Annex 2 - Conditions consistent with the Operating Schedule
1 Sale of alcohol to residents is permitted 24 hours a day.
2 Non residents are only permitted to purchase alcohol on the premises Sunday to Thursday 10.00 - 23.00 and Friday to Saturday 10.00 to midnight when attending a function or as an accompaniment to food when dining at the premises.
3 The supply of intoxicating liquor shall be by waiter / waitress service only, and only to persons seated at tables.
4 Off sales are subject to the following: Any unfininshed bottles of wine must be recorked before being taken away from the premises. No other off sales are permitted.
5 The management will use their best endeavours to ensure that any customers using the external areas do not cause nuisance to neighbouring businesses or residents.
6 The management will ensure that the external parts of the premises are kept tidy and so do not cause a nuisance to neighbouring businesses or residents.
7 The walled terrace garden will be closed at midnight.
8 No entertainment of an adult nature will take place on the premises.
9 Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to, food served in the licensed premises.
10 At least one personal licence holder will be available (i.e. contactable by telephone at all times the premises are open and able to attend the premises within 30 minutes of the call) while the supply or sale of alcohol is being undertaken (whose identity will be known to all other staff engaged in the supply or sale of alcohol) except in the case of emergency.
11 Another member of staff shall be nominated to act for the Designated Premises Supervisor, in their absence, whose identity is known by all other staff when such absence occurs.
12 Frequent collections of glasses and bottles will be undertaken to ensure that empty containers do not accumulate in or around the licensed premises. Pint glasses shall not be used.
13 Noise from any regulated entertainment shall be inaudible within the nearest sensitive properties.
14 All internal doors to any entrance / exit point, fire exit doors and external windows shall be closed during any regulated entertainment except in the event of an emergency, save for the purpose of access and egress.
15 Vibration produced as a result of any regulated entertainment shall not be perceptible in any adjoining or nearby sensitive properties.
16 There shall be placed at all exit points from the premises in a place where they can be seen and easily read by the public, clear and legible notices requiring customers to leave the premises and the area quietly so as to minimise disturbance to nearby residents.
17 The collection and disposal of bottles and refuse should not take place externally between the hours of 22:00 and 07:30 so as to minimise disturbance to nearby residents.
18 The premises licence holder shall provide adequate ventilation so as to ensure that cooking, noxious or persistent smells generated at the premises do not cause nuisance to properties within close proximity.
19 The premises licence holder shall provide suitable containers for the storage of waste, which are constructed and maintained to prevent the removal of such waste by vandals, thieves, animals, accidental spillage or inclement weather. This shall include any external receptacles provided for the disposal of all discarded smoking related litter, so as to prevent waste litter being deposited onto the highway. Smoking will not be permitted at any time inside the premises.
20 Any external light source associated with the premises shall not cause a nuisance or disturbance to any property within close proximity.
21 All external smoking areas provided for the premises shall be located in such a positon, so that any associated use does not cause a nuisance to any nearby noise sensitive properties.
22 A zero tolerance drugs policy will be adopted at the premises, which will apply equally to any form of substance abuse. No person who is or appears to staff to be affected by any substance (including alcohol) abuse will be admitted to the premises. The management reserves the right to deny the service of alcohol to any person at any time, should it be deemed necessary according to management policy.
23 All emergency escape routes and exits will be maintained so as not to cause hindrance in the event of an evacuation.
24 Annual and five yearly checks of the systems installed at the premises will take place. The premises are fitted with fire alarms, fire extinguishers and emergency lighting to the current legal requirements, regularly tested, inspected and certified with required notices displayed.
25 All staff to have received suitable training in relation to the proof of age scheme to be applied upon the premises. Records to evidence this will be made available to an authorised officer upon request.
26 Proof of identity shall be required from all residents and persons wishing to be served alcohol who appear to be under the age of 21 years shall be required to produce proof of age by way of one of the following:
i) A recognised proof of age card accredited under the British Retail Consortium's Proof of Age Standards Scheme (PASS)
ii) Photo driving licence
iii) Citizen card supported by the Home Office
iv) Official ID card issued by HM Forces or European Union bearing a photograph and date of birth of the holder.
27 CCTV with sound is installed at the premises, with a view of the area in which alcohol may be served and consumed and covers all exits / entrances.
28 Unaccompanied children are not admitted to the premises. Persons under the age of 18 may be present only as hotel residents, accompanied by or by arrangement with persons having parental responsibility.
29 No gambling machines will be installed on the premises. No gambling for money will be permitted in public areas.
