• Annex 1 - Mandatory conditions

   

  Exhibition of films

   

  1              Where the film classification body is specified in the licence, unless (2) applies, admission of children must be restricted in accordance with any recommendations made by that body

   

  2              Where  -

   

  a)              The film classification body is not specified in the licence,

   

  or

   

  b)              The relevant licensing authority has notified the holder of the licence that this condition is applied to the film in question,

   

                Admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  Alcohol

   

  3              No supply of alcohol may be made under the premises licence -

   

  a)              At a time when there is no designated premises supervisor in respect of the premises licence,

   

  or

   

  b)              At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  4              Every supply of alcohol under the premise licence must be made or authorised by a person who holds a personal licence.

   

  5              (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  6              The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  7               (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either a holographic mark, or an ultraviolet feature.

   

  8               The responsible person must ensure that -

   

  (a) where any of the following alcoholic drinks are sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

   

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  9              (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

                (2) In this condition:-

  a.              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  i.              P is the permitted price,

  ii.              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  iii.              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  b.              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  c.              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  i.              the holder of the premises licence,

  ii.              the designated premises supervisor (if any) in respect of such a licence, or

  iii.              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  d.              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  e.              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

                (3) Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

   

                (4) Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax, the permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

  Annex 2 - Conditions consistent with the Operating Schedule

   

  1              No entertainment of an adult nature will take place on the premises.

   

  2              Alcohol may only be supplied in the Festival Headlands area within Zone 4 and Town Centre zone indicated on the attached plans.

   

  3              Monthly Safety Advisory Group meetings will be held, chaired by the premises licence holder, at which the emergency services are fully briefed on the upcoming events for the year.

   

  4              Contingency plans will be in place for dealing with any major incidents as outlined in the Management of Health and Safety at Work Regulations 1999.

   

  5              Risk assessments will be carried out by the licence holder for every event and shall be available for inspection by an authorised officer or a Responsible Authority.

   

  6              For an event with an anticipated capacity of 500 or more, a detailed risk assessment shall be forwarded to Lancashire Constabulary Licensing Department a minimum of 4 weeks prior to the event unless the event falls on a Bank Holiday weekend, when the notice period will be 6 weeks. The risk assessment will include details of anticipated capacity, number of stewards, the company organising the event and their relevant contact details, the proposed DPS, and drugs and weapons policies. For events on the Promenade, copies of these risk assessments with details of the event shall also be provided to Blackpool RNLI, Central Promenade, Blackpool, regarding Health and Safety due to the proximity of the sea.

   

  7              In relation to any event the Premises Licence Holder shall follow the principles within The Event Safety Guide - A Guide to Health, Safety and Welfare At Music and Similar Events - HSG 195, Published by the Health and Safety Executive (HSE) 1999 ISBN 0 7176 2453

   

  8              Before entry to enclosed venues, appropriate checks will be made of all fire and emergency services by a qualified Health and Safety Officer. These include: unblocked exits, clear escape routes, working emergency lighting, working fire fighting equipment, emergency PA system.

   

  9              An appropriate number of stewards and/or police officers will be on duty for all events  in accordance with a risk assessment and for events at which an attendance over 500 persons could be anticipated this shall be in accordance with the Event Safety Guide).

   

  10              A clear chain of command will be in place and where appropriate, Gold / Silver / Bronze command, in accordance with Police guidelines for events over 499 spectators.

   

  11              CCTV recording will be in place where practicable.

   

  12              Waste management will be the responsibility of the event manager and will include adequate provision for regular and safe disposal of rubbish.

   

  13              Random searches will take place at entrances where deemed appropriate.

   

  14              All stewards will be fully briefed before commencing work and will be made highly visible by wearing hi-vis jackets during events.

   

  15              Provision of adequate facilities  for refreshments, sanitary requirements etc, will be provided in accordance with the Event Safety Guide.

   

  16              The licence holder shall ensure that adequate first aid provision (according to risk assessment) is available at all times events are taking place.

   

  17              There will be a clear, effective means of communication with the audience at all times and pre-determined announcements in case of an emergency.

   

  18              In the event of strobe lighting or similar the audience will be notified before the start of the event.

   

  19              There will be clearly advertised collection points for lost children, supervised at all times with fully briefed staff.

   

  20              Stewards will marshal all crossing points of the tramway when necessary.

   

  21              The use of explosives, pyrotechnics and fireworks of a similar nature, which could cause disturbance in surrounding areas, shall be restricted in accordance with requirements specified by the Council.

   

  22              The volume of amplified sound used in connection with entertainment shall at all times be under the control of the licence holder and the controlling mechanism will be operated from an area inaccessible to the public.

   

  23              At the end of each event, whenever possible, announcements will be made to remind the public of the need to leave the area without causing annoyance, nuisance or disturbance to local residents.

   

  24              The provision of Late Night Refreshment is only permitted in zones 4, 5, 6 and the Town Centre as indicated on the attached plan.

   

   

  Additional conditions in relation to the Tower Festival Headland:

   

  25              A suitable control room, agreed with the police at least 4 weeks before the event, will be staffed from by trained personnel to monitor large scale events for incidents of crime and disorder.

   

  26              Alcohol shall only be supplied at events with an expected capacity of 500 people or more.

   

  27              The use of glass containers (including bottles) shall not be permitted. Beverages shall be served in their cans or in plastic or polycarbonate containers.

   

  28              The area shall be fenced off with a maximum of two controlled entrances which shall be staffed at all times. Any exits from the area shall also be staffed.

   

  29              Suitable signage shall be displayed in appropriate areas to specify that a Challenge 25 Policy shall be in place.

   

  30              The licence holder and the DPS shall support and rigorously enforce the Challenge 25 Proof of Age policy. Any person who looks or appears to be under the age of 25 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable: photo driving licence; passport; Proof of Age Standards Scheme Card; any other locally or nationally approved form of identification which may be introduced in the future.

   

  31              Alcohol shall only be sold or supplied to persons attending the event. Except for the purpose of delivery, no alcohol shall be allowed to be taken into the site. Only alcohol bought inside the site shall be allowed to be consumed within the site.

   

  32              All staff involved in the sale or supply of alcohol shall have received suitable training in relation to the proof of age scheme to be applied upon the site.  Records to evidence this shall be made available to an authorised officer upon request. Staff will also be briefed on responsible drinking practices.

   

  33              Clearly visible notices shall be displayed advising those attending that:

   

  a.              Alcohol may not be brought on site

  b.              It is a condition of entry that customers agree to be searched 

  c.              The Police will be informed if anyone is found in possession of controlled substances or weapons.

   

  34              Where there is reasonable suspicion that drugs, weapons, or unauthorised alcohol are being carried the licence holder or DPS shall ensure that outer clothing, pockets and bags of those entering the site are searched by a trained staff member of the same sex.

   

  35              The site shall operate a zero tolerance drugs policy. Confiscated and found drugs shall be stored, transferred and disposed in accordance with procedures detailed in the event risk assessments.

   

  36              Regular patrolling by the event stewards shall take place at all times the site is providing alcohol to ensure all incidents of crime and disorder drunkenness and anti-social behaviour are prevented and appropriately dealt with.

   

   

  Additional Conditions in relation to the Town Centre Zone

  47                            Lancashire Constabulary Police reserve the right to veto any Licensable Event in the interests of Public Safety.

   

  48              Personal Licence holder, DPS, will be on site at all times.  A log will be kept of supervisors on site.

   

  49              Alcohol shall only be consumed or served in pre-determined designated areas after consultation with Police.

   

  50              An appropriate number of SIA registered stewards will be on duty for all events in accordance with a risk assessment where alcohol will be on sale for consumption on the premises.

   

  51              Town Centre CCTV recording will be in place at all times when outdoor consumption of alcohol is taking place.

   

  52              Door Staff will use the Town Centre Link Radio to inform CCTV of any issues.

   

  53              Each designated area which is to be used for the “on” sales and consumption of alcohol shall be fenced off with a maximum of two controlled entrances. These entrances shall be staffed at all times whilst alcohol is available. Any exits from the area shall also be staffed by SIA registered staff.

   

  54              Stewards will marshal all entry/exit points to enclosed areas where alcohol is to be consumed.

   

  55              At the end of each event, whenever possible, announcements will be made to remind the public of the need to leave the area without causing annoyance, nuisance or disturbance to local residents. Any announcements will also remind customers of the Town Centre Street Drinking Ban, and the need to dispose of any unfinished alcohol.

   

  56              All bottle bins are to be kept secure and any broken glass on site is to be cleared up immediately.
