curtilage and grounds of the licensed premises.
12 Frequent collection of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises.
13 At least one personal licence holder will be available while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
14 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
15 An authorisation, signed and dated by the Designated Premises Supervisor, shall be kept at the premises showing all persons authorised by them to make sales of alcohol at the premises.
16 Risk assessments carried out by or on behalf of the licence holder which relate to a licensing objective will be available for inspection by an authorised officer.
17 The premises shall maintain a drinks policy which complies with any Local Authority resolution made in accordance with approval from the Licensees Forum or any successor body recognised by the Licensing Authority.
18 During the final hour of daily trading appropriate announcements shall be made or images projected to remind patrons of the need to leave the premises without causing annoyance, nuisance or disturbance to local residents and further to advise patrons of any taxi freephone or collection arrangements available upon the premises.
19 A clear, legible and conspicuous notice requesting patrons to avoid causing noise nuisance or disturbance to local residents shall be displayed at every exit.
20 The volume of amplified sound used in connection with any regulated entertainment shall at all times be under the control of the licence holder or management and the controlling mechanism shall be operated from a part of the premises inaccessible to the public.
21 Noise from any regulated entertainment, mechanical ventilation or refrigeration plant shall be inaudible within the nearest sensitive properties or, at the discretion of the Local Authority, shall not exceed some other pre-agreed limit, which does not cause unreasonable disturbance to the residents of those properties or their guests.
22 All internal lobbied doors to any entrance/exit point, fire exit doors and external windows shall be closed during hours of any regulated entertainment except in the event of an emergency and save for the purposes of access and egress.
23 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
24 The premises shall be operated in participation with the "Pubwatch" and "Radiolink" schemes.
25 All doorstaff employed at the entrance/exit of the the licensed premises will wear a reflective jacket/tabard of a design approved by Lancashire Constabulary.
26 The Radiolink equipment will be "live" and will be monitored by the head doorman or another responsible person while the licensed premises are open for business.
27 Door staff will monitor and adequately manage any queue which forms to gain entry to the premises.
28 Any person who appears to be intoxicated or who is behaving in a disorderly manner will not be allowed entry to the venue. Any person within the premises who appears to be intoxicated or who is behaving in a disorderly manner will be given care and consideration in leaving the venue.
29 All staff are to have received suitable training with regard to serving drunks. All staff are to receive regular refresher training at intervals of a maximum of three months. Records to evidence this will be made available to an authorised officer upon request.
30 Fire exits will be clearly lit and escape routes will be clearly marked and remain unobstructed at all times in case of emergency. The fire alarm system will be tested regularly to include fire-fighting aids such as extinguishers and fire blankets. Current certification will be available for the following: Electrical Inspection reports certificate, Fire Alarm test inspection report, Emergency Lighting inspection and test report, Gas Safety certificate and Operations Log.
31 Rubbish will be disposed of in accordance with guidelines prescribed by the local authority and refuse disposal will not pose a fire hazard.
32 The maximum number of persons to be accommodated in the premises at any one time shall be 180.
33 The doors to the outdoor area are to be closed at midnight to prevent noise nuisance to local residents.
34 Any external smoking area provided for the premises shall be located in such a position so that its use does not cause a nuisance to any nearby sensitive premises.
35 Any external smoking area must be a clearly defined area with a barrier enclosing customers and adequately supervised. No drinks will be permitted in this area.
36 The entrance / exit will be via the Promenade. There will be no entrance / exit onto The Strand save for fire / emergencies.
37 The boundary of the outdoor areas will be clearly marked by, at the front of the premises, a fixed barrier, and at rear of the premises, a removable barrier. Sufficient facilities to have all customers seated will be provided at all times. The areas will be adequately supervised by staff / door supervisors and will be covered by CCTV.
38 All beverages to be consumed outdoors will be served in plastic / polycarbonate drinking vessels with all glass bottles decanted into such drinking vessels.
39 The premises licence holder shall provide suitable containers for the storage of waste which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external waste receptacles provided for the disposal of all smoking-related litter so as to prevent waste litter being deposited on to the highway.
40 Functions which specifically target young people aged 17-18 years (for example birthday parties) will not be allowed to take place on the premises.
41 No entertainment of an adult nature will take place on the premises.
